PERFORMANCE WORK STATEMENT (PWS)

Non-Tactical Vehicles in support of Freezing Winds SEP-JAN 2025-2026

PART 1- GENERAL INFORMATION

1.1 General: This is a non-personal services performance work statement to lease Non- Tactical Vehicles (NTVs) in the vicinity of Vaernes Garrison, Norway and Dragsvik Garrison, Finland. The period of performance will run from September 24, 2025 through January 9, 2026 for Vaernes, Norway, and from October 14, 2025 through December 15, 2025 for Dragsvik, Finland.

1.2 Background: The purpose of this Performance Work Statement (PWS) is to outline requirements for the rental of NTVs to support transportation requirements in the local areas of Vaernes, Norway and Dragsvik, Finland. Vehicles are required in sufficient numbers to support U.S. Marine Corps operations.

1.3 Scope: The contractor will provide safe, operable, and fully functional NTVs with all required safety equipment, without operators. The U.S. Government accepts no liability for vendor, its employees, or agents. The contractor shall also provide insurance, roadside assistance, snow chains/snow tires, and ensure local maintenance support in or near Vaernes, Norway and Dragsvik, Finland.

1.4 Description of Services: The contractor will provide safe, operable, and fully functional NTV’s with all required safety equipment, without operators. The NTVs will be utilized in the general vicinity of Vaernes, Norway and Dragsvik, Finland for routine travel and transportation of personnel. All vehicles shall have valid host-nation license and finished plates in compliance with Norwegian and Finnish regulations. The U.S. Government accepts no liability for vendor, its employees, and agents.

1.5 NTV’s Condition: NTV’s shall be provided in good working condition. Both the exterior and internal components shall be free of excessive rust, and damage, and without excessive wear and tear. NTV’s shall be clean and serviceable at time of pick-up. NTV conditions, as stated above, will be inspected by the U. S. Government. All NTV’s systems shall be operative, kept in line with manufacturer's recommended maintenance program, and free of dirt and debris. NTV’s with cracked windshields or excess dents and damage to the interior or exterior will not be accepted.

1.5.1 Maintenance: The Contractor shall ensure each rental vehicle meets or exceeds the following minimum maintenance standards at the time of acceptance and throughout the rental period:

1.5.2 The Contractor is responsible for all scheduled and unscheduled maintenance of the NTV’s. The Contractor shall provide all parts and labor necessary to complete required maintenance tasks. Maintenance shall be performed according to the manufacturer's recommended maintenance schedule. If the contractor's scheduled or unscheduled maintenance results in the U.S. Government losing use of a NTV for more than 24 hours, the Contractor shall provide a replacement NTV within 24 hours of a comparable make and model for the U.S.

Government to use.

1.5.3 Unlimited Mileage: The U.S. Government shall have unlimited mileage during the performance of the contract.

1.5.4 Fuel: The contractor shall deliver the NTV’s with a full tank of fuel. The Government will return the NTV’s in the same physical state it was received other than normal wear and tear to the NTV’s.

1.5.5 Fuel Type: The NTV’s will be Diesel OR Gasoline Fuel Only

1.5.6 NTV’s Alterations: The Government will not modify or alter any NTV’s.

1.5.7 Safety: The Contractor shall comply with applicable local safety standards and must maintain each NTV pursuant to local city and country safety requirements.

1.5.8 Recovery/Replacement: Upon proper notification, the contractor shall recover disabled NTV’s within 24 hours of notification by the U.S. Government. The Contractor shall provide a replacement NTV for all disabled NTV’s at the time of recovery. The service shall be available 7 days a week, 24 hours a day.

1.5.9 Delivery of NTV’s: The Contractor shall make availability of all NTV’s by the date specified in the period of performance in the vicinity of Vaernes Norway and Dragsvik, Finland. Each NTV must pass an acceptance inspection before the U.S. Government takes possession. The NTV’s shall be returned by the U.S. Government from the respective location at the conclusion of the rental period.

1.5.10 Damages: The U.S. Government shall not be responsible for acts of God that may result in damage to any NTV’s (i.e., hailstorms, thunderstorms etc.). In addition, the U.S. Government shall not be responsible for normal depreciation to the NTV’s. For purposes of this contract, "normal depreciation" is defined as the wear and tear that can be expected to result given the NTV’s use by equipment-laden troops in a harsh environment. Normal depreciation includes, but is not limited to, minor scratches and dents to NTV’s exterior, minor damage to seat coverings, and the presence of dirt or sand.

1.5.11 Insurance: The Contractor shall provide full insurance (liability, collision, theft, comprehensive) for all vehicles in accordance with host-nation laws, with proof provided at delivery).

1.5.12 Comprehensive Coverage Inclusion: The lease price shall include full coverage insurance, with a $0 deductible, encompassing all necessary protections as mandated by host nation laws; coverage is for any and all U.S. Government licensed drivers. This coverage shall extend to all associated costs, including but not limited to taxes, licenses, registration fees, and any other requirements stipulated by host nation law. The comprehensive insurance shall include coverage for damages caused to vehicles that will be utilized on paved and unpaved road surfaces. Unpaved surfaces are defined as professionally maintained roads that are not paved. Minivans and SUVs may be utilized on off-road surfaces (gravel and/or dirt roads “range roads”).

1.15.13 Coverage Details: The full coverage insurance provided shall protect the operator(s) of the vehicle against third-party claims. It shall be expansive enough to address various scenarios, ensuring comprehensive protection for the Government's interests.

1.15.14 Ongoing Compliance with Host Nation Law: The vendor is obligated to maintain the full coverage insurance in strict accordance with host nation law throughout the entire lease period. This includes adherence to any changes in legislation affecting insurance requirements.

1.15.15 Proof of Insurance: The vendor shall furnish proof of the full coverage insurance for each vehicle. This proof shall be provided upon the initial issuance of vehicles and subsequently upon the renewal of insurance as it becomes due. The documentation should explicitly outline the coverage details and compliance with the host nation’s legal standards (Deliverable A.008).

1.15.16 Immediate Notification of Changes: The vendor shall promptly notify the government in writing of any changes to the insurance coverage that may affect the terms, conditions, or extent of protection provided within 48 hours of the changes. This includes changes in coverage limits, policy terms, or any other relevant details.

1.15.17 Insurance Certification: The vendor shall certify, in writing, that the full coverage insurance provided meets or exceeds the minimum requirements set forth by host nation law.

This certification shall be included with the documentation provided to the user (Deliverable A.009).

1.15.18 Gross Negligence: Gross negligence is defined by actions taken by the driver that demonstrates a lack of care or recklessness that results in damage to the vehicle that the Contractor’s insurance agency deems as out of scope of the full comprehensive insurance coverage (reference section 1.15.11 Insurance (1.15.12)). In specific cases where the comprehensive insurance is not deemed payable due to operator gross negligence, the contractor shall obtain a written determination by the insurance provider that such specific incident(s) is outside the scope of coverage. Proven gross negligence by local authorities’ documentation, the government will determine if the operator will be responsible for financial damages at the time of incident, or if a modification to the contract to compensate for the damages will be made.

1.6 Period of Performance:

Vaernes, Norway: September 24, 2025 – January 9, 2026 Dragsvik, Finland: October 14, 2025 – December 15, 2025

1.7 Place of Performance:

1.8 Contractor Responsibilities - is required to:

1.8.1 The contractor shall provide the requested services as defined within the specified timeframes in the quantities specified within the solicitation.

1.8.2 The Contractor must be capable of providing the required items within a minimum time of 24 hours from time of notification.

1.8.3 Immediately notify the Contracting Officer upon contractor determination of inability to perform.

1.8.4 The contractor will perform all tasks in accordance with Performance Work Statement

(PWS).

1.8.5 Contractor personnel shall always be under the supervision of the contractor and not under the supervision of the U.S. Government or any of its officers or employees. The Contracting Officer will bring discrepancies or noncompliance with the contract clauses, specifications, or Performance Work Statement to the attention of the Contractor's supervisor or foreman for necessary corrective action.

1.9 Government Responsibilities: The U. S. Government will:

1.9.1 Provide the contractor with Purchase Orders and or cancellations within the terms specified in this contract.

1.9.2 Provide the contractor with the required information to ensure timely delivery of the services ordered within the provisions/terms and conditions of this contract.

1.9.3 The Contracting Officer shall make the final decision as to what constitutes damage due to other than normal operation.

1.10 Contractor Notice Regarding Late Availability: In the event the contractor anticipates or encounters difficulty in complying with the delivery schedule, the contractor shall immediately notify the Contracting Officer telephonically giving full detailed reasons for the delay. Receipt of contractor's notice does not constitute acceptance of an alternate delivery schedule waiver of the U.S. Government's rights under this contract or at law.

1.12 Liability: The U.S. Government accepts no liability for the actions of the Contractor or his employees and agents.

1.13 Type of Contract: The U.S. Government anticipates awarding a single Firm-Fixed-Price (FFP) contract. The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.

1.14 Security Requirements: All contractor personnel requiring entry to Local Defense Installations require prior approval through base security office. The contractor shall conform to base security office entry requirements for successful performance of all tasks defined within this PWS.

1.15 Contractor and Subcontractor's Employees: The Contractor and Subcontractor's employees will not be permitted on the installation when their presence is considered detrimental to the security of the installation. The U.S. Government reserves the right to require removal from the Job site any Contractor employee who endangers persons or property, whose continued presence is considered inconsistent with the interest of military security or who is found to be incapacitated or under the influence of alcohol, drugs, or other substances.

Removal of employees for any reason does not relieve the Contractor of the requirements to perform services specified herein.

1.17 Points of Contact. The contractor will provide points of contact within their company to interface with the contract representative on issues concerning rental NTV’s. Names, business address, phone numbers, and hours of operation are the minimum information requirements.

Arrangements for contacting the contractor's points of contact after normal business hours should also be made.
