Multifamily (MF) Loan Underwriting and Closing Support Services Questions and Answers
Q1 Aside from weekly status reports, are monthly reports required? If so, would HUD consider increasing the number of reports from 52 to 64 each contract year?
A1 Monthly Reports are not required.
Q2 Can HUD confirm the number of calendar days loan underwriting for 223(a)(7) loans shall be submitted? Section 5.2, bullet point "a" states 35 calendar days, however it states 20 calendar days under the Performance Standards.
A2 The number of calendar days is 20 days from the date the loan application is accepted into processing for underwriting a 223(a)(7). The PWS under section
5.2 has been revised to reflect the 20 days.
Q3 Can HUD confirm the number of calendar days loan underwriting for 221(d)(4) loans shall be submitted? Section 5.3, bullet point "a" states 35 calendar days, however it states 45 calendar days under the Performance Standards.
A3 The number of calendar days is 45 days from the date the loan application is accepted into processing for underwriting a 221(d)(4). The PWS has been revised in section 5.3 to reflect the 45 days.
Q4 Can HUD confirm if the Management Plan is a separate volume or part of the technical volume?
A4 It is part of the Technical Volume
Q5 Can HUD provide the email to which Attachment F Past Performance Survey shall be sent?
A5 Performance Surveys shall be submitted to Crishonna.a.wade@hud.gov
Q6 As the incentive/remedy calls for a 1% reduction in the associated monthly CLIN price, how to establish the number of components in a particular CLIN associated with the billing. Do we take the number of annual loans in a CLIN (e.g., 250 in CLIN 0001 for 223 (a)7 loans and divide by 12, and the same methodology for each CLIN) to derive the monthly total. (PWS 5.1-5.9)
A6 The Incentive/Remedy section of the PWS has been revised for each task to state the following:
HUD will apply a 1% reduction from the associated monthly CLIN price for performance that falls below the Standard but meets or exceeds the Acceptable Quality Level (AQL).
Q7 Will there be a predetermined number of components per month per CLIN or will the contractor only bill for those units in each CLIN it has completed in the month?
A7 The contract is Fixed Unit Price for those respective CLINs therefore, the invoice should be submitted for units completed.
Q8 To confirm, the 1% penalty is on the amount of the offending unit within a CLIN during the month for which the invoice is submitted. By example, if we billed $100,000 in one invoice for CLINS 0001, 0002 and 0003 in a given month, and the units within each CLIN were priced at $5000 each, and one loan was delayed beyond the AQL standard, the 1% would be applied to that loan….$50 in this example. The contractor would decrement its invoice by $50 in the following month’s invoice.
Or is the 1% applied to the entire CLIN for the month. Example, we billed $33,333 for a CLIN in given month the 1% would be applied to the full monthly CLIN amount, $333 in this case.
Or, is it applied in a different manner?
A8 The monthly CLIN price will be reduced by 1% by the amount invoiced to the Government. The PWS language has been modified to read as follows: HUD will apply a 1% reduction from the associated monthly CLIN price for performance that falls below the Standard but meets or exceeds the Acceptable Quality Level (AQL).
Q9 Who determines whether additional technical consultants are needed to support the taskin, and what the cost for them would be? We are not planning to price these into our bid as it is impossible to tell when these services could be needed. If the government expects these persons will be needed, might it consider a separate CLIN with a ceiling to accommodate the cost to the contractor from the consultants.
A9 Offerors shall proposed the labor mix and level of effort it determines is required to successfully perform the requirement in the PWS.
Q10 Are there any quantifiable standards or criteria to determine application deficiencies or lender delays out of the contractor’s control? Does the contractor need to get exceptions to the AQL's in writing? If so will the contractor need to get in writing a restated delivery date for the affected tasks to avoid the 1% penalty.
A10 HUD has inserted the following AQL language revisions for task 5.1, 5.2 and 5.3: No deviation; exceptions are only permitted for legitimate reasons (e.g., significant application deficiencies, lender delays), and any issues causing material delays shall be discussed immediately with and agreed upon by the HUD office in writing.
Q11 Third party entities who specialize in health care analytics can provide tools and data collation that may not be in use now by HUD, though could aid materially in predicting the likelihood of troubled 232 loans. Is HUD open to the use of such platforms in this contract pursuant to the contract’s mission? If so, would HUD consider adding a CLIN to consider such features or otherwise have these features bid as an ODC?
A11 No additional tools or data analytics will be considered in the processing of loan applications under this contract other than those identified in the PWS.
Q12 The incumbent contractor appears to have been awarded a one-year contact on Dec. 6, 2021. Please confirm.
A12 Confirmed
Q13 How many FTEs is the incumbent employing on the contract?
A13 CPO needs to address. I do not think the CPO can provide this information to the contractor as it should be procurement sensitive information.
