Performance Work Statement (PWS)
Cape Hatteras National Seashore Lifeguard Services
1. Background. Cape Hatteras National Seashore (Seashore) in located in Eastern North Carolina and consists over 70 miles of Atlantic Ocean beaches. Cape Hatteras became the first national seashore in 1937. It was designated to preserve dynamic barrier islands and its unique vegetation, wildlife, and coastal processes, and to provide recreation and enjoyment for the public. It receives over 3 million visitors annually.
2. Required Services. The contractor will have an Open Water Lifeguard Agency Certification from the United States Lifesaving Association (USLA) or other equivalent standards that meet the requirements of USLA and will provide all labor, training, materials and supervision, tools, equipment required to safely complete the services to be rendered at the following locations.
BASE BID: Provide lifeguard services for the four identified beach sites below during the periods identified under section 5: Period of Performance.

Rodanthe Beach Access in Rodanthe, NC.
3. Contractor Responsibilities:
3.1.CONTRACTOR shall meet all standards set forth by the United States
Lifesaving Association (USLA) for ocean lifeguards as detailed in the latest edition of the USLA booklet, “Guidelines for Open Water Lifeguard Training and Standards.” A trained lifeguard will meet and maintain the following standards and requirements and will man each lifeguard position:

1. Coquina Beach in South Nags Head, NC
2. Buxton Beach, Buxton, NC
3. Frisco Beach, Frisco, NC
4. Ocracoke Beach, Ocracoke Island, NC
Will be at least 18 years of age at the time of the first workday.
Will have successfully completed ocean rescue training or have two years of experience as an ocean lifeguard.
Will have completed a basic CPR course of instruction.
Will have completed a basic first-aid course of instruction.
Will meet and maintain minimum physical qualifications for running swimming and general fitness as established by the USLA training and standards guides.
Will be familiar with the operation and use of all rescue equipment and devices provided for use in water rescue operations.
Will comply with all rules and regulations set forth by the National Park Service.
3.2.CONTRACTOR shall provide a minimum of two lifeguards per beach location who will be responsible for skilled water safety work involving the prevention of injuries, responding to emergencies, performing emergency lifesaving and first aid care as occasions require.
3.3.CONTRACTOR will designate lifeguarded zones at Coquina Beach, Buxton
Beach, Frisco Beach, and Ocracoke Beach at the beginning of the shift (9:00 a.m.) by erecting two white PVC poles with the appropriate surf condition flag.
The designated swim area (In zone) is a 100-meter-wide area, in front of the lifeguard stand, marked by flags on its left and right limits. The undesignated area (Out of zone) is considered the area outside of the 100-meter designated area in which the lifeguards may be able to observe and respond to water safety issues without leaving the designated swim area unprotected.
3.4.CONTRACTOR shall post the daily surf condition flags on the lifeguarded towers so visitors can clearly see the surf condition flag. Surf condition flags will also be placed at the beach access boardwalk located near the parking areas. Lifeguards will change the beach condition flags when weather and/or surf deem necessary. Lifeguards will leave in place on the tower the appropriate colored flag (yellow or red) to be flown after end of shift (5:00 p.m.) Upon making the determination that double red flag warning conditions exist, the lifeguards shall notify Chief Rangers’ Office or the
District Ranger.
3.5.CONTRACTOR will respond to all water related emergencies within the identified zone. If available respond to emergencies outside of the designated swim area.
3.6.CONTRACTOR shall provide first aid for medical emergencies to ill or injured visitors on land. Request assistance from NPS Rangers and Dare/Hyde County
EMS for EMS cases beyond level of care properly trained for. Lifeguards can contact Law Enforcement Rangers by calling 911, or by utilizing a cell phone.
3.7.CONTRACTOR shall provide AED’s and radios for communications with
Dare County Regional Communications Center. Each lifeguard stand will have an AED and radio.
3.8.CONTRACTOR shall ensure compliance with all rules and regulations governing use of the protected beach area and the natural resources of the area and refer violations to Law Enforcement Rangers.
3.9.CONTRACTOR will advise and educate the public on a daily basis on ocean safety and alert the public on specific hazards. Make visitor contacts to disseminate information, and provide safety direction or assistance, or contact
Park Service Law Enforcement Rangers for enforcement actions. As a service to our visitors the guards will unlock the beach wheelchair at the start of the day and lock it up at the end of the day.
3.10. CONTRACTOR shall submit daily rip current reporting form to NOAA and to NPS.

3.11. CONTRACTOR shall submit a monthly incident tally sheet at the end of each month documenting lifeguard activities, to the National Park Service consistent with USLA reporting standards.
3.12. CONTRACTOR shall provide (6) rip current and beach safety training sessions for park service staff. Training sessions will be provided by contract personnel with experience in identifying rip currents. Training sessions will point out real active rip current areas and the characteristics to look for when identifying danger areas.
3.13. CONTRACTOR shall contact Cape Hatteras National Seashore’s main phone line (252) 473-2111 to relay visitor reports of injured/deceased wildlife or nesting sea turtles. When possible, obtain and convey details such as location, type of animal, whether injured or deceased.
3.14. CONTRACTOR shall complete end of year report to Cape Hatteras no later than 30 days after Labor Day. The report will include numbers of swimmers in trouble, water rescues, search and recovery/rescues, EMS calls (broken down into first aid, basic life support, and advanced life support), etc. that occurred within CAHA. These records will be taken directly from the daily statistics forms used each week located at each designated beach.
3.15. CONTRACTOR shall provide the USLA Minimum Recommended Lifeguard
Equipment Standards.
o Rescue equipment
At least one rescue flotation device (RFD) for each lifeguard on duty.
Mask(s) and snorkel(s) readily accessible to mount an underwater search and rescue, as appropriate.
Binoculars readily accessible in the beach area and in each stand.
Marker buoy(s) readily accessible to lifeguards as appropriate according to local conditions.
Swim fins for rescue purposes readily accessible to lifeguards as appropriate according to local conditions.
o Medical
A first aid kit adequate to treat minor injuries at each staffed lifeguard beach zone.
A first aid kit adequate to treat minor and major medical emergencies at each life guarded beach zone.
Equipment to protect against blood-borne pathogens consistent with OSHA requirements.
Spinal stabilization equipment, including spine board, head and neck immobilization devices, and fastening devices readily accessible at each lifeguarded beach zone.
Oxygen / Airway medical kit readily accessible at each staffed beach area, with all lifeguard personnel training in its use.
AED’s at each lifeguarded beach zone and roving patrol.
o Communications
Equipment for lifeguards to communicate with the public at a distance (ex. Whistles, megaphone(s), air horn(s), etc.
Equipment for lifeguard-to-lifeguard communication.
Equipment for lifeguards to immediately activate local emergency medical services (EMS).
Radios to communicate with emergency responders.
o Uniform
Lifeguards will wear an easily identifiable uniform, denoting the wearer as a trained rescuer for the National Park Service (ex. Lifeguard, Beach Patrol, Marine Safety). Uniforms will consist of a red swimsuit and light grey shirt or tank top free from logos, emblems, or names of nearby community rescue services.
Reasonable equipment to protect lifeguards from sun exposure.
4. Government Furnished Property, Materials & Supplies.
Lifeguards stand at each lifeguarded beach location.
Designated Swim Beach Area Markers Flags to indicate Rip Current Hazard to be posted at lifeguarded beach.
Surf Condition Flags (Purple, Yellow, Red, and No Swimming Red) Agency education and orientation for a minimum of 2 hours annually at the lifeguard preseason training or meeting.

5. Period of Performance.
This contract will have a period of performance from April 2025 to April 2026.
The contract shall start the first Monday in April. This will give the NPS and the contractor ample time to ensure that all requirements are understood, and coordination is made with district points of contact.
Operations of designated sites will begin the Saturday of Memorial Day weekend and operate through Labor Day. Lifeguarded beaches will operate 7 days a week. Each of the locations will be staffed with guards operating from 09:00 a.m. to 5:00 p.m.
Any work outside of normal business hours shall be pre-approved by the Contracting Officer and COR.
6. Management. The contractor shall manage the total work effort in accordance with effective and efficient management principles and safe working practices to ensure on-time completion of this contract.
7. Safety & Environmental Compliance.
The contractor shall comply with pertinent provisions of the Occupational Safety and Health Act (OSHA), and state, local, safety, laws.
The contractor shall comply with pertinent Environmental Protection Agency laws and regulations.
The Park safety officer has the authority to issue restraint or cease-and-desist orders to the contractor when violations or unsafe acts are present and threaten Government and contractor employees or damage to Government property.
The contractor shall immediately report to the Contracting Officer, COR and Park safety officer all accidents resulting in employee injury or death or damage to property while performing this contract.
8. Insurance. The Contractor shall be insured in accordance with State of North Carolina insurance regulations. The Government is not responsible for damage to Contractor’s equipment, vehicles, tools or materials or their employees and the personal property brought on-site. The Government will not accept any liability due to contractor employee negligence.
Workers Compensation: The contractor shall furnish proof of workers compensation insurance to the Contracting Officer for those employees performing work related to this contract and shall comply with the Workman’s Compensation Laws of the State of North Carolina.
Liability: The Contractor shall maintain a level of insurance that will protect the contractor and the Government from any claims as a result of bodily injury (including death) and property damage which may arise from and during the performance of this contract, and shall submit proof of insurance to the Contracting Officer.
9. Performance Requirements Summary (PRS). The contractor performance requirements are summarized into required services that relates directly to successful contract completion.
The performance standard identifies the minimum acceptable levels of service allowed.

10. Motor Vehicle & Traffic Regulations. Contractor employees operating motor vehicles shall possess a valid driver's license. Driver and vehicle permits, licenses, registrations and proof of insurance shall be maintained in the vehicle at all times and made available upon request.
Contractor employees shall comply with federal vehicle motor law requiring seat belts be worn at all times. Contractor employees shall adhere to the posted speed limits.
11. Employee Badges/Parking. All contractor employees shall comply with parking procedures published for the Park. Contractor employees shall return any PARK issued personal or vehicle identification badges immediately upon termination of employment or completion of this contract.
12. Replacement of Contractor Employee for Security Reasons. The Government retains the right to request removal of the contractor’s employee(s), regardless of prior clearances.
13. Non-Payment for Additional Work. Any additional contractor performed services not specified in contract, either at its own volition or at the request of an individual other than an appointed Contracting Officer, except as may be explicitly authorized in the contract, shall be performed at the financial risk of the contractor. Only an appointed Contracting Officer is authorized to bind the Government to a change in specifications, contract terms, or conditions.
14. Conflict of Interest. The contractor shall not employ off-duty COR’s or other Government employees if such employment would create a conflict of interest or be contrary to the policies contained in conflict-of-interest directives.
15. Quality Control. The contractor shall establish and maintain a Quality Control Plan (QCP) to ensure the work performed conforms to the contract requirements. The Performance Requirements Summary establishes performance standards that are the minimum requirements for acceptable performance of required services. The contractor’s QCP shall address methods for remedying poor performance. The Contractor shall develop QCP and submit with proposal package. The Contractor’s QCP includes:

16. Quality Assurance. The COR will monitor the contractor’s performance under this contract using the quality assurance procedures specified in the Government’s Quality Assurance Surveillance Plan (QASP). The QASP may be modified after contract award upon review and acceptance of the contractor’s QCP to ensure both plans are mutually supportive. The purpose of the QASP is to ensure that the required services are performed in accordance with the contract requirements. The plan ensures reliable and continued operation by precluding unnecessary complaints and unacceptable performance. Government’s QASP includes:
Acceptance of the contractor’s quality control plan Random inspection of the contractors work Communicating customer complaints Progress meetings with the contractor
The implementation of this QASP does not relieve the contractor of its responsibility to implement and abide by the QCP incorporated into this contract, and to provide acceptable performance of all required services listed herein. At the CO’s discretion, the contractor may incur a payment deduction for lack of compliance with the QCP, PWS or PRS.
17. Contractor’s Proposal Package. The following deliverables are to be submitted with offer in response to RFQ.
Technical approach to perform required services.
Contractor safety plan.
Contractor’s QCP Proof of Insurance–Business Liability & Workers Compensation.
18. Inspection. The Government will conduct a review upon completion of required services.
Final payment will be processed upon confirming that all noted contractor performance deficiencies have been satisfactorily corrected.
