About this file
This is a Minority/Women-Owned Business Enterprise (M/WBE) Trucking Procedure Compliance infographic and presenter notes document issued by the Harris County Department of Economic Equity and Opportunity (DEEO). The document establishes guidelines for determining whether M/WBE trucking companies are performing a Commercially Useful Function (CUF) to receive M/WBE credit on Harris County contracts. The document outlines responsibility and management requirements, ownership and operation standards, exclusive use and control provisions for leased trucks, subcontracting options, and required submittal documentation including W-9 forms, current insurance documents, and proof of truck ownership or registration on the TxDOT website. Vendors using trucking companies to meet M/WBE contract goals must submit these documents with their M/WBE Utilization Plan. DEEO offers courtesy utilization plan reviews with a deadline of up to five business days prior to solicitation closure, and vendors may submit only one review request per bid.
Key compliance requirements mandate that M/WBE trucking firms must perform at least 30 percent of subcontract work with their own forces, own and operate at least one truck with at least one dedicated employee driver, and manage the entire trucking operation without contrived arrangements. M/WBE firms receive 100 percent credit toward participation goals for all transportation services provided using owned and operated trucks with employee drivers, or when leasing additional trucks from non-M/WBE firms while employing M/WBE drivers. For leased trucks exceeding the one-to-one ratio of owned trucks, M/WBE firms receive credit only for fees and commissions. All M/WBE firms must be certified through Harris County-recognized certification programs. Additional documentation will be requested post-award to verify CUF performance and contract goal credit. Questions and additional M/WBE program policy information are available through DEEO at (713) 274-1400 or DEEO@eeo.hctx.net.
