About this file

This is a Final Waiver and Release of Lien form prescribed by Florida Statute Section 713.20 for use by the Marion County Board of County Commissioners in connection with the road resurfacing project on NE 35th Street and NE 60th Court from NE 36th Avenue to SR40. The form serves as a statutory document through which lienors (subcontractors, suppliers, or laborers) formally waive and release their lien rights upon receipt of final payment from the project owner. The form requires completion of the final payment amount, project identification information, lienor details including name and address, notarization by a Florida notary public, and the notary's commission expiration date.

The form includes a notable provision allowing lienors to condition the waiver and release of lien upon clearance of the payment check, providing protection to parties furnishing labor, services, or materials by rendering the release null and void if collected funds are not received following check deposit. This statutory form has been mandatory for use in Florida since October 1, 1996, and prohibits parties from requiring lienors to furnish alternative waiver or release of lien documents. The document functions as a critical component of the project closeout process, establishing a clear record that all lien rights have been extinguished upon final payment and notarization.
