Modification 5: Revisions to Questions 2, 8 and 10

# Reference Page No. Question Response

2 Cover Letter and Section L.21

2, L-L-3 There are two different dates for the Pre-Proposal Conference: August 24 and September 2. Would the Government please clarify? Is the date firm and would the Government please provide the link for registering for the virtual event?

The Government has modified its response to Question 2, which was provided as an attachment to Modification 2, per the description below.

The Government has revised the date for the Pre- Proposal Conference to September 9, 2020.

Therefore, the Draft Request for Proposal has been modified to ensure that all dates reflect September 9, 2020.

All information necessary to register for the pre-proposal conference is provided in Provision entitled 1852.215-77 “PREPROPOSAL/PRE- BID CONFERENCE (APR 2015)” of the document entitled “80JSC020R0045 Revised Draft RFP 8_25_20.”

8 L31.1 Past Performance Narrative

L-L-15 Draft RFP section L31.1 Past Performance Narrative states that Offerors shall clearly detail “…the specific resources (workforce, management, facilities, or other resources) to be employed and relied upon to perform the proposed effort.” As these tasks are generally management-related items of the prime Offerors overall corporate resources and not specific to individual contract capabilities, industry recommends that the Government remove this requirement from the Past Performance Narrative section.

The Government has modified its response to Question 8, which was provided as an attachment to Modification 4, per the description below.

After considering its initial response, the Government noted that the phrase “…the specific resources (workforce, management, facilities, or other resources) to be employed and relied upon to perform the proposed effort” is utilized three separate times in the draft RFP.

Further, the Government considered that this exact phrase is also utilized in the JSC Procurement Instruction Provision entitled 52.215-115 “Past Performance Evaluation. (NOV 2018) (JSC Procurement Instruction).”

The Government determined that the purpose of this phrase is to dilettante the work the prime contractor may perform vs. the work its proposed subcontractors may perform in order to validate that the prime contractor will have meaningful involvement in contract performance.

The Government continues to consider past performance that demonstrates performance and/or access to facilities necessary to perform SEAM II requirements without requiring the use of NASA facilities to be relevant. Therefore, the Government will continue to include the following sentence in L31.1:

“The Offeror shall provide relevant past performance that demonstrates performance at facilities necessary to perform SEAM II SOW requirements without requiring the use of NASA facilities.”

10 L31.1.b Relevant Past Performance Matrix

L-L-16 Draft RFP section L31.1.b Relevant Past Performance Matrix states that “Only contract periods of performance within five years from the issuance date of the SEAM II final RFP will be considered in the past performance evaluation.”

However, Draft RFP section L31.1 Other Past Performance Data states that “Offerors shall provide the following performance data with explanatory remarks on contracts performed in the last three years.” Can the Government confirm that a five-year performance period for both of these requirements is acceptable?

The Government has modified its response to Question 10, which was provided as an attachment to Modification 4, per the description below.

The Government confirms that the five-year performance period is the correct period for all Past Performance Section L guidance other than the section entitled “Other Past Performance Data.”

To explain, the information contained within “Other Past Performance Data” describes a specific subset of past performance data, which includes items such as “Environmental Data” and “Safety and Health Data.” For the SEAM II procurement, the Government has determined that it only requires three years of “other past performance data” to determine that the contractor is compliant with environmental and safety and health requirements. Therefore, the Government will not modify Section L31.1 “Other Past Performance Data” to change references from three years to five years.
