About this file

This is an Invitation to Bid (ITB) document issued by the Florida Department of Transportation (FDOT) Central Procurement Office for the procurement of State and Federal Forested and Herbaceous Wetland Mitigation Bank Credits to offset freshwater wetland impacts associated with multiple transportation projects. The solicitation requests per-credit pricing for mitigation bank credits across multiple drainage basins within the service areas of the St. Johns River Water Management District (SJRWMD), the Southwest Florida Water Management District (SWFWMD), the South Florida Water Management District (SFWMD), and the United States Army Corps of Engineers (USACE). The estimated wetland impacts total approximately 99 acres across three drainage basins: 21.0 acres of freshwater herbaceous in the Reedy Creek Basin, 5.0 acres of freshwater herbaceous in the Ocklawaha River Basin, and 5.0 acres of freshwater herbaceous plus 68.0 acres of freshwater forested in the Withlacoochee River Basin. Bids are due on January 5, 2026, at 9:00 AM EST, with a public bid opening scheduled for 10:00 AM on the same date and intended award posting on January 6, 2026. This is a 24-month indefinite quantity term contract commencing from the date the award is final, with no guaranteed specific quantity of wetland mitigation bank credits to be purchased. Bidders must be actively registered in MyFloridaMarketplace by the bid opening date.

Bidders must submit firm, net, delivered prices F.O.B. destination, subject to a one percent MyFloridaMarketplace transaction fee. A five percent in-state preference applies when the lowest bid is from an out-of-state vendor whose state does not grant reciprocal preference; bidders must complete the In-State Preference Form and provide attorney certification regarding their home state's preferences. All bidders must submit completed Vendor Certification Regarding Scrutinized Companies Lists and E-Verify forms, and out-of-state entities must be authorized to do business in Florida. Bidders must possess valid state mitigation bank permits and/or federal banking instruments with released and available credits at the time of bid submission, and must provide copies of current state and/or federal credit ledgers and approved permits. Credits using assessment methodologies other than the Uniform Mitigation Assessment Method (UMAM) require documentation from regulatory agencies confirming conversion calculations are acceptable. The Department reserves the right to award multiple bidders and will issue purchase orders to the lowest responsive bidders with available credits. Delivery of mitigation credits must occur within 14 days of purchase order receipt with confirmation that formal adjustments to state and federal credit ledgers have been made and approved by appropriate regulatory agencies. Payment follows invoice receipt after credit delivery confirmation. No pre-bid conference will be held, and questions must be submitted in writing by December 15, 2025, at 5:00 PM, with responses posted by December 17, 2025.

At the time of the bid, the Vendor must have approved mitigation banking instruments (permits) and have federal and/or state mitigation bank credits available for purchase at the time of the bid response that meet the requirements of this Invitation to Bid (ITB). A copy of the mitigation bank’s state and/or federal permits and a copy of the mitigation bank’s current state and/or federal ledger must be provided with the bid response.

Delivery: A receipt letter shall be delivered to the Department upon notice of award. Delivery will be made within 14 days of receipt of purchase order and shall include confirmation that formal adjustments to the state and federal credit ledgers have been made and approved by the appropriate regulatory agencies. Payment will be rendered following receipt of the invoice for the credit(s). The Department may consult with the appropriate regulatory agencies to confirm that credits from the respective bank will satisfy mitigation required before the Intended Award will be made.

MFMP Transaction Fee:

All payment(s) to the vendor resulting from this competitive solicitation WILL be subject to the MFMP Transaction Fee in accordance with the referenced Form PUR 1000 General Contract Condition #7d. The Transaction Fees imposed shall be based upon the date of issuance of the payment.

The mitigation bank’s service area must cover the identified WMD drainage basin. If a mitigation bank’s service area is outside the identified basin, the Vendor shall provide as applicable, a cumulative impact assessment or the appropriate multiplier analysis for use by the Department if required, which has been approved by the applicable WMD or DEP, confirming that its mitigation bank is acceptable to offset wetland impacts associated with the planned project.

A Federal mitigation bank's service area must cover the project’s identified 8-digit Hydrologic Unit Code (HUC). 5. When a Vendor’s mitigation credits use an assessment methodology other than the Uniform Mitigation Assessment Method (UMAM) the Vendor must provide documentation as part of its bid proposal from the appropriate permitting agency(ies) stating the credits can be used for the Department’s proposed project(s). The Vendor is responsible for calculating any conversion factors and providing documentation from the appropriate regulatory agencies confirming that the bidder’s conversion calculation of permitted credits to UMAM is acceptable to satisfy the Department’s mitigation needs. 1. If bidding on state credits, the Vendor must have a valid state mitigation bank permit (state permit) for the mitigation bank. The mitigation credits must be acceptable to the applicable WMD or Florida Department of Environmental Protection (FDEP) to offset wetland impacts associated with the planned project.

The federal wetland mitigation bank credits shall include all species credits (e.g., wood stork) tied to each wetland mitigation bank credit. If the federal service area is outside the identified basin, a Vendor can provide written verification from the United States Army Corps of Engineers (USACE) that its wetland mitigation bank credits are acceptable to offset wetland impacts for a planned project. The Vendor shall provide the Department a copy of its federal permit and a copy of its current federal credit ledger, so the available number of credits can be verified at the time of its bid submittal.

A Federal mitigation bank's service area must cover the project’s identified 8-digit Hydrologic Unit Code (HUC). Alternatively, a Vendor may provide written verification from USACE that the mitigation banking instrument for the bank includes language permitting the use of wetland mitigation bank credits for impacts outside the identified HUC-8 which includes the impacts associated with the Department’s planned project and/or allows for consideration under the federal Proximity Factor Tool.

4. The Vendor must have the type of mitigation credits it is bidding on released and available for sale at the time of the bid.

The Department reserves the right to coordinate with regulatory agencies to confirm these mitigation credits are appropriate to meet its mitigation needs.

At this time, the Department has identified estimated wetland impacts below for which Wetland Mitigation Bank Credits may be purchased under the resulting contracts

The actual quantities of Wetland Mitigation Bank Credits needed are unknown at this time. The Department will issue Purchase Order(s) for the purchase of Wetland Mitigation Bank Credits at such time as the exact quantities are known.

Drainage Basin information and estimated wetland impacts are included as available from preliminary project planning. The estimated impact acres are included for the benefit of vendors with credits using an assessment methodology other than UMAM. These wetland impact acres are estimated and subject to agency verification during the permitting review process.
