About this file

This is an AIA Document A101-2017 Standard Form of Agreement Between Owner and Contractor for a stipulated sum contract between the City of South Fulton, Georgia, and a contractor (to be determined) for the Conversion of Existing Clay Courts project located at 5645 Mason Road, SW, South Fulton, Georgia. The project is identified as City of South Fulton RFP 26-35. The contract specifies that work commencement will be established by a notice to proceed issued by the Owner, with substantial completion required not later than sixty (60) calendar days from the date of the notice to proceed. No architect has been designated for this project. The contract documents include the AIA Document A201-2017 General Conditions of the Contract for Construction, the City of South Fulton Supplemental General Conditions, the RFP 26-35, and the contractor's technical and cost proposals. Final payment is contingent upon receipt of all record documents, lien waivers, releases of claims, and subcontractor lien waivers.

The contract sum is to be determined (TBD), subject to additions and deductions as provided in the contract documents. Progress payments will be made monthly based on applications for payment approved by the Owner, with the Owner retaining ten percent (10%) of each payment until the project reaches fifty percent (50%) completion, after which retainage is reduced to five percent (5%). Upon substantial completion, no further retainage is withheld and eighty-five percent (85%) of the cumulative withheld retainage is released. Liquidated damages are assessed at five hundred dollars ($500) per day for each day beyond the date of substantial completion and an additional five hundred dollars ($500) per day for each day beyond the forty-fifth day following substantial completion for submission of record documents. Interest accrues at one percent (1%) per thirty-day period on unpaid amounts, levied after the forty-fifth day following the approved invoice date. The contract designates litigation in a court of competent jurisdiction as the binding dispute resolution method. Key City contacts include Gregory Dyson (General Services Director), William Whitaker (Procurement Director), Sharon D. Subadan (City Manager), and Sara Kelly (Interim City Attorney).
