2 DESCRIPTION OF SERVICES/COMMODITIES

2.1 Scope of Work

The City of Madison anticipates constructing a fully accessible playground to replace an existing community-level playground at Elver Park in 2018 and is seeking proposals from vendors for playground designs.

The intent of this proposal is to select equipment designs that will be presented to the neighborhood as options for their playground. Once the design is selected by the neighborhood, the City shall work with the selected equipment vendor to adjust the design as necessary for the specific site requirements and per neighborhood requests. This final playground design shall fall within the budget established by the City. Construction of the playground, including installation of the playground equipment and procurement and installation of poured-in-place surface, shall be bid under a separate Public Works contract.

The vendor shall submit a minimum of three playground designs:

Playground Design

• The three playground designs shall each have a fully ramp-connected main play structure with equipment age rated and appealing to both 2-5 year olds and 5-12 year olds and one triple-bay swing with two tot / two belt / two accessible seats within $110,000 (excluding delivery).

Additional Individual Components

• The vendor shall also submit six (6) stand-alone play components as identified in this RFP.

All playground designs must be from one manufacturer and one product line. Additional product lines may be submitted and must include three designs as described above.

The submitted playground designs shall represent both a potential playground design layout, and the character of the product line represented by that design.

The City will select playground product lines to present to the neighborhood based on the evaluation criteria listed in this Request for Proposals. Following selection of vendors under this RFP, the City will ask for a 22x34 or 24x36 presentation-style board showing the selected equipment to take to the neighborhood meeting. Please note that presentation boards are neither required nor desired as part of the initial RFP submittal.

The final selection of the equipment shall be the responsibility of the neighborhood, and there is no guarantee or commitment of any kind regarding usage of any contracts resulting from this solicitation.

There shall be no attempt of any kind from the vendor to persuade the neighborhood to select their representative equipment.

Playground manufacturers may not submit multiple proposals using different vendors. In the event that there are multiple submittals from different vendors for a playground manufacturer, the City will only review the proposal from the nearest vendor in proximity to the City of Madison.

8649-0-2017-BO Fully Accessible Playground Equipment edited by Kate.doc Page 8

3 REQUIRED INFORMATION AND CONTENT OF PROPOSALS

3.1 General Design Requirements

1. All playground designs must comply with the Americans with Disabilities Act (ADA) and the latest edition of ADA Standards for Accessible Design.

2. Suppliers shall base their playground designs on meeting all safety standards as well as guidelines and specifications identified in this RFP. Quality of equipment components, quality of design, and cost must be taken into consideration of the playground system design.

3. All play system elements must meet and/or exceed all federal, CPSC, ASTM & IPEMA guidelines.

4. Designs should focus on side-by-side play wherever possible. Designs must provide a well-balanced combination of usability, engaging play and interaction opportunities for all children.

Playground designs should be as appealing to able-bodied users as to those with physical and/or mental challenges.

5. Equipment must appeal to the wide array of differently-abled users: use of tactile features, contrasting colors, sheltering/quiet zones, sound elements, activity panels or other secondary games, wide turn-around areas, generous (meeting or exceeding accessibility standard) ramp aisles and play elements that can be reached from multiple points are encouraged.

6. Main play structure should avoid ramps to islands: situations where a user in a chair is able to ascend to a single platform within the main structure and is then forced to dismount the chair or turn-around as an only exit option are strongly discouraged.

7. Vendor to assume all ingress / egress points are at-grade: site manipulations such as earthwork or elevated concrete walkways to meet grade changes are unlikely at the site. Ramping will be required.

8. All design submittals shall not exceed the costs identified in Section 4.1 (3).

9. All play equipment will be purchased by the City of Madison and ordered for delivery from the vendors to a predetermined receiving location. The supplier of the playground equipment is responsible for securing all deliveries and insuring the completeness and correctness of the order prior to shipping. If materials are found to have been damaged or the delivery is not complete or correct upon delivery to the City’s predetermined receiving location, the supplier shall be responsible for resolving issues and supplying corrected playground products within 2 weeks of notification of the issue(s).

Playground Design Requirements Each playground design shall include the following, not to exceed $110,000:

1. Triple bay arched swing with two tot / two belt and two accessible swing seats

2. Play structure: Each playground design shall include the following:

• Fully ramp-connected play structure with at-grade entry and exit points

• Components shall include, but not be limited to: slides, roofs, climbers, decks and bridges

• At least one piece of equipment shall have a motion component (i.e. twirl, shake, spin, etc.)

Color Requirements Material color choices must include the following and samples must be submitted with the proposal:

• Railings and safety restraints should be a highly contrasting color to the posts and support structures (ramps / decks)

• Climbing elements (fire poles, ladders, overhead bars) should NOT be the same color as handrails

8649-0-2017-BO Fully Accessible Playground Equipment edited by Kate.doc Page 9

• Slides and roofs: Beige

• Platforms: Dark Brown

Additional Stand-alone / Individual Components Each manufacturer shall provide costs for additional individual components that can be potentially interchanged or added to the playground structure or playground site. The purpose of this submittal is to identify the individual component costs of features that may be used to modify the playground design that was submitted as part of this RFP. The City realizes that changing an individual component on a play structure can modify costs and designs associated with platforms, fasteners, posts, orientation, etc. This component of the RFP shall not include those costs, and shall only include the cost of the component itself. Costs associated with modifications to platforms, fasteners, posts, orientation, etc. shall be addressed as part of the final design.

The proposer shall submit the costs for the following types of stand-alone components:

1. One multiple seat spring rider with C-clamp construction

2. Multiple seat spinner with seats featuring high backs and heights for easy transfer to/from wheelchairs

3. Disc / group swing with seat base height appropriate for wheelchair transfer

4. Dome / cocoon or quiet space feature (spinning or static)

5. Net climber (spinning or static) with wide base for sitting/standing

6. Vendor’s choice stand-alone component with cost not exceeding $20,000

3.2 Design Restrictions

Designs shall not include the following:

• Spiral construction spring rider (spring rider must be constructed with C clamp construction)

• Fabric elements

• Triple bay swing with any type of frame other than an arch

• Single ramp/point of entry for wheelchair

3.3 Materials

1. The play structures shall be constructed of steel or aluminum posts, with PVC coated steps, including all transfer points and decks. Wood shall not be permitted.

2. All materials shall be new and not used.

3. All posts shall be aluminum with a minimum 5” outside diameter.

4. No wood shall be used on the equipment.

5. All steel decks shall be plastic or PVC coated.

6. All slides and roofs shall be molded (no stainless steel or other metal) and colored through the product with a UV stabilized material.

7. All hardware for decks shall be stainless steel, tamper resistant without protrusions or projections and provided by the vendor.

8. All materials shall be structurally sound and suitable for safe play.

9. All metal finishes should be powder coated.

CITY OF MADISON

(STC-Form: 07/26/2016)

1. General. Throughout this document, "City of Madison," "City" and "Purchasing" shall be synonymous and mean the City of Madison. The words "bid" and "proposal" are synonymous, as are the words "bidder," "proposer" and "contractor." The phrases "request for proposal," "invitation for bids," "request," "invitation," and "solicitation" shall also be synonymous.

As applied to the winning or selected bidder, the words "bid," "proposal," and "contract" are synonymous.

2. Entire Agreement, Order of Precedence. These standard terms and conditions shall apply to any Purchase Order issued as a result of this Request for Bid/Proposal, except where expressly stated otherwise in the RFP or in a written instrument covering this purchase signed by an authorized representative of the City and the Contractor, in a form approved by the City Attorney (a “Separate Contract”). If such a separate contract is executed it shall constitute the entire agreement and no other terms and conditions, whether oral or written, shall be effective or binding unless expressly agreed to in writing by the City.

If a Separate Contract is not executed, these Standard Terms and Conditions, the City’s request for proposals, the version of the vendor’s bid that was accepted by the City, and the City’s Purchase Order (if any) shall constitute a contract and will be the entire agreement.

Order of Precedence: If there is a conflict between this Section A and any terms in the vendor’s accepted bid or proposal, this Section A shall control unless the parties expressly agree to another order of precedence, in writing. If there is a conflict between this Section A and a Separate Contract, the terms and conditions of the Separate Contract shall control.

I. TERMS FOR SUBMISSION OF BIDS: The following section applies to the bid/selection process only.

3. This invitation for bids does not commit the City to award a contract, pay any costs incurred in preparation of bids, or to procure or contract for services or equipment. The City may require the bidder to participate in negotiation and to submit such additional price or technical or other revisions to his or her bids as may result from negotiation. The bidder shall be responsible for all costs incurred as part of his or her participation in the pre-award process.

The City reserves the right to accept or reject any or all bids submitted, in whole or in part, and to waive any informalities or technicalities which at the City’s discretion are determined to be in the best interests of the City. Further, the City makes no representations that a contract will be awarded to any offeror responding to this request. The City expressly reserves the right to reject any and all bids responding to this invitation without indicating any reasons for such rejections(s).

The City reserves the right to postpone due dates and openings for its own convenience and to withdraw this solicitation at any time without prior notice.

4. Addenda. Changes affecting the specifications will be made by addenda. Changes may include, or result in, a postponement in the bid due date. Bidders are required to complete the Bidder Response Sheet, acknowledging receipt of all parts of the bid, including all addenda.

5. Price Proposal. All bidders are required to identify the proposed manufacturer and model, and to indicate the proposed delivery time on the attached Proposal Form. Failure to do so may cause the bid to be considered not responsive. If desired, the bidder may include product literature and specifications. The price quoted will remain firm throughout each contract period. Any price increase proposed shall be submitted sixty (60) calendar days prior to subsequent contract periods and shall be limited to fully documented cost increases to the bidder which are demonstrated to be industry-wide.

6. Price Inclusion. The price quoted in any bid shall include all items of labor, materials, tools, equipment, and other costs necessary to fully complete the furnishing and delivery of equipment or services pursuant to the specifications attached thereof. Any items omitted from the specifications which are clearly necessary for the completion of the project shall be considered a portion of the specifications although not directly specified or called for in these specifications.

7. Pricing and Discount.

a. Unit prices shown on the bid/proposal or contract shall be the price per unit of sale (e.g., gal., cs., doz., ea., etc.) as stated on the bid/proposal or contract. For any given item, the quantity multiplied by the unit price shall establish the extended price. If an apparent mistake exists in the extended price, the unit price shall govern in the bid/proposal evaluation and contract administration.

b. In determination of award, discounts for early payment will only be considered when all other conditions are equal. Early payment is defined as payment within fifteen (15) days providing the discount terms are deemed favorable. All payment terms must allow the option of Net 30.

8. F.O.B. Destination Freight Prepaid. Bid prices must include all handling, transportation and insurance charges. Failure to bid FOB Destination Freight Prepaid may disqualify your bid.

9. Award.

a. The City will have sole discretion as to the methodology used in making the award. Where none is specified, the award will be made to the lowest responsible bidder in compliance with the specifications and requirements of this solicitation.

b. The right is reserved to make a separate award of each item, group of items or all items, and to make an award in whole or in part, whichever is deemed in the best interest of the City.

10. Responsiveness and Responsibility. Award will be made to the responsible and responsive bidder whose bid is most advantageous to the City with price and other factors considered. For the purposes of this project, responsiveness is defined as the bidder’s conformance to the requirements of the solicitation. Being not responsive includes the failure to furnish information requested.

If requested, the bidder must present within five (5) working days evidence satisfactory to the City of performance ability and possession of necessary facilities, financial resources, adequate insurance, and any other resources required to determine the bidder’s ability to comply with the terms of this solicitation document.

11. Cancellation.

a. The City reserves the right to cancel any contract in whole or in part without penalty due to non-appropriation of funds.

b. In the event the Bidder shall default in any of the covenants, agreements, commitments, or conditions and any such default shall continue unremedied for a period of ten (10) days after written notice to the Bidder, the City may, at its option and in addition to all other rights and remedies which it may have, terminate the Agreement and all rights of the Bidder under the Agreement.

c. Failure to maintain the required certificates of insurance, permits, licenses and bonds will be cause for contract termination. If the Bidder fails to maintain and keep in force the insurance, if required, the City shall have the right to cancel and terminate the contract without notice.

II. CONDITIONS OF PURCHASE: The following section applies to purchases/contracts after the award. See Paragraphs 1 & 2 for applicability and order of precedence.

12. Specifications.

a. All bidders must be in compliance with all specifications and any drawings provided with this solicitation. Exceptions taken to these specifications must be noted on your bid.

When alternates are bid/proposed, they must be identified by manufacturer, stock number, and the bidder/proposer is responsible for providing sufficient information to establish equivalency. The City shall be the sole judge of equivalency. Bidders are cautioned to avoid bidding alternates which do not meet specifications, which may result in rejection of their bid/proposal.
