About this file

This is a Single Source Justification (SSJ) document for the US Army Corps of Engineers Wilmington District, seeking to procure an EZ Dock System for the Philpott Lake Project in Bassett, VA. The requirement is for one dock system consisting of 7 - 60"x10' dock sections, measuring 5' by 70', made of linear low-density polyethylene (LLDPE) in beige color, with a total estimated value of $29,590. The procurement will be a 100% small business set-aside, firm-fixed price contract awarded to the lowest technically acceptable offeror.

The justification for the brand-specific requirement is based on maintaining compatibility with existing dock systems at Philpott Lake, allowing for interchangeability of locations and spare parts. The contracting office conducted market research and found adequate small business suppliers, and no alternative sources have expressed interest in providing a different dock system. The previous purchase order (W912PM17F0052) was also unrestricted, and the contracting officer has certified the fair and reasonable pricing through market research methods.

4. Authority: FAR 13.106-1(b)(1)

Action using simplified acquisition procedures (select one):

FAR 13.106-1(b)(1)(i): For purchases not exceeding the simplified acquisition threshold (SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.

urgency, exclusive licensing agreements, brand name, or industrial mobilization)

5. Reasons for Authority Cited:

To maintain continuity on Philpott Lake and the ability to interchange dock locations in the application of this product, EZ dock system. The EZ dock docks are used to provide a platform for boaters and fishmen to facilitate the recreation on Philpott Lake. Purchasing products other than EZ dock system would result in additional costs to the agency by requiring additional manpower and equipment when moving docks from their location. All our existing docks are EZ docks and we need to maintain compatibility in order to keep stocked parts interchangeable.

6. Efforts to Increase Competition: Online efforts to solicit offers from as many potential sources of this dock system as practicable has been performed by Philpott Lake staff / Neal Ingram. This product is widely utilized by suppliers and installers and is not limited to exclusive sources owned or licensed by the manufacturer.

7. Actions to Increase Competition: The contracting office and project lake staff will continue to do market research to identify other suppliers of this product for future acquisitions.

8. Market Research: Internet searches. An adequate number of small businesses that supply and install this product exist within the market, therefore sufficient competition is expected on this requirement. A fair and reasonable price is expected and will be determined based on competition and comparison to the IGE. This acquisition is anticipated to be a 100% small business set-aside request for quote, firm fixed price contract, to the lowest technically acceptable offeror.

9. Interested Sources: To date, no sources sought have expressed interest in utilizing an alternative deck system for this acquisition.

10. Other Facts: Philpott Lake already has this type of dock system in multiple parks and at times move locations to better suit the needs of the public. Any other dock type would not interchange with our dock locations. Our project currently keeps spare parts for these Ez docks, and any other style dock would further complicate our tooling and parts stock resulting in increase cost to our agency.
