About this file

This document is a Brand Name Justification and Approval (J&A) for the purchase of APC Symmetra LX uninterruptible power supply (UPS) equipment for the Utah Army National Guard (UTARNG).

The J&A outlines the justification for the sole-source procurement of this APC brand UPS equipment. Key points include the need to standardize on a single brand for training, maintenance, and logistics support, as well as the significant costs and disruptions associated with switching to a different hardware platform. The J&A also notes that the pricing will be fair and reasonable based on competitive quotes from authorized APC retailers.

The related federal contract opportunity (Solicitation # W911YP24R117A) seeks proposals for the procurement and installation of the APC Symmetra LX UPS system. This is a full and open competition under NAICS code 334111 with a size standard of 1,250 employees. Responses are due by 7:00 AM Mountain time on September 30, 2024. The contract will be awarded on a Lowest Price Technically Acceptable (LPTA) basis.

Brand Name Justification and Approval

Purchase Requisition # 12113691

Organization/Line Office: Utah Army National Guard, Description of Action being approved: New contract, firm fixed price

Description of Product, Supplies or Services required to meet the Agency’s needs: UPS Symmetra LX

An identification of the statutory authority permitting other than full and open competition:

This acquisition is being conducted under the authority of Federal Acquisition Regulation (FAR) 6.302-1(c).

Identification of the Justification Rationale:

1. This APC UPS battery backup and power management equipment is used for the UTARNG network equipment which manages hundreds of sites using this system of similar devices and remote management software. Standardization to a single device/brand simplifies training, maintenance, and logistical support of the systems we employ.

2. Switching equipment would not allow us to remotely manage this equipment and could cause service disruptions in the future. Furthermore, we have an inventory of replacement equipment that is proprietary to these models and manufacturer.

3. With the complexities and scope of this hardware, switching to a competitor hardware platform at this time is not cost reasonable. Any competitor hardware would require a similar level of configuration, tuning and customizing, training and maintenance. This would result in significant up-front expenses in time and money to get the competitor product performing on an acceptable level to safeguard vital UTARNG battery backup power management equipment. These costs far outweigh any possible savings that might be obtained by switching to a competitor product.

Fair and Reasonable Price Determination: Award issued under this individual limited sources justification represents a fair and reasonable price as the agreed to pricing will be based upon competitive quotes received from authorized retailers of the brand in a competitive environment. Price analysis will be performed on all quotes received. Therefore, the price paid will represent the best value and result in the lowest overall cost to meet the needs of the Utah National Guard.

Actions to Increase Competition: This requirement is limited to the vendors within the Army’s IT mandatory source CHESS, IAW AFARS 5139.101-90(a)(1), AR25-1, and DA PAM 25-1-1.

Market Research conducted: Reviewed publicly available information on CHESS and in the marketplace.

Conducted additional market research from prior year contracts awarded from our agency and other government agencies.

Technical Cognizance: As the technical or requirement personnel, I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.
