This document is a comprehensive set of Supplemental Specifications prepared by Sussex County Division of Engineering for the replacement of Sussex County Bridge X-03 (also known as Bridge No. 184) crossing Papakating Creek Tributary on County Route 565 in Wantage Township, Sussex County, New Jersey. The project scope includes demolition and removal of the existing 70-linear-foot, 103" x 71" corrugated metal plate arch culvert; construction of a new 71-linear-foot corrugated metal pipe arch (polymer coated) with reinforced cast-in-place concrete walls and moment slabs on spread footings; installation of select backfill material; full-depth bituminous pavement replacement and mill-and-pave operations across approximately 1,100 linear feet; installation of MASH-compliant guide rail with end treatments and crash cushion compressive barriers. The specifications reference the 2019 NJDOT Standard Specifications for Road and Bridge Construction, as amended. The contractor must submit Performance and Payment Bonds within 14 calendar days of contract award, Certificates of Insurance within 10 calendar days, and a Critical Path Method progress schedule for approval prior to commencement of work. A preconstruction meeting is required, and Notice to Proceed must be issued before construction operations begin. The contract work is scheduled for a 21-consecutive-day closure period commencing August 10, 2026, with substantial completion required by August 30, 2026.
The specifications establish a working day framework (excluding weekends, holidays, and the November 15 through April 15 seasonal shutdown period) and impose liquidated damages of $14,500 per day for failure to achieve substantial completion by August 30, 2026, with an offsetting incentive payment of $5,000 per day (maximum $30,000) for early completion. The contractor must employ a Professional Herpetologist from the US Fish & Wildlife Service's "Recognized Qualified Bog Turtle Surveyors" list to comply with Freshwater Wetlands Protection Act General Permit GP10A and Flood Hazard Area General Permit-by-Certification requirements, including timing restrictions for bog turtle and wood turtle habitat protection. Environmental and permit compliance costs, including Professional Herpetologist services, are reimbursable on a dollar basis with no contractor markup. Prevailing wage requirements per N.J.S.A. 34:11-56.25 apply, and all materials must comply with Buy America requirements under the Infrastructure Investment and Jobs Act. The project includes detailed requirements for traffic control coordination, soil erosion and sediment control, maintenance and protection of stream flow, field office establishment and maintenance, and final cleanup. State wage rates are available through the New Jersey Department of Labor & Workforce Development.

101.01 INTRODUCTION
THE FOLLOWING IS ADDED:
The 2019 Standard Specifications for Road and Bridge Construction, of the New Jersey Department of Transportation (Department) as amended these Supplemental Specifications will govern the construction of this Project and the execution of the Contract.
Whenever any section, subsection, subpart or subheading is amended by such terms as changed to, deleted or added it is construed to mean that it amends that section, subsection, subpart or subheading of the 2019 Standard Specifications unless otherwise noted.
These Supplemental Specifications consist of the following: Pages SS-1 to SS-60 inclusive.
State wage rates may be obtained from the New Jersey Department of Labor & Workforce Development (Telephone: 609-292-2259) or by accessing the Department of Labor & Workforce Development’s website at https://www.nj.gov/labor/wagehour/wagerate/prevailing_wage_determinations.html. The State wage rates in effect at the time of award are part of this Contract, pursuant to Chapter 150, Laws of 1963 (N.J.S.A. 34:11-56.25 et seq.).
In the event it is found that any employee of the contractor or any subcontractor covered by the contract, has been paid a rate of wages less than the minimum wage required to be paid by the contract, the contracting agency may terminate the contractor's or subcontractor's right to proceed with the work, or such part of the work, as to which there has been a failure to pay required wages and to prosecute the work to completion or otherwise. The contractor and his sureties shall be liable to the contracting agency for any excess costs occasioned thereby.
Payment for a pay item in the proposal includes all the compensation that will be made for the work of that item as described in the contract documents unless the "measurement and payment" clause provides that certain work essential to that item will be paid for under another pay item.
Whenever any section, subsection, subpart or subheading is amended by such terms as changed to, deleted or added it is construed to mean that it amends that section, subsection, subpart or subheading of the 2019 Standard Specifications unless otherwise noted.
Henceforth in this supplementary specification whenever reference to the State, Department, ME, RE or Inspector is made, it is construed to mean the particular municipality or county executing this contract.

104.03.01 Authority to Make Changes
THE FIRST PARAGRAPH IS CHANGED TO:
The Department has the right to make changes to the Work at any time, including altering the Contract, altering the requirements of an Item, increasing, or decreasing the quantities of any Item, or deleting any Item. Such changes neither invalidate the Contract, nor release the Surety. The Contractor agrees to perform the Work as changed. If the Contractor does not perform, or refuses to perform the Work as changed, the Department may perform the work with its own forces. If the Department mobilizes its forces to perform the work, the Contractor agrees to pay the Department’s cost of performing the work including the cost of material and labor used and the actual costs for police traffic protection and maintenance and protection of traffic as specified in 107.16.
104.03.02 Protests to Change Orders
THE SUBPART IS CHANGED TO:
If the Contractor disagrees with any terms or conditions set forth in a Change Order, submit a written protest to the Department within 30 days after the date of receipt of the Change Order.
A protest is notice that the terms and conditions for proposed work are not in accordance with the Contract, quantity adjustments are incorrect, or that the modification for Contract Time is incorrect. A protest is not a substitute for notice as specified in
104.03.04. Providing a protest within 30 days after the date of the receipt of a Change Order may not meet the requirements of 104.03.04 or N.J.S.A 59:13-5 and the Department will not make payment for the costs of a claim if recovery is barred by other provisions in the Contract.
Replacement of Sussex County Bridge X-03 SS-11 of SS-62 2019 NJDOT Standard Specifications
In the protest, list the points of disagreement, and, if possible, the specification references, quantities, and costs involved.
Ensure that the protest is a specific, detailed statement of the points of disagreement. The Department will reject general protests. If the Department rejects a protest for being a general protest, provide a specific, detailed statement within 7 days of such rejection.
Regardless of whether the Contractor’s assent is required, if the Contractor refuses to sign the change order or submit an acceptable written protest within 30 days after the date of receipt of the Change Order or within 7 days of the initial rejection of a protest, the Department will make payment and modify Contract Time as set forth in the Change Order. Such payment is full payment for all work included or required by the Change Order and is conclusive as to any Contract Time modifications provided for therein or in establishing that no Contract Time modification was warranted.
When the Contractor signs a change order and the Department processes the Change Order within 15 days of receiving the Contractor’s signature, the Contractor is barred from protesting the Change Order.
Protest does not relieve the Contractor from the obligation to proceed with work directed by an approved Change Order.
104.03.03 Types of Changes
1. Quantity Increases and Decreases.
THE SECOND PARAGRAPH IS CHANGED TO:
For minor changes in quantity, the Department will make payment for the quantity of the Item performed at the bid price for the Item. Construction layout is included in the price of the original work.
3. Changes in the Character of Work.
THE THIRD PARAGRAPH IS CHANGED TO:
If a modification cannot be reached by agreement, the Department will make payment, only for the change in work, by force account as specified in 104.03.08.
SECTION 105 - CONTROL OF WORK
105.01 AUTHORITY OF THE DEPARTMENT
105.01.02 Inspection
THE FOLLOWING IS ADDED:
A Department authorized inspector will be available to provide inspection of work during normal working hours of 7:00 a.m.
to 3:30 p.m. excluding Sussex County holidays, Saturdays and Sundays. The Contractor may work outside of these hours on weekdays and on holidays, Saturdays and Sundays or at any times not restricted by local municipal ordinance without the presence of an inspector, but such work performed cannot include operations that require the presence of an authorized inspector provided by the County.
The RE will have the sole discretion to determine what work will require the presence of an inspector. The RE will have the sole discretion to determine if an inspector can be provided on weekends and/or holidays for work requiring an inspector that is critical to timely completion of a quality project. The Contractor shall request this relief at least 48 hours prior to the perceived need.
Any work completed without the presence of an authorized inspector will remain subject to inspection and acceptance or rejection upon the inspector’s return.
The presence of a Department authorized inspector during subcontractor work does NOT relieve the Contractor from their responsibility to maintain direct supervision of their subcontractors.
