About this file
This is a Justification for Sole Source Procurement document submitted by the Centers for Disease Control and Prevention (CDC) on behalf of the National Institute for Occupational Safety and Health (NIOSH) Respiratory Health Division/Surveillance Branch.
The procurement seeks to award a sole source contract to the Association of Occupational and Environmental Clinics (AOEC), located at 1010 Vermont Avenue, NW, #513, Washington, DC 20005, for the maintenance and updating of an active Exposure Code List and online web-based lookup system. This system supports evidence-based occupational public health surveillance by documenting exposures associated with occupational disease and injury. The estimated contract value is $40,000 for the base period plus $40,000 for each of three option years (total potential value: $160,000). The Procurement Request Number is 000HCCHD-2026-98004. The justification for sole source procurement is based on the determination that only one source is available capable of providing the integrated combination of services, specifically: a national network of more than 60 occupational and environmental health member clinics, a clinical case surveillance database derived from occupational health clinical practice, and a standardized Exposure Code List used to classify chemical, physical, biological, and mixed occupational exposures. AOEC has maintained and actively updated this system since its founding in 1987 and has been the exclusive provider of this integrated system to NIOSH-funded State partners for work-related asthma surveillance since 1999. Market research confirmed that competing federal and public databases such as OSHA's Occupational Chemical Database and NIH resources provide only hazard reference or toxicological data without the clinical case surveillance capability or standardized exposure classification linked to a national clinic network. The justification was certified by Program Official Katelynn Dodd on July 14, 2026, and by Contracting Officer Brian M. Swann on July 15, 2026.

JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN MARKET OR GSA)
UNDER $350,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 12.102 or 8.401 (GSAR 538.7104-3). At a minimum, the following information must be included:
Identification of Program Office, Contracting Activity, and Proposed Requirement, Justification and Program Office Certification:
A. Program Office:
National Institute for Occupational Safety and Health Respiratory Health Division/Surveillance Branch PO: Katelynn Dodd 1000 Frederick Lane Morgantown, WV 26508
Centers for Disease Control and Prevention
B. Contracting Activity:
Centers for Disease Control and Prevention Office of Financial Resources Office of Acquisition Services
C. Identification of Requirement:
1. Nature of Action to be Approved by Contracting Officer:
a. Sole source acquisition of: The purpose of this contract is to support and enhance evidence-based occupational public health surveillance practice through documentation and dissemination of exposures associated with disease and injury and to promote prevention of occupational illness and injury. This will be accomplished through maintaining and regularly updating an active and unique exposure code list and on-line web-based ‘look-up’ system. The Exposure Code List and on-line “look-up” system are valuable for occupational public health practices and surveillance purposes and are available to the public, particularly to clinicians in assisting them with their evaluation of a patient whose asthma may be occupational in nature. 3. Is the requirement on GSA Schedule? ☐ Yes ☒ No
If yes, provide schedule number: Click here to enter text.
D. Justification:
1. The justification for this non-competitive action is: (NOTE: Must select only ONE of the listed justifications for other than full and open competition and fully support the justification in the following paragraphs. Please delete this note prior to submitting the justification.)
☒ In accordance with FAR 12.102, “only one source is available” in accordance with 41
USC 1901:
X Only one source available A brand-name product or service being required without allowing “equal” products The need for compatibility with existing systems, equipment, software, licenses, warranties, or support arrangements Unusual urgency Exclusive licensing or proprietary rights Continuity of operations Other: [briefly describe]
☐ In accordance with GSAM 538.7104-3 as required in FAR 8.401(b) I hereby determine that the circumstances of this acquisition deems only one source reasonably capable of providing this requirement on the basis that:
The need is of such unusual urgency that following the procedures would result in unacceptable delays in fulfilling that need;
Only one source is capable of providing the products, services, or solution required at the level of quality required because the products, services, or solutions are unique or highly specialized;
The order should be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an FSS order already issued on a competitive basis;
It is necessary to place the order with a particular FSS contractor to satisfy a minimum guarantee established in the FSS BPA; or
A law expressly authorizes or requires that the purchase be made from a specified source.
Other: [briefly describe]
2. Market Research Conducted:
The Association of Occupational and Environmental Clinics (AOEC) is the only nationally recognized association of occupational and environmental health clinics and the only known organization that integrates:
(1) a national member-clinic network of occupational and environmental health practitioners,
(2) a clinical case surveillance database derived from occupational health clinical practice, and
(3) a standardized Exposure Code List used to classify chemical, physical, biological, and mixed occupational exposures.
Since its founding in 1987, AOEC has supported independent, evidence-based occupational public health practice through collaboration among clinicians, researchers, and public health practitioners. AOEC currently includes more than 60 member clinics across the United States that are committed to improving occupational and environmental health surveillance through shared information, coordinated clinical reporting, and collaborative research.
Because of its organizational structure and direct connection to occupational medicine clinics, AOEC maintains close communication with practitioners engaged in the day-to-day diagnosis and management of occupational diseases and injuries. This clinical network enables the systematic collection of case-based occupational exposure data directly from treating clinicians.
The AOEC clinical case surveillance database and its standardized Exposure Code List allow for timely documentation of sentinel occupational disease and injury cases and detailed information on workplace exposures in a non-regulatory clinical context. This capability enables early identification of emerging occupational health hazards that may not yet be documented in regulatory monitoring systems or scientific literature.
The AOEC Exposure Code List is a comprehensive classification system of occupational and environmental exposure agents, including chemical, biological, and physical hazards. The coding system enables clinicians and public health practitioners to capture detailed exposure information using standardized terminology, including: specific chemical and biological agents, physical hazards, mixed or complex exposures, exposures identified through patient history even when the exact agent is uncertain, emerging or poorly characterized exposures.
This capability is particularly important because occupational exposures frequently involve mixtures of agents or substances that may not yet have established toxicological profiles or regulatory standards. The AOEC Exposure Code List allows clinicians to document these exposures in a consistent format and link them to clinical cases of occupational disease.
The AOEC Exposure Code List has been actively maintained and updated and has been used since 1999 by NIOSH-funded State partners participating in work-related asthma surveillance programs. The use of a consistent exposure classification system over time enables the tracking of occupational diseases and their associated exposures across jurisdictions and across multiple years.
Maintaining and updating the Exposure Code List and the associated online exposure code lookup system allows clinicians and public health surveillance programs to: track the number of individuals with occupational diseases and associated exposures over time; identify emerging occupational hazards and exposure patterns; support clinical evaluation of suspected occupational diseases such as work-related asthma; and facilitate consistent reporting of occupational exposures across surveillance systems and clinical programs.
No other organization provides this combination of a national occupational health clinic network, a clinical case surveillance system based on patient encounters, and a standardized exposure coding system used by clinicians and public health surveillance programs.
3. Facts supporting sole source procurement: What can this product/service do that other products/services cannot do? Include description of other products/services considered and why they did not meet the need.
The Program Office conducted a search for publicly available databases and systems related to occupational exposures. The search identified several federal and publicly available resources, including the OSHA Occupational Chemical Database and multiple databases maintained by the NIH National Library of Medicine, including Haz-Map®, the Hazardous Substances Data Bank (HSDB), and the Household Products Database (HPD). These resources were reviewed and determined to provide hazard reference information, toxicological data, or chemical identification data but do not provide a clinical case surveillance system or a standardized exposure classification system linked to a national network of occupational health clinics. None of the identified databases or resources provide the integrated combination of services available through AOEC, including a national occupational and environmental health clinic network; a clinical case surveillance database capturing occupational disease cases; and a comprehensive Exposure Code List used by clinicians and public health practitioners to classify workplace exposures. Because no other organization provides these combined capabilities, AOEC is the only known source capable of meeting the program’s requirements.
