About this file

This is a Minority/Women Business Enterprise (M/WBE) Trucking Procedure Compliance document issued by the Harris County Department of Economic Equity and Opportunity (DEEO) that establishes guidelines for determining whether M/WBE trucking companies meet Commercially Useful Function (CUF) requirements to receive M/WBE credit on Harris County contracts, specifically the Intersection Improvement project at Prairie Drive and Windfern Road for Harris County Precinct 1. The document outlines the operational and ownership standards that M/WBE trucking firms must satisfy, including the requirement to perform at least 30 percent of subcontract work with their own forces and manage the entire trucking operation for a specific contract. M/WBE firms must own and operate at least one truck with a dedicated employee driver and cannot utilize independent contractors to qualify for credit. The document specifies that exclusive use and control lease agreements must clearly indicate priority access and display the M/WBE's name and identification number on leased vehicles.

The compliance framework addresses multiple scenarios for truck ownership and leasing arrangements, detailing how credit toward M/WBE participation goals is calculated under each configuration. When an M/WBE firm subcontracts to another M/WBE truck owner-operator or leases additional trucks from non-M/WBE firms while using its own employees as drivers, 100 percent of expenditures paid to the M/WBE firm count toward participation goals. However, when leased trucks from non-M/WBE firms exceed the number of trucks owned and operated by the M/WBE, only fees and commissions apply toward the participation goal. Vendors must submit required documentation including W-9 forms, current insurance documents, proof of truck ownership or registration verified through TxDOT, and completed M/WBE certification copies. A courtesy utilization plan review process is available with a deadline of five business days prior to solicitation closure, and the DEEO contact is the Harris County Department of Economic Equity and Opportunity at (713) 274-1400 or DEEO@eeo.hctx.net.
