FAR 52.212-2, EVALUATION - COMMERCIAL ITEMS (OCT 2014). The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors are in descending order of importance and shall be used to evaluate offers: Price, Technical, and Past Performance.

ADDENDUM TO FAR 52.212-2 EVALUATION - COMMERCIAL ITEMS (OCT

2014).

(a) EVALUATION FACTORS AND SELECTION OF THE SUCCESSFUL

OFFEROR

The Contracting Officer will utilize a Lowest Price Technically Acceptable (LPTA) source selection process to make an award decision. Only one award will be made as a result of this synopsis/solicitation. Award will be made to the offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), who conforms to the synopsis/solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, meets the technically acceptable standard for the technical factors and provides the lowest evaluated price. The selection will be made subject to an affirmative determination of contractor responsibility in accordance with FAR Subpart 9.1. The offeror’s proposal will be evaluated in accordance with the procedures identified below.

(b) EVALUATION OF PRICE PROPOSALS The Contracting Officer will review each offeror’s submitted total price. As part of this process, the Government will establish a proposal price ranking of all offers from lowest to highest, taking into consideration any contract financing. The proposed prices will be evaluated by comparison against the Government estimate and prices submitted by other offerors.

(i) For evaluation purposes, when contract financing terms vary among offerors, the contracting officer will adjust each proposed price to reflect the cost of providing the proposed financing in order to determine the total cost to the Government of that particular combination of price and financing.

(ii) Contract financing results in the Government making payments earlier than it otherwise would. In order to determine the cost to the Government of making payments earlier, the contracting officer will compute the imputed cost of those financing payments and add it to the proposed price to determine the evaluated price for each offeror.

(iii) The imputed cost of a single financing payment is the amount of the payment multiplied by the annual interest rate, multiplied by the number of years, or fraction thereof, between the date of the financing payment and the date the amount would have been paid as a delivery payment. The imputed cost of financing is the sum of the imputed costs of the financing payments. The delivery payment date is June 3, 2021.

(iv) The contracting officer will calculate the time value of proposal-specified contract financing arrangements using as the interest rate the nominal discount rate specified as 1.6% in Appendix C of the Office of Management and Budget (OMB) Circular A-94, “Guidelines and Discount Rates for Benefit- Cost Analysis of Federal Programs,” appropriate to the period of contract financing. Where the period of proposed financing does not match the periods in the OMB Circular, the interest rate for the period closest to the finance period shall be used.

(c) EVALUATION OF TECHNICAL PROPOSALS

Offerors will be evaluated on the technical sub-factors of Certification, Technical Experience, Quality Control Plans, and Past Performance. “ACCEPTABLE” means the proposal clearly meets the minimum requirements of the solicitation.

“UNACCEPTABLE” means the proposal does not clearly meet the minimum requirements of the solicitation. An “UNACCEPTABLE” rating in any technical sub-factor will result in an overall technical proposal being rate “UNACCEPTABLE”, which makes the proposal ineligible for award.

(1) CERTIFICATE OF AUTHORIZATION The Government will verify the offeror’s Certificate for the authorization to build ASME pressure vessels. The certificate must be current.

(2) TECHNICAL EXPERIENCE

Offerors must have the technical experience needed to meet the technical performance requirements of this synopsis/solicitation. The Government will assess the technical experience of an offeror on contracts/projects identified in the offeror’s Technical Experience. An offeror’s technical experience must satisfy all of the following requirements to receive an “Acceptable” rating:

(i) All three (3) projects listed in the Technical Experience Summary must have been performed by the offeror as a prime contractor or major subcontractor with a requirement to build MC-338 tanker trailers or similar.

(ii) All three (3) projects listed in the Technical Experience Summary must have been successfully completed within five (5) years of the date of issuance of this solicitation.

(iii) All three (3) projects were completed within the performance period.

(iv) All corrective actions for all three (3) projects were implemented successfully.

Failure to meet all of the requirements under this sub-factor will result in an “UNACCEPTABLE” rating and elimination from further consideration for contract award.

(3) QUALITY CONTROL PLAN(S)

The Government will assess the submitted Quality Control plan(s) for completeness and compliance in accordance with the SOW sections 2.g and 3.d. The review will assess the offeror’s familiarity with the project’s technical requirements, as well as the offeror’s ability to translate those requirements into effective actions to complete the project with a high degree of quality.

Failure to provide a Quality Control Plans demonstrating a sound technical approach for ensuring quality workmanship will result in an ‘UNACCEPTABLE” rating and elimination from further consideration for contract award.

(4) PAST PERFORMANCE

The Government will assess the past performance of the offeror on all of the contracts/projects identified in the offeror’s Technical Experience Summary and may consider the offeror’s past performance on other recent and relevant projects. (This assessment of past performance information is separate from the contractor responsibility determination required under FAR Subpart 9.1.).

The customer contact equivalents identified in the Technical Experience Summary will be evaluated. The Government shall consider this information, as well as information obtained from other sources (to include interviews with previous customers and search results in the Contractor Performance Assessment Reporting System Information), when evaluating each offeror’s past performance. The currency and relevance of the information, source of the information, context of the data, and general trends in the offerors’ past performance shall be considered.

The Government will not disclose the names of persons/companies who provide performance information. If, during the course of the evaluation, the Government obtains adverse information to which the offeror has not previously had an opportunity to respond, the Government will afford the offeror an opportunity to clarify the adverse information.

(i) Past Performance Evaluation Areas. The Government will evaluate the offeror’s past performance in:

(A) Overall project management ability to meet specifications

(B) Completing a project within deadline

(C) Ability to complete project according to specifications

(D) Ability to ensure quality workmanship

(E) Complete deliverables as required

(F) Understanding and complying with safety requirements

(G) Effectiveness and timeliness of corrective actions

(H) Contractor’s performance regarding cure notices, show cause letters, or terminations for cause/default.

(I) Overall Contractor Performance

(ii) Past Performance Evaluation Ratings:

Past performance will be rated on an “acceptable” or “unacceptable” basis.

“ACCEPTABLE”

Based on the offeror’s performance record, the Government has a Reasonable expectation that the offeror will successfully perform the required effort or the offeror’s performance record is unknown.

“UNACCEPTABLE”

Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, or so sparse that no meaningful past performance rating can be reasonably assigned; the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a) (2) (iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered

“ACCEPTABLE.”

(5) EVALUATION PROCESS

The evaluation for this acquisition will be conducted using the lowest-price-technically-acceptable (LPTA) evaluation process. The Government reserves the right to make award without discussions.

(1) Offerors will be checked against the List of Parties Excluded from Federal

Procurement and Non-procurement Programs. Offerors who appear on the List will be eliminated without further consideration.

(2) The Government intends to evaluate the lowest priced proposal, and if it is determined to be technically acceptable, then make award to that offeror. If the lowest priced proposal is determined not technically acceptable, the Government will evaluate the second lowest priced proposal.

(3) In the event that the Government is unable to make a technical acceptability/unacceptability determination for the lowest priced proposal, the Government reserves the right to hold exchanges only with the lowest priced offeror prior to evaluating the second lowest priced proposal.

(4) If after exchanges conclude and the lowest priced proposal is still the lowest price and determined technically acceptable, award will be made to that offeror. If after exchanges conclude and the lowest priced proposal is determined not technically acceptable, the Government will evaluate the second lowest priced proposal for technical acceptability. If after exchanges conclude and the first lowest priced proposal is no longer the lowest priced quote (e.g. a change in price as a result of exchanges), the Government will evaluate the second lowest price quote for technical acceptability. This process will continue until the lowest priced technically acceptable proposal is identified.

(5) When the Contracting Officer determines exchanges on matters unrelated to technical acceptability (e.g. industry terms and conditions such as pricing omissions, discrepancies or other irregularities preventing the Government from determining an offeror’s total evaluated price) to be necessary, the Government reserves the right to conduct exchanges to resolve these matters.
