About this file
This is a Request for Bids (RFB) issued by the City of Madison Fire Department for the provision of medical supplies. The City seeks qualified vendors to supply a comprehensive range of fire department medical items, including gauze, bandages, airway equipment, IV supplies, medications, monitoring devices, and various medical consumables detailed across 263 line items on the cost proposal form. The bid consists of two components: fixed pricing for commonly used medical items listed on Form D and a universal discount percentage to apply to all other purchases outside the common items list. Bidders must acknowledge receipt of all bid forms and documents by October 25, 2017, at 2:00 PM CST. The contract term runs from January 1, 2018, through December 31, 2018, with potential renewal for up to two additional annual terms at the City's discretion. Questions regarding the bid were due by October 11, 2017, with answers posted by October 18, 2017. No bidders' conference or site visits are mentioned as mandatory requirements.
Pricing for commonly used medical items must remain fixed throughout each one-year contract period with no adjustments permitted during the annual term; price increase requests may only be submitted during renewal periods. The universal discount must apply to the vendor's lowest published list prices unless expressly exempted by the bidder. All delivery is FOB Destination, Madison, Wisconsin, with required delivery within two business days of order. Bidders must provide an online ordering system with inventory management capabilities compatible with the Fire Department's current Operative IQ inventory software. The City of Madison is tax-exempt and will not pay federal excise taxes or state sales taxes. Successful contractors employing 15 or more employees with aggregate annual business of $25,000 or more must comply with the City's Affirmative Action Ordinance. A local vendor preference is available for registered local suppliers, providing a one percent scoring preference. No specific funding amount or incumbent vendor information is provided in the solicitation documents.

S. 19.36(5)
(5) TRADE SECRETS. An authority may withhold access to any record or portion of a record containing information qualifying as a trade secret as defined in s. 134.90(1)(c).
s. 134.90(1)(c)
(c) “Trade secret” means information, including a formula, pattern, compilation, program, device, method, technique or process to which all of the following apply:
1. The information derives independent economic value, actual or potential, from not being generally known to, and not being readily ascertainable by proper means by, other persons who can obtain economic value from its disclosure or use.
2. The information is the subject of efforts to maintain its secrecy that are reasonable under the circumstances.
The City cannot ensure that information will not be subject to release if a request is made under applicable public records laws. The City cannot consider the following confidential: a bid in its entirety, price bid information, or the entire contents of any resulting contract. The City will not provide advance notice to Bidders prior to release of any requested record.
To the extent permitted by such laws, it is the intention of the City to withhold the contents of Bids from public viewuntil such times as competitive or bargaining reasons no longer require non-disclosure, in the City’s opinion. At that time, all Bids will be available for review in accordance with such laws.

Annually, the successful Bidders shall furnish to City Purchasing usage reports summarizing the ordering history for each department served during the previous contract year. The report, at a minimum, must include each and every item or service ordered during the period, its total quantities and dollars by item/service and in total. The City reserves the right to request usage reports at any time and request additional information, if required, when reviewing contract activity.

1.23 Cooperative Purchasing
Bidders may choose to extend prices offered on bids to other municipalities. Under Wisconsin Statutes, a municipality is defined as a county; city; village; town; school district; board of school directors; sewer district; drainage district; vocational, technical and adult education district; or any other public or quasi-public corporation, officer, board or other body having the authority to award public contracts. This is known as “cooperative” or “piggyback” purchasing, a practice common amongst units of government. The City is not responsible for any contract resulting from a cooperative purchase using this RFB as a basis;
they are made solely between the bidders and third party unit of government.
1.24 Bidders Responsibility
Bidders shall examine this RFB and shall exercise their judgment as to the nature and scope of the work required. No plea of ignorance concerning conditions or difficulties that exist or may hereafter arise in the execution of the work under the resulting contract, as a consequence of failure to make necessary examinations and investigations, shall be accepted as an excuse for any failure or omission on the part of the Bidders to fulfill the requirements of the resulting contract.
2 DESCRIPTION OF SERVICES/COMMODITIES
2.1 Overview
The City is issuing this Request for Bids with the intent of selecting a qualified vendor to provide medical supplies to the City of Madison Fire Department.
2.2 Bid Components
There are two major components of this bid: 1) pricing for medical supplies commonly used by the Fire Department and 2) a discount to be applied to other purchases.
1) Pricing for commonly used medical supplies – The City has provided a list of items it commonly uses or expects to use. Bidders shall provide an exact price for each item they can provide to the City. See Section 2.5 below for additional details on pricing. Bidders are required to specify a price for these items taking all discounts into effect.
2) Instead of requesting pricing for all other medical items the City is calling for a simple universal discount. It is inefficient for the City to maintain and monitor a pricing list of the thousands of existing medical items the City may need now or in the future. Instead, Bidders shall propose a discount, in the form of a percentage deducted from list price, which will apply to all City orders outside of the commonly used items. The City recognizes that Bidders may carry a wide range of products and not be able to extend the discount to all of them. Therefore, as detailed in Section 2.4 below Bidders may specify any number of certain items, or classes of items, for exemption from the discount. See 2.4 below for a more detailed and complete listing of bid conditions.
2.3 List Prices for Common Medical Items
Included on Bid Form D, attached, is a list of the Fire Department’s commonly purchased medical supplies. For these items, Bidders must provide their price. The universal discount, described below, does not apply to these prices; the City shall consider it already included.
2.4 Universal Discount
Bidders are to specify a percent discount on Bid Form D, which will apply to any and all City purchases made outside of the Common Medical Items. This universal discount must apply to any and all products sold by the Bidder, unless expressly excluded by the Bidder in their bid response. List on a separate tab in Bid Form D any and all items, or classes of items, to which the discount will not apply. Example:
“The universal discount we (the bidder) offer will not apply to the following: widgets of all types, thingamajigs manufactured by XYZ Company, Item #12-345(Name) and any promotional items.”
Bidders must be as specific as possible. Failure to apply the discount to any items not expressly listed as exempt may result in rejection of the bid or termination of the agreement. List separately any additional discounts available (e.g. bulk, promotional). The universal discount described above will apply to the successful Bidder’s lowest, most recently published list prices, no matter the source (e.g. print catalog, web, promotions), unless explicitly exempted by the Bidder in their bid.
2.5 Fixed-Term Pricing
The universal discount specified in this bid shall remain the same, or better, for the duration of the agreement and all renewals. The list prices proposed by the Vendor (defined as the successful Bidder the City has selected and executed an agreement with) for common medical items on Bid Form D shall remain fixed during each one-year (1) period granted. The successful Bidder may NOT adjust their list prices for common medical items, those on Bid Form D, during an annual term. A request for pricing adjustment may only be submitted during request for renewal. The suggested price increase will factor into the City’s decision on whether or not to renew.
The Vendor must contact City Purchasing and submit their renewal request at least thirty (30) days prior to the end of the current period. Failure to comply with this condition may result in termination of agreement. Fixed term pricing will also apply to any items subsequently added to the list on Bid Form D (see 2.7 for Addition and Deletion). All deliveries shall be F.O.B. Destination, Madison, Wisconsin and include all charges (e.g. handling, transportation and insurance charges).
2.6 Quantities
An estimated annual usage is provided for common medical items on Bid Form D. These estimates are made in good faith and based on purchases made during the 12 months ending September 30, 2017.
While the City makes no guarantee that these exact quantities will be purchased, Bidders may reasonably use these numbers to submit best pricing. The Fire Department will order items on an “as-needed” basis.
2.7 Addition and Deletion
The City reserves the right to add or delete commonly used items on Bid Form D at any time. For items added, the City reserves the right to negotiate the price or lock in at the same price as its most recent purchase. Any and all items added are subject to fixed term pricing. The successful Bidder may request to have items added to or removed from the exemption list during the term, subject to the City’s approval.
2.8 Term
The bid, if awarded, shall begin on January 1, 2018 through December 31, 2018, and may, at the discretion of the City, be renewed for up to two (2) additional annual terms, provided that both parties are mutually agreeable. Renewal is not automatic or guaranteed; the City will review the pricing and evaluate Vendor performance, before deciding to either extend or discontinue the agreement. The Vendor shall not construe the absence of any such notice or action by the City as automatic renewal.
2.9 Reports
The successful Bidder shall submit annual reports to the City Purchasing Department detailing purchase activity. Vendor shall also make reports available as requested. Vendor shall furnish these reports as an Excel file. At a minimum the reports should include the following information for all items purchased:
o Department o Item description o Item # (if applicable) o Quantity purchased o Sales amount, in dollars, per item
2.10 Brand Standardization
The City will not consider alternate brands in order to stay consistent with the system already in place.
2.11 Delivery
Vendor shall deliver medical supplies within 2 business days of order by the City.
2.12 Online Ordering
Vendor shall provide a free online ordering system accessible via the internet. The system must allow the City to order any item in the Vendor’s inventory. Furthermore, the system must display a list of only the City’s commonly ordered items, in order to facilitate quick and efficient ordering.
2.13 Inventory Tracking and Management System
Bidders, as part of their response, shall elaborate on whether or not they can provide or integrate with Inventory Tracking and Management Systems. The Fire Department currently utilizes Operative IQ inventory software provided by EMS Technology Solutions.
