The purpose of this Amendment is to answer contractor generated questions and add two clauses to the solicitation.

A. Answering the following questions:

1 Question: There is a discrepancy in the period of performance. In box 11 of the solicitation form 1442, the period of performance is given numerically as 180 days.

It then refers the reader to Section F, Clause 52.211-10. In words, that clause indicates a period of performance of 120 days, then immediately shows 180 days in parenthesis. Which is it?

Answer: The period of performance will be from the NTP until 5/30/2021. To avoid confusion, see the amendment for correction of this period. Outage dates remain unchanged.

2 Question: Division 1, paragraph F.1 indicates the GFE will be delivered to both Kofa and Gila substations. Why is GFE being delivered to Gila? Gila has nothing to do with the project and is seven miles south of Dome Tap, and even further south of Kofa. All GFE should be delivered to Kofa as there is plenty of room to store it, and it is far closer to the actual work than Gila. Gila should be taken completely off the points of delivery.

Answer: Only the fiber is going to Gila so WAPA can perform testing for material acceptance. The contractor shall pick up the fiber from Gila, transport it to Kofa and do their own testing as well if they desire. All items on the Table in 1F1 of the project specification will be delivered to the places designated in that table.

3 Question: Referencing item 2 above, there is no indication what GFE is to be delivered to which substation. The contractor has no idea of what goes where, and how far he will have to travel to pick up what he needs. All GFE should be delivered to Kofa; any GFE slated for delivery to Gila should be rerouted to Kofa.

Answer: See answer above.

4 There are no liquidated damages listed in the solicitation. Should there be some?

Liquidated damages are a part of this specification. Clause 52.211-12 has been added to the solicitation.

B. The following clauses have been added or corrected to the solicitation.

1. 52.211-12 Liquidated Damages - Construction. (SEP 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,329.32 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

(End of clause)

2. 52.228-15 Performance and Payment Bonds - Construction. (OCT 2010)

3. 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK.

(APR 1984)

The Contractor shall be required to (a) commence work under this contract within ten (10) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 May 2021.

The time stated for completion shall include final cleanup of the premises.

(End of clause)

C. The date and time set for receipt of bids remains unchanged, January 14, 2020 at 2:00pm local time.
