RFP m Proposal Preparation Instructions ii (d) 37 If a major subcontractor is proposed, is a subcontractor MS volume submission required?
Offerors shall follow the solicitation instructions for proposals submission regarding volumes to submit References in provision "Electronic Submission of Proposals – Proposal Marking and Delivery Through NASA’s EFSS Box (Nov 2021)" are for informational purposes only and do not override the proposal instructions
4 Pricing Exhibit (Using Attachment D-13 Pricing) Pursuant to Solicitation Instructions E 2(h)(v) 3 Header The following is a copy of the referenced section: E 2 ADDENDUM to FAR 52 212-1 Instructions to Offerors—Commercial Products and Commercial Services h Communications Regarding this Solicitation There is no “v” below h
The Attachment D-C pricing exhibits contain a typographical error Offerors should refer to solicitation instruction E 2(m)(v) for price volume instructions
5 Pricing Exhibit Attachment D-13 all all
The pricing PDF requests monthly pricing Does NASA have a preferred/expected method to calculate monthly productive hours?
Is this assumption appropriate? 52 week * 40 hours = 2080 total annual hours 11 federal holidays * 8=88 24 hours min CA sick leave 40 hours min SCA vacation 2080-(88+24+40)=1928 annual 1928/12=160 67 monthly productive hours at AFRC
Offerors should propose monthly rates in accordance with their standard business practices and company methodology The government does not have an expected method for calculating productive hours
6 Solicitation m Proposal Preparation Instructions (v) 40 all
Offerors shall propose a Firm-Fixed Price (FFP), fully burdened monthly rate for each labor category Offerors shall propose a Firm-Fixed Price (FFP), fully burdened monthly rate for each labor category
Part 1: Since no labor Category for the Program Manager, Deputy, Business, Manager, or floaters are included in D-13 or 14 Is it appropriate to conclude the fu burdened rate should include these costs if proposed?
Part 2: If the conclusion stated above in “Part 1” is true and the sample task is merely for evaluation and does not necessarily reflect the actual Task Orders (staffing levels) to be issued, it appears to require consequential speculation on the part of the offeror as to how to distribute those costs because the FBLR (Fully Burdened Labor Rate) staffing level allocation base is unknown
For example, the sample task for AFRC is 53 FTE but we know the current non-mgt staff is less If the management cost is distributed across 53 FTE as shown in the sample task but the resulting TO is 47 (for example) the proposed FBLR fails to allocate the true contract cost because the allocation base is reduced Additionally, it is unknown if the NASA NCS contract may further reduce the actual FBLR allocation base (PWS 4 4) by as much as 20% and further invalidate the offeror FBLR calculus Our rough estimates show this could result in the offeror being unable to capture $50,000 to $200,000 or more of costs annually depending upon the actual FBLR staffing levels procured under CATSS III CATSS III is a highly desirable contract and likely to be very cost sensitive and this situation creates a significant risk to the offeror (and NASA) and will likely result in a financial loss to the offeror and produce an operational risk to NASA and operational loss to the awardee Will NASA consider adding language/clarification to the Solicitation to mitigate this mutual proposal risk?
All priced labor categories shall include Program Management Office (PMO) costs, such as Program Manager, Deputy Program Manager, Manager or floaters, regardless of the actual distribution of labor categories The firm fixed price of the labor category included in the offeror's proposal will become the contractual firm-fixed price and no adjustments to the price will be made for PMO costs post-award It is the responsibility of the offeror to propose a firm-fixed price for each labor category to minimize risks of financial loss to their company should changes in staffing occur during contract performance
7 D1
8 0 Overtime Overtime hours are normally required to respond to emergencies, unusually heavy workloads, and unexpected situations that may occur due to unforeseen service requirements If circumstances indicate the potential need for overtime in order to accomplish a task, such overtime must be authorized in advance by the Contracting Officer or his/her authorized representative Overtime will not be authorized to compensate for shortcomings in Contractor performance NASA-directed overtime will be covered by the Cost No Fee line item(s) of the contract
15 Since the only pricing data is the Fully Burdened Labor Rate (FBLR), will the FBLRs be used for authorized overtime? As CA law requires 1 5 and 2x pay for OT, will these actual costs be added to the FBLR as a multiplier? What calculus is used to calculate OT? The successful offeror will be required post-award to provide firm-fixed price overtime labor rates for non-exempt employees
8 D1 APPENDIX B - Labor Categories and Minimum Qualifications 22
Most of the positions on CATSS have historically been non-exempt (AFRC is non-exempt where ARC is more commonly exempt for the same work) Companies do not have the latitude to legally classify a position both ways within a single contract and must be consistent if compliant with the FLSA To complicate the iss the DoL Directory of Occupations 5th Edition does not include/consider years of experience or education as a criterion It simply states the work to be performed and the WD provided in the solicitation sets the pay for the position without regard to experience or education By establishing these criteria, under the combined locations, a significant risk is introduced because it is not likely the offeror will be able to successfully recruit and retain individuals with 4-7 years of experience and a degree across both locations when using WD wage rates in a FFP contract vehicle (especially at ARC) CATSS III positions do not generally meet the DoL tests for Administrative or Professional exceptions to be classified by the offeror as exempt Fortunately, the government does have latitude to define positions as exempt Will the government consider designating positions requiring degrees and/or 4 years or greater experience as Exempt within the solicitation to reduce th s risk?
Follow up Question: Will the government consider requiring and evaluating the offerors proposed wage rates and wage rate analysis as a part of price proposal r assessment to identify recruiting and operational risks to NASA?
DoL Exempt Guidelines: https://www dol gov/agencies/whd/fact-sheets/17a-overtime
Offerors should propose to the requirements of the solicitation, regardless of how AFRC or ARC have historically classified the contractor employees Offerors should do sufficient research to propose pricing that will capture incumbents and/or qualified individuals to enable successful performance of the requirement at both centers
The government will evaluate the IDIQ pricing model total price in terms of reasonableness
9 D1 APPENDIX B - Labor Categories and Minimum Qualifications 22 The solicitation education requirement may result in some high performing incumbent employees not qualifying for their current position Will four years of equivalent experience (for all positions) satisfy the requirement for a BS/BA degree?
Experience in lieu of education is annotated in the Performance Work Statement (PWS) when allowable Technical stakeholders have confirmed those labor categories requiring a bachelor's degree or higher are a requirement to successfully perform the tasks in the respective subject area
