About this file

This is a Bid Bond Form for the City of Owensboro, Kentucky, serving as a sample template for the 2026 Monarch NRSA Downspout Removal Program. The bond secures bidder performance and compliance with bidding documents, requiring bidders to submit executed agreements and performance and payment bonds within specified timeframes. The form establishes the City of Owensboro, located at 101 E. Fourth Street, P.O. Box 10003, Owensboro, Kentucky 42303, as the Owner, with provisions for bidder and surety identification, bond number assignment, and penal sum specification. Default occurs when a bidder fails to deliver required executed agreements and bonds within the time stipulated in bidding documents or any written extensions approved by the Owner. The bond obligation becomes null and void if the Owner accepts the bid and the bidder delivers all required documentation timely, if all bids are rejected, or if the Owner fails to issue a Notice of Award within the specified timeframe, not to exceed 120 days from the bid due date without surety consent.

The bond requires payment of the penal sum to the Owner within 30 calendar days of written notice of default, with the penal sum constituting the extent of the bidder and surety's joint and several liability and the Owner's sole remedy. Suit or action under the bond cannot commence prior to 30 calendar days after default notice is received and must be initiated no later than one year after the bid due date in a court of competent jurisdiction within Kentucky. The surety must provide a current Power of Attorney evidencing the authority of its signatory officer or representative. All notices must be in writing sent via personal delivery, commercial courier, or United States Registered or Certified Mail with return receipt requested to the addresses specified on the bond's face. The form is designed to conform to all applicable Kentucky statutory requirements, with any omitted statutory provisions deemed included and any conflicting provisions subordinated to applicable state law.

5. Surety waives notice of any and all defenses based on or arising out of any time extension to issue Notice of Award agreed to in writing by Owner and Bidder, provided that the total time for issuing Notice of Award including extensions shall not in the aggregate exceed 120 days from Bid due date without Surety’s written consent.
