About this file
This document contains questions and responses related to a request for proposal from the Department of Energy National Energy Technology Laboratory for the production of mixed rare earth oxides from coal-based resources. The solicitation seeks proposals to develop processes to recover rare earth elements from coal and coal by-products in an environmentally sound manner, using U.S. coal resources containing a minimum of 300 parts per million total rare earth elements. Key details include that financial responsibility documents are required only for the prime contractor, unless it is a joint venture or partnership. The performance guarantee must be submitted by the prime contractor only. Past performance contracts must have been active within five years prior to the June 22, 2015 closing date. For subcontractors, past performance references should come from the prime contractor on previous relevant projects.

Amendment 0003 Attachment 2
QUESTIONS and RESPONSES
Q1. In the case of a prime contractor with a subcontract to another company as part of this project, does the subcontractor need to also provide the financial responsibility documents? Also, does the subcontract organization need to complete the performance guarantee or is that just required of the prime?
R1. Financial responsibility documents are required for the prime entity only, unless the prime entity is a joint venture or partnership. In those instances, financial information must be provided for each member of the joint venture or each partner. Financial responsibility documents are not required for subcontractors. See Solicitation section L.21(e).
The performance guarantee is submitted by the offeror (prime contractor). L.21(e)(4) states “If the Offeror is a limited liability corporation or other partnership entity (including joint ventures) then a performance guarantee agreement is required for each individual entity making up the teaming arrangement.” This would not apply to a subcontract arrangement.
Q2. We would like to request clarification on section L.22 in regard to past performance. The solicitation states:
“The Offeror shall provide no more than three contracts for similar services that have been active (excluding closeout activities) during the past five years, prior to closing date of this solicitation, to be evaluated as relevant past performance.”
Would contracts that finished within the calendar year of 2015 prior to June 22 be excluded as references based on the above statement?
R2. L.22 is correct as stated. Any contracts submitted as part of performance prior to June 22, 2015 would not be considered.
Q3. The minimum duration of the Feasibility Case Study/Option Phase seems to be 7 months, per indicated in the schedule of deliverables. However, it is inadequate considering the scale of design work in the Option program. Our analysis shows that that the downstream FEED study (2021) and construction schedule (2023-24) requirements can be met with an Option program conducted over a more realistic duration of 12-18 months. Can the government provide guidance on the range of duration for the Option study?”
R3. As stated on page 11, “If the Government elects to exercise the option, the work to be performed under this Option I Period shall commence on the date the option is exercised and shall continue for two-hundred and ten (210) calendar days.”
Q4. You have changed the SOW; will you be extending the due date of the proposal?
R4. The change was addition of information in the Background Section on page 1. No changes were made to impact the requirement; therefore, an extension will not be made to the proposal due date.
**Corrected Question/Response from Amendment 0001
| Q5. | Past Performance Questionnaires. Our sub for this RFP will be referencing the same projects that we are using as the prime. For our sub, is the reference point of contact the government entity the work was completed for (i.e NETL) or is the reference point of contact us as the prime on those previous completed projects? |
| R5. | Original response: The reference point should be the government entity. The subcontractor should make sure that the past performance questionnaire indicates their role in those referenced projects. |
Corrected Response: Subcontractor performance would come from the prime contractor of those contracts as the issuer and monitor of performance through those completed subcontracts.
