(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6 of the Federal Acquisition Regulation (FAR), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) This solicitation is issued on 15 July 2025 as a Request for Proposal (RFP) via the Governmentwide Point of Entry at SAM.gov.

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2025-03.

(iv) This procurement is a total small business set-aside. The NAICS code is 212321 – Construction Sand and Gravel Mining, and the Small Business Size Standard is 500 EMP.

(v)Schedule of Items/Price Schedule. See Excel Document and Attachments in Section D.

Offerors shall use the Excel spreadsheet to provide pricing for items/categories listed.

(vi) Description of Requirement. See Section B herein and Attachments listed in Section D.

(vii) A detailed description of Project Locations can be found in Section B and Section D of this solicitation and any resulting contract, where applicable.

(viii) 52.212-1 Instructions to Offerors – Commercial Products and Commercial Services (NOV 2021) (Provision). See Section E for the applicable addenda to the provision and for specific instructions on how to submit quotations. Offerors are instructed to read the entire solicitation document, including all attachments, prior to submitting questions and/or preparing your quotation.

(ix) 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021) (Provision). See Section E of this solicitation for specific evaluation criteria. Paragraph (a) outlines the addenda of the provision.

(x)Interested and eligible offerors are required to include a copy of the Representations and Certifications in response to this solicitation. All offerors must have an ACTIVE registration in SAM.gov. See Section E for further instructions and requirements. If the Offeror has completed the FAR representations and can be accessed, the Offeror must complete the provision at FAR 52.212-3 Offeror Representation and Certifications – Commercial Products and Commercial Services, with the submission.

(xi) 52.212-4 Contract Terms and Conditions – Commercial Products and Commercial Services (NOV 2021) (DEVIATION 2017-1) are included in this solicitation and will be included in the resulting contract(s). Addenda to this clause can be found in Section C.

Minimum Insurance Coverage Requirements

Pursuant to FAR clause FAR 52.228-5, Insurance-Work on a Government Installation paragraph (a), Contractors shall present evidence and maintain, as a minimum, the amounts of insurance coverage indicated below:

(1) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they must be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. (2) General Liability. The Contractor must have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(3) Automobile Liability. The Contractor must have automobile liability insurance written on a comprehensive form of policy. The policy must provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States must provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(4) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor must have aircraft public and passenger liability insurance. Coverage must be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury must be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

ADDITIONAL REQUIREMENTS & CONTRACT CLAUSES

Invoices & Payment

All invoices are to be submitted via the electronic Invoice Processing Platform (IPP) System. Supplemental to the “Submit Invoice-To” information provided on the SF 1442, the offeror must have an established account prior to commencement of work. Invoice Processing Platform (IPP) does not allow for the contractor to change the description of the line items being invoiced against; therefore, an itemized invoice must be uploaded as an attachment(s).

Key Personnel (FEB 1988)

(a) The Contractor shall assign to this contract the following key personnel: Contractor Representative, Project Manager

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

USDA Bio-based/Sustainable Products Program

The contractor must comply with the Agriculture Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 9FSRIA), 7 U.S.C. 8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance”, dated October 2, 2009; EO 13423, “Strengthening Federal Environmental, Energy and Transportation Management”, dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Biobased and Sustainable Product Procurement,” dated February, 2012 to provide biobased products. All supplies and materials shall be of a type and quantity that conform to applicable Federal specifications and standards, and to the extent feasible and reasonable; include the exclusive use of biobased and recycled products.

In the performance of this contract, the Contractor shall make maximum use of biobased oils and lubricants that are designated by the United States Department of Agriculture unless the product cannot be acquired: (1) Competitively within a time frame providing for compliance with the contract performance schedule; (2) meeting contract performance requirements; or (3) at a reasonable price. Safety

The contractor must protect the lives and health of contractor employees; prevent damage to property, materials, supplies and equipment; and avoid work interruptions. As needed, the contractor will be responsible for providing appropriate safety barricades, signs, and signal lights to avoid accidents.

Occupational Safety and Health Administration (OSHA) Must be consistent with the OSHA Act of 1970. The Contractor is responsible for all hazardous conditions arising under this contract. Occupational Safety and Health Administration (OSHA) regulations, as well as this contract, impose the responsibility upon you to ensure that the working conditions are not unsanitary, hazardous, or dangerous to your employees’ health and safety. Forest Service employees will not inspect or accept the work under conditions that are hazards or unsanitary, that has not been mitigated to the extent required by OSHA. Any subcontract entered into pursuant to this contract shall similarly provide a work environment that is sanitary and not hazardous.

Personal Protective Equipment The contractor shall train workers in the safe operation and use of equipment that the worker may use before the worker begins using such equipment.

Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards or processes encountered which may cause injury or impairment in the function of any part of the body. Defective or damaged personal protective equipment shall not be used.

The contractor shall provide chain saw chaps to each employee who operates a chain saw, at no cost to the employee. These chaps must be approved by an Underwriters Laboratory or meet Forest Service specification 6170-47. The chaps shall cover the full length of the thigh and shall extend to the top of the boot on each leg.

The contractor shall assure that each employee wears foot protection that provides adequate traction and ankle support. Employees operating chain saws shall wear foot protection that is constructed with cut-resistant material which will protect the employee against contact with a running chain saw.

In any area where the worker is exposed to the potential for flying or falling objects, the contractor shall provide a hard hat, at no cost to the employee, and the contractor shall assure that the employee wears the hard hat. The hard hat must meet the minimum requirements of American National Standards Institute (ANSI) standard Z89.1-1997.

The contractor shall provide, at no cost to the employee, eye protection where there is potential for eye injury due to flying objects. This eye protection must meet the minimum requirements of

ANSI standard Z87.1-2003. The contractor shall provide, at no cost to the employee, hearing protection where there is a potential for hearing loss due to high intensity noise for example, chain saw operation.

Injury Notification Injuries to workers will be reported promptly to the COR and appropriate contractor personnel. Emergency care for workers while on the job site is a contractor responsibility.

Accident Reporting Report any accidents to the contract COR and CO as soon as possible. Maintain an accurate record of all work-related accidents resulting in death, injury, occupational disease, or damage to property, materials, supplies, or equipment.

The technical volume shall include, at a minimum, the information identified below in sufficient detail to allow for evaluation based on the criteria identified herein. It is strongly suggested that offerors organize their technical proposal with individual sections that address each of the following evaluation criteria:

Factor 1. Technical Approach to Performing the Work: At a minimum, describe your planned approach to performing this work. Include the type of equipment to be used, key personnel and their qualifications, logistics of equipment and supply delivery, crew accommodations, major sub-contractors and their roles, approach to maximizing local labor opportunities, biobased products to be used in the accomplishment of the work, and anticipated schedule of work. A proposal which merely paraphrases the requirements of the Government's Statement of Work or uses such phrases as "will comply" or "standard techniques will be employed" will be considered unacceptable and may not be considered further for award.

Use of the Forest Service Designation of Key Personnel-Reps form is mandatory. Form can be found in Section D of this Solicitation, and roles are editable. NOTE: Personnel may hold multiple roles.

Factor 2. Responsibility: Responsibility will be determined in accordance with FAR 9.104-1.

Each offeror must complete the Representations and Certifications in Section E of this solicitation.

Factor 3. Experience & Past Performance: The Government will assess the specialized experience and skill of the firm with a focus on experience that is relevant to the specified project. As a part of this assessment, the Government will consider the firm’s past performance history.

The Technical Volume must include a completed copy of the Experience Questionnaire. Complete all sections on the questionnaire and include a brief statement in block 13 regarding financial ability to perform the work. Form can be found in section D of this Solicitation.

(a) Proposals will be evaluated using the Tradeoff Process as defined in FAR 15.101. This process permits tradeoffs among price and non-price factors and allows the Government to award to other than the lowest priced proposal and other than the highest technically rated proposal, in accordance with FAR 15.101-1(a). The Government will consider the benefits associated with the offeror’s proposed approaches, experience, and qualifications to arrive at a confidence assessment of the offeror’s likelihood of successfully performing the work and meeting the requirements of the RFP.

The following table shows the adjectival ratings that will be used:

Excellent understanding of the requirements; significantly exceeds all the minimum requirements of the criteria; contains significant strengths, exceptional features, or innovation that should substantially benefit the Government;

contains no weaknesses or deficiencies; has a very high probability of success and the risk of unsuccessful performance is extremely low.

Good

Good understanding of the requirements; exceeds all the minimum requirements of the criteria; contains significant strengths or minor strengths, features, or innovation that should benefit the Government; weaknesses, if any, are minor and are more than offset by strengths; no deficiencies are noted; has a better than average probability of success and the risk of unsuccessful performance is very low.

Satisfactory Acceptable understanding of the requirements; meets all the minimum requirements of the criteria; there are few, if any, strengths or features to benefit the Government; has an average probability of success.

Marginal

Superficial or vague understanding of the requirements; fails to meet one or more of the minimum requirements of the criteria; there are weaknesses that cannot be offset by strengths and cannot be readily corrected; the risk of unsuccessful performance is moderate.

Unacceptable

Lacks understanding of the requirements; fails to meet any of the minimum requirements of the criteria; numerous weaknesses and deficiencies exist; proposal needs major revisions; the risk of unsuccessful performance is high.
