About this file

This is a Brand Name Justification and Approval document (J&A) issued by the U.S. Army Corps of Engineers, Rock Island District, for the procurement of Schneider Electric components and installation services under control number MVR-26-004. The estimated total acquisition value is $40,000.

The procurement consists of seven Schneider Electric replacement components for a failed Variable Frequency Drive (VFD) that controls Pump #5 at the Big Creek Supplemental Pump Station, a critical flood risk management infrastructure asset protecting Polk City. The required components include: Power Fuse (VX5FUPM0315), Precharge Fuse (VX5FUPM0012), AFE INV Brick (VX5RBAPMC1180NSCN4), F-Line Coil (LX9FG220), Suppressor Module (LA4FRCP), Auxiliary Contact (LADN22), and Main Contacts (LA5FG431). The procurement also includes installation and commissioning services to be performed by a factory-certified technician. The justification for brand-name specification is based on proprietary system integration requirements, OEM manual and warranty mandates, mission-critical application needs, and procurement urgency due to the pump's current inoperability. Market research confirmed that the VFD system is proprietary to Schneider Electric with no compatible alternatives available from other manufacturers. Competition will be sought among authorized Schneider Electric distributors and service providers through a Firm-Fixed-Price solicitation. The Contracting Officer, Ryan Larrison, certified the justification on March 16, 2026, and will determine fair and reasonable pricing through comparison against government estimates and historical pricing data.

Brand Name Justification and Approval for Schneider Electric Components and Technician for Other than Full and Open Competition - FAR Part 6 1

1. Contracting Activity:

U.S. Army Corps of Engineers, Rock Island District, Rock Island, Illinois (CEMVR-CT)

2. Nature and/or Description of the Action Being Approved:

This document justifies the use of a brand-name specification in an acquisition for Schneider Electric components and associated installation services. This action is not a sole-source procurement. The acquisition will be competed amongst authorized Schneider Electric service providers and/or distributors as a Firm-Fixed-Price solicitation, ensuring that the brand-name requirement does not unduly restrict competition among qualified vendors.

3. Description of Supplies/Services Required:

The action is to procure specific, genuine Schneider Electric replacement components for a failed Variable Frequency Drive (VFD) and to secure the services of a factory-certified technician to perform the installation, testing, and commissioning. The VFD controls Pump #5 at the Big Creek Supplemental Pump Station, a critical piece of flood risk management infrastructure.

The required supplies and services are as follows:

CUN Description Part Number

0001 Schneider Electric Power Fuse VX5FUPM0315

0002 Schneider Electric Precharge Fuse VX5FUPM0012

0003 Schneider Electric AFE INV Brick VX5RBAPMC1180NSCN4

0004 Schneider Electric F-Line Coil LX9FG220

0005 Schneider Electric Suppressor Module LA4FRCP

0006 Schneider Electric Auxiliary Contact LADN22

0007 Schneider Electric Main Contacts LA5FG431

0008 Installation and Commissioning Services N/A

1 This J&A is subject to the following class deviations: 2026-00017 and 2026-00021. These deviations make the draft Revolutionary FAR Overhaul (RFO) applicable to this J&A. The RFO citations contained within this document are current as of 12 March 2026.

The estimated total value of this acquisition is $40,000.

4. Cited Authority: 10 U.S.C. 2304(c)(1) as implemented by FAR Overhaul Part 6.103-1, The Agency's need is for a brand-name commercial product and No Other Supplies or Services Will Satisfy Agency Requirement. This authority is applicable to brand name justifications in accordance with FAR 6.103-5(b)(2).

5. Application of Authority / Rationale for Brand Name:

The use of a brand-name specification is essential for the following reasons:

• Proprietary System Integration: The Schneider Electric Variable Frequency Drive (VFD), Model No. ATV680C40T4N2GNWABNHSPL, is a proprietary, integrated system. The components are designed to work together in a specific electronic and physical configuration. The use of non-genuine parts would introduce incompatibility issues, leading to system malfunction or further damage.

• OEM Manual and Warranty Requirements: The OEM's own Operation and Maintenance (O&M) Manual for this VFD, which governs its proper care, explicitly mandates the use of genuine Schneider Electric branded parts and specialized, factory-certified personnel for repair and installation. Adherence to these requirements is necessary to maintain the operational integrity of the system and to ensure the manufacturer's warranty remains valid.

• Mission-Critical Application and Risk Mitigation: The VFD controls a pump that is critical for protecting the populated area of Polk City from flooding . Extended downtime or equipment failure due to improper parts or faulty installation represents an unacceptable risk and a direct threat to the USAGE mission. Engaging with an unauthorized vendor would introduce significant schedule delays and the unacceptable risk of incorrect installation, further equipment damage, and voiding the manufacturer's warranty.

• Urgency: The pump is currently inoperable and restoring it to service is an urgent priority. Sourcing the supply and installation from the OEM or its authorized agents is the only course of action that ensures a rapid , reliable, and safe resolution.

6. Impact of Not Purchasing the Brand Name Items: Failure to acquire the specified Schneider Electric components would necessitate the use of third-party alternatives. This would result in a loss of the integrated features detailed above, leading to a degraded system.

It would also introduce significant technical risks related to interoperability, introduce significant schedule delays and the unacceptable risk of incorrect installation, further equipment damage which would likely lead to increased risk of failure.

7. Market Research: In accordance with FAR Part 10, thorough market research was conducted to determine the availability of alternative parts and qualified vendors. Research confirms that the VFD system is proprietary to Schneider Electric. While there are multiple distributors for Schneider Electric parts, the installation and commissioning require proprietary software and training that is only available to technicians certified by the OEM. No other manufacturer produces compatible, authorized replacement parts for this specific VFD model.

Therefore, competition will be sought from authorized Schneider Electric distributors and service providers.

8. Actions to Increase Competition: For this specific requirement, an exception to publicize a special notice has been determined in accordance with 5.202(a)(2) as this requirement has an unusual and compelling urgency precluding competition to the maximum extent practicable and the Government would be seriously injured if the agency complies with the time periods specified in periods specified in 5.203. the proprietary nature of the equipment and the need to maintain the warranty preclude the use of non-OEM parts. Future requirements for new systems will be competed to the maximum extent practicable, with requirements written in a performance-based manner that does not restrict competition to a single vendor, where mission requirements allow.

9. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the final agreed-upon price is fair and reasonable. This will be achieved by comparing proposed prices against the government estimate, historical pricing for similar items, and/or other techniques necessary to ensure a fair and reasonable price is paid.

10. Certifications & Approval

Contracting Officer:

I certify that this justification is accurate and complete to the best of my knowledge and belief.
