About this file
This document is the Special Provisions (Document A00801) issued by the Massachusetts Department of Transportation Highway Division for Proposal No. 616377-137021, governing scheduled and emergency guardrail and fence repairs at various locations on Interstate 90 in District 1. The scope of work includes repair and replacement of existing guardrail, guardrail end treatments, and fencing along I-90 within District 1 as directed by the Engineer, along with installation of reflectorized delineators, termini markers, and implementation of traffic control during construction operations. The work must conform to Engineering Directive E-20-004, NCHRP350 approved hardware standards, MASH compliant guardrail hardware per 2017 Construction Standard Details, and the 2026 Standard Specifications for Highways and Bridges. Work locations within District 1 are assigned by the Engineer, with MassDOT reserving the right to add additional roadways throughout the contract duration. The Contractor must commence scheduled work within ten days of written or electronic work order notification and emergency work within four hours of notification. Work is restricted to normal 8-hour days, 5-day weeks, with no weekend or holiday work without prior Engineer approval; specific allowable work hours are determined by the District Highway Director based on roadway classification.
The contract establishes labor participation goals of 15.3 percent for minorities and 6.9 percent for women for each job category. Non-response damages of $500 per day apply for scheduled work delays beyond ten days and $1,000 per occurrence for emergency work not commenced within four hours. The Contractor must maintain 24-hour emergency contact capability and provide repair documentation in an Engineer-supplied log upon project completion. Compensation is provided through various pay items including laborer hours, selective clearing, tree removal (differentiated by diameter), gravel borrow, treated wood disposal, guardrail and fence components, and emergency response mobilization. The Contractor is responsible for utility coordination including pre-construction surveys within 30 days of site work commencement, notification of conflicts, and maintenance of communication with utility companies. Insurance requirements supplement the Standard Specifications, and MassDOT may provide traffic control setup at certain locations without contractor compensation. Environmental compliance is required including erosion and sediment control, Northern Long-Eared Bat protection measures with seasonal tree-cutting restrictions (April 15 to October 31), and restriction of stockpiling, maintenance, and refueling activities within 100 feet of wetlands or 200 feet of water bodies. The contract document contains comprehensive holiday work restrictions by location and facility type, telecommunications equipment prohibitions per 2 CFR 200.216, and truck safety device certification requirements per Massachusetts General Laws Chapter 90.

SUBSECTION 8.14 (Continued)
C.2 – EARLY UTILITY REQUEST – (aka SUBNET SCHEDULE) PRIOR TO THE BASELINE All early utility work is defined as any anticipated/required utility relocations that need to occur prior to the Baseline Schedule acceptance. In all cases of proposed early utility relocation, the Contractor shall present all known information at the pre-construction conference in the form of a ‘sub-net’ schedule showing when each early utility activity needs to be issued a notice-to-proceed. The Contractor shall provide advance notification of this intent to request early utility work in writing at or prior to the Pre-Construction meeting. Prior to officially requesting approval for early utility work, the Contractor shall also coordinate with MassDOT and all utility companies (private, state or municipal) which may be impacted by the Contract. If this request is acceptable to the Utilities and to MassDOT, the Engineer will issue a notice-to-proceed to the affected Utilities, based on these accepted dates.
C.3 – PROPOSAL SCHEDULE - CHANGES TO THE PUC FORM
If the Contractor intends to submit a schedule (in accordance with MassDOT Standard Specifications, Division I, Subsection 8.02) that contains durations or sequencing that vary from those provided in the Project Utility Coordination (PUC) Form, the Contactor must submit this as an intended change, in the form of a Proposal Schedule and in accordance with MassDOT Standard Specifications, Division I, Subsection 8.02. These proposed changes are subject to the approval of the Engineer and the impacted utilities, in the form of this Proposal Schedule and a proposed revision to the PUC form. The Contractor shall not proceed with any changes of this type without written authorization from the Engineer, that references the approved Proposal Schedule and PUC form changes. The submission of the Baseline Schedule should not include any of these types of proposed utility changes and should not delay the submission of the Baseline Schedule. As a prerequisite to the Proposal Schedule submission, and in advance of the utility notification(s) period, the Contractor shall coordinate the proposed utility changes with the Engineer and the utility companies, to develop a mutually agreed upon schedule, prior to the start of construction.
