About this file
This is a Memorandum for Record (MFR) for Brand Name Justification for a commercial procurement under FAR Part 12 simplified procedures.
The Engineer Research and Development Center – Coastal and Hydraulics Laboratory (ERDC–CHL) is procuring model supplies for the Arkabutla Outlet Works Physical Model on a brand name or equal basis. This is a new requirement with firm-fixed price terms and a 30-calendar day delivery period post-award. The procurement is funded under Civil Works Construction. The NAICS determination is 332510 - Hardware Manufacturing. Authority for the brand name justification derives from DFARS 211.204 (Class Deviation 2026-O0013) regarding items peculiar to one manufacturer and Section 888 of the FY 2017 National Defense Authorization Act.
The justification details 50+ line items spanning specialized materials and equipment necessary for the proprietary patented modeling process. Key items include Drew Foam EPS foam blocks, Sta'-Put adhesive, Curbell acrylic sheets and tubes, Weld-On acrylic cements, Creative Polymers polyurethane coatings, various sealants and adhesives (3M, DAP, Sika, Loctite), Makita power tools, Mitutoyo precision measuring instruments, Rigid shop vacuums, Wayne Waterbug pumps, and specialty equipment such as JetAire fans and Spectra laser levels. Most justifications cite either compatibility with existing equipment and government-owned batteries, prior proven performance on physical model construction, required technical specifications for model scaling and accuracy, or necessity for the proprietary patented modeling process. The Procuring Contracting Officer (Christine Shuck) has certified the anticipated cost as fair and reasonable based on price analysis techniques and approved the justification subject to fund availability.
