Proposal Formatting
• Instructions for proposal arrangement, page limitations, copies and the due date are specified in JPI 52.215-113, Proposal Formatting Instructions, and Section L.21, Proposal Arrangement, Page Limitations, Copies, and Due Dates.
Offerors shall submit their proposals in accordance with those instructions.
Pages submitted in excess of the limitations specified in
Section L.21 will not be evaluated by the Government and will be returned to the offeror in accordance with NFS 1815.204- 70(b).
Minor informalities or irregularities in a proposal that can be adjusted, corrected, or waived without being prejudicial to other offerors may be accepted if it is immaterial to the acquisition.
However, any pages contained in a page limited section of your proposal which do not comply with the RFP requirements may be returned by the Government and not evaluated.
Proposal Formatting, Continued
• Pay close attention to ensure that the number of pages, page margins, font type, font size, and page size are in conformance to Section L.21.
• Return the entire model contract, not just the pages with the fill-ins.
The model contract becomes the actual contract and so it must be complete and correct.
• Please note page limitations.
Some volumes/sections are subject to a page limitation and others are not.
In the Past Performance Volume, the Past Performance
Information is subject to the page limit of 35 pages, but the Key Personnel Resume, Environmental Non-Compliance, OSHA Forms 300 and 300A, Insurance Carrier Information, Past Performance Attachments, Organizational Chart, Past Performance Matrix and Consent Letters are not subject to the page limitation.
Proposal information must be provided in the correct volume.
Proposal information in a page-limited volume or section should not be moved to another volume/section without such page limitations.
• Having non-conforming pages returned may affect the government’s evaluation of a proposal, and how this proposal is ultimately rated.
Responsibility Considerations
• The Contracting Officer makes the determination of responsibility per
FAR 9.104.
Responsible means that the contractor has adequate organizational and financial controls, satisfactory business ethics, financial resources, the ability to successfully perform the work, is eligible, etc.
This determination is performed by the CO and is separate from the selection decision.
If an offeror is not responsible, then they are not eligible for award.
• The Contracting Officer will also check the FAPIIS database (includes records of the Contractor’s previous contracts.)
• The Contracting Officer will request an Equal Opportunity clearance and check to ensure the veteran’s reports are submitted.
• This determination is performed for offerors in the competitive range or the successful offeror only.
Model Contract
• The Model Contract consists of the elements requested in Volume V of the RFP.
The Evaluation Criteria, and Instructions are used for selection purposes only.
• The Offerors will submit a signed Model Contract with their proposal.
The Model Contract becomes the actual contract and so it must be complete and correct.
The Model Contract must be signed by a person authorized to commit the offeror.
All pages must be returned – not just the pages with the fill-ins.
• The Contracting Officer will sign the Model Contract of the Successful
Offeror once all issues are resolved and the selection decision is made.
• Errors or inconsistencies in the Model Contract (that cannot be resolved) may result in an offeror being removed from consideration for award.
• The Model Contract takes precedence over the proposal.
Ensure that your rates in the Cost/Price Volume are reflected in Section B of the Model Contract.

Prime Offeror do not match the FBRs proposed by the Subcontractor
Direct Labor Rate Adjustments Incumbent Labor Rates – Where an Offeror has indicated the intention of both retaining incumbents and paying incumbent direct labor rates, and has not utilized the incumbent direct labor rate, the Offeror’s proposed direct labor rate will be adjusted to reflect the incumbent direct labor rate (reference the EPM Templates “IA – Incumbency Assumptions” and “Incumbency Retention and Pay (IRAP)”) Scenario A: Offeror proposes 100% incumbent retention for SLC
“X” and indicates intention to pay incumbent direct labor rates to 100% of incumbents but does not utilize the incumbent direct labor rate. 100% of the Offeror’s proposed direct labor rate will be adjusted to reflect the incumbent’s direct labor rate.
Direct Labor Rate Adjustments (Con’t) Incumbent Labor Rates (Con’t)
Scenario B: Offeror proposes 100% incumbent retention for SLC “X” and indicates intention to pay incumbent direct labor rates to 75% of incumbents but does not utilize the incumbent direct labor rate. 75% of the Offeror’s proposed direct labor rate will be adjusted to reflect the incumbent’s direct labor rate. The remaining 25% of the proposed direct labor rate will not be adjusted to reflect the incumbents proposed direct labor rate but will be evaluated for reasonableness based upon the Offeror’s supporting rationale and/or documentation provided.
Direct Labor Rate Adjustments (Con’t) Incumbent Labor Rates (Con’t)
Scenario C: Offeror proposes 10% incumbent retention for SLC “X” and indicates intention to pay incumbent direct labor rates to 50% of incumbents but does not utilize the incumbent direct labor rate. 5% (10% x 50% = 5%) of the Offeror’s proposed direct labor rate will be adjusted to reflect the incumbent’s direct labor rate. The remaining 95% of the proposed direct labor rate will not be adjusted to reflect the incumbents proposed direct labor rate but will be evaluated for reasonableness based upon the Offeror’s supporting rationale and/or documentation provided.
Direct Labor Rate Adjustments (Con’t) Other Than Incumbent Labor Rates – Adjustments are most likely when:
Offeror proposed data is not reasonable and realistic RFP required supporting data is not provided (Third Party Salary
Data) or adequately referenced Offeror referenced documents cannot be verified:
– Forward Pricing Rate Agreement (FPRA)
– Forward Pricing Rate Recommendation (FPRR)
– It is suggested that FPRAs and FPRRs be included with the
Cost/Price Volume.
Labor escalation is not adequately supported and/or is not reasonable and realistic.
Indirect Rate Adjustments RFP required supporting data is not provided (FPRA/FPRR
Agreements) Use information contained on the Offeror’s Overhead and
G&A templates and Cost Narrative:
Historical Indirect Data does not reconcile with proposed indirect data and no explanation and/or supporting narrative is provided Insufficient information on the forecasts and assumptions used
(cost pool and base of application) for each indirect rate, if no FPRA or (FPRR) is in effect or does not cover the entire period of performance
Use Audit or ACO indirect rate information, where available
Technical/Management Evaluation of Proposed Staffing and Non-Labor Resources (NLRs)
Based on all technical or management weaknesses related to resources associated with each of the three Sample Task Orders (STOs):
Number of Work Year Equivalents (WYEs) Skill mix of WYEs Non-Labor Resources (NLRs)
Discrepancies between Technical and Cost/Price Volumes associated with each of the three STOs
Develop Pricing Charts for Presentation to the Source Evaluation Board (SEB) & the Source Selection Authority
(SSA)
Proposed Cost vs. Probable Cost and Delta Rationale for Probable Cost Adjustments
Government Resource Estimate
(GRE)
What is the GRE?
Applicable only to each of the three STOs Government’s best estimate of resources (WYEs only) necessary to perform each STO Grass roots estimate, not budgetary
GRE will be provided to Offerors Section L, Paragraph L.23.2(C)(4), Table L.4 (WYEs Only) Applicable to the effort over a twelve-month period Offeror is responsible for WYE Skill Mix and NLRs
The GRE is not intended to influence the Offeror’s proposed estimates. Offerors shall develop their own estimates that are:
Consistent with Offeror’s Management Approach Consistent with Offeror’s Technical Approach
Specified Resources Estimate (SRs)
What are IDIQ Specified Resources (SRs)?
Specified Resources (labor hours and non-labor resources) are provided by the Government for each Contract Year
Section L, Paragraph L.23.5(C), Table L.7a (labor hours) and 7b (NLRs) and in the RFP Excel Pricing Model (EPM) ICST – SR Tab
SR Hours assigned to each Standard Labor Category (SLC) indicates anticipated labor distribution for typical projects for a task order based primarily on historical data SR Non-Labor Resources (NLRs) are based on historical data as impacted by the COVID 19 environment with out-year projections allowing for a return to a pre-COVID 19 environment Offerors shall not change the Government provided SRs as identified in Section L (Tables L.7a and 7b) of the RFP
