About this file

This is a Federal Requirement Certification for Contracts, Grants, Loans, and Cooperative Agreements, commonly known as the Byrd Anti-Lobbying Federal Form, applicable to any entity entering into a federally-funded transaction with a government agency. The certification affirms that no federal appropriated funds have been or will be paid to influence officers or employees of federal agencies, members of Congress, or congressional employees in connection with the award of federal contracts, grants, loans, or cooperative agreements. The document serves as a material representation of fact and is a prerequisite for executing any federally-funded transaction. Any contractor or subrecipient must include equivalent certification language in all subawards at every tier, including subcontracts and subgrants, with all parties required to certify and disclose accordingly.

The certification imposes mandatory compliance obligations on contractors and their authorized officials, who must sign and date the form to attest to the truthfulness and accuracy of their statements. Failure to submit the required certification subjects violators to civil penalties ranging from $10,000 to $100,000 for each violation. The form also invokes the provisions of 31 U.S.C. Chapter 38 regarding Administrative Remedies for False Claims and Statements, establishing that false certifications may result in additional legal consequences. Contractors must understand that this certification applies to any non-federal funds used for lobbying activities as well, requiring disclosure on Standard Form-LLL if such funds are involved.
