About this file

This is a Buy America Certification form for the Federal Transit Administration (FTA) related to Broward County Transportation Department's Paint and Body Repair contract for the BCT Bus Fleet in Florida. The certification document is mandated for all bids and offers on FTA-funded contracts involving the acquisition of steel, iron, or manufactured products, unless the FTA has granted a waiver or the product is subject to a general waiver. Bidders must submit a completed certification alongside their bid or offer, certifying either compliance with or non-compliance with Buy America requirements under 49 USC 5323(j)(1) and 49 CFR part 661. Bids or offers submitted without an accompanying completed Buy America Certification will be rejected as nonresponsive. The certification form requires the bidder's or offeror's authorized signature, printed name, title, company name, and date.

The Buy America requirements mandate that products used in FTA-funded procurements must be domestically produced and assembled. Bidders unable to comply may qualify for an exception to the requirements pursuant to 49 USC 5323(j)(2) and 49 CFR 661.7, which outlines general waivers. Broward County requires vendors to hold a Broward County Motor Vehicle Body Repair and Painting License and, if applicable, a Broward County Towing License. All submissions must be made electronically through BPRO, and vendors are instructed to consult the FTA's Buy America regulations website at https://www.transit.dot.gov/buyamerica for additional information. This certification is not applicable to rolling stock acquisitions.
