GOALS OF INDUSTRY DAY

Promote competition on the proposed acquisition.

Develop Industry’s understanding of the Government’s current vision and objectives.

Provide Industry with the opportunity to meet with the Government early enough in the procurement process to provide input into the Multiple Center Administrative Services (MCAS) procurement strategy.

Encourage offerors to submit questions and comments electronically via email to the Contracting Officer(s) as identified on SAM.gov.

RESPONSES TO QUESTIONS

Verbal questions will be answered during Industry Day at the end of the presentation.

Responses to verbal questions will not be considered official.

The Government expects that verbal questions received from Industry will be followed-up in writing. Please submit questions to Rachel.Clayton@NASA.gov and Johnny.M.Hisaw@NASA.gov. All questions shall by submitted no later than COB, January 24, 2024.

The Government may not respond to untimely questions submitted. However, if responses are provided, they will be posted to the SAM.gov website.

Only the written responses posted in SAM.gov are considered official. If a difference exists between verbal and written responses to questions, the written responses shall govern.

SPECIAL CONSIDERATION

NOTE TO PROPECTIVE OFFERORS

Prospective offerors are reminded not to contact incumbent personnel (either directly or through electronic means) during duty hours or at their place of employment, as such contacts are disruptive to the performance of the current contract.

MCASS will use Odd Numbered Wage Determinations (WD)

Wage determinations (e.g., 15-5447) require the contractor to satisfy the health and welfare fringe benefit requirements on a “fixed cost” per employee basis. (fringe benefits must be paid on both productive and non-productive hours)

For active contracts using odd-numbered WDs, the CO will use the odd-numbered WD for your WD modifications

Odd Wage Determination - Average Cost Fringe Benefit Example Fringe applied to both productive and non-productive hours = includes holiday, sick, and vacation leave Fringe applied to all hours up to 40 hours per workweek and 2,080 hours per year for every employee Fringe benefits NOT applied to overtime

What are different types of benefits an employee may receive?

MCASS Industry Day

Health & Welfare

• EO 13706 applies to this requirement, HW = $4.57

• for all hours paid per employee or for the average of all hours worked by the service employees as a whole; depending on the type of wage determination you have

Sick Leave

• FAR 52.222-62 Paid Leave Sick Leave under Executive Order 13706

• Contractor must provide employees (exempt and non-exempt) with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Vacation

• 2 weeks paid vacation after 1 year of service with a contractor or successor; 3 weeks after 5 years, and 4 weeks after 15 years.

• Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility.

Holidays

• 11 paid holidays per year minimum

• A contractor may substitute another day off with pay in accordance with a plan communicated to the employees involved.

What is a "bona-fide" fringe benefit?

“To be considered a ‘bona fide’ fringe benefit . . . a fringe benefit plan, fund, or program must constitute a legally enforceable obligation which meets the . . .

criteria” prescribed at 29 C.F.R. §4.171 (a)

29 C.F.R. §4.171 (b) and (c) identify items that are not considered bona fide fringe benefit. For example, 29 C.F.R. §4.171 (c) states benefits required by other Federal, State or local such as unemployment compensation, workers' compensation, or social security, are not fringe benefits.

Offerors are responsible for understanding labor laws or regulations to understand the requirement to provide bona fide fringe benefits under the MCASS contract.

What is NOT a "bona-fide" fringe benefit?

Fringe benefits are required to be provided separate from and in addition to the specified minimum hourly rate provided on the wage determination.

Fringe benefits are not included in the hourly wage rate, even if the hourly wage is more than required by the WD.

Procurement Schedule

The Government intends to issue a Draft Request for Proposal (DRFP).

Following the release of the Draft RFP, Industry will have an opportunity to submit questions and comments in writing so the government may officially respond.

A more detailed procurement schedule will be posted to the SAM.gov website as soon as it is available.

One-on-one meetings must be requested in writing no later than January 19, 2024.

All one-on-one meetings will be held virtually.

Only one meeting will be allowed per company.

Meetings will not exceed 20 minutes in length. Please manage your time accordingly.
