About this file
This is a Construction Manager at Risk (CMaR) agreement form between the City of Columbus, Ohio Department of Finance and Management and a selected vendor for services related to the Columbus Police Substation #6 (Easton) project. The City is soliciting CMaR proposals with a deadline of 1:00 PM EST on February 17, 2026. The selected CMaR will collaborate with the City and the Architect-of-Record to develop construction documents and provide Guaranteed Maximum Price (GMP) amendments following design completion and competitive bidding. The project anticipates one or more bid scopes or partial GMP amendments, with particular focus on early procurement of long-lead time materials and products. Construction documents are expected to be issued in their entirety, and the project will be subject to a Community Benefits Agreement (CBA) that the CMaR must follow. The total project will already be designed and permitted prior to the CMaR contract execution.
The agreement establishes a two-stage compensation structure: preconstruction stage compensation (including preconstruction fees, personnel costs, reimbursable expenses, and contingency) and construction stage compensation through GMP amendments. The CMAR's preconstruction and construction stage personnel costs are subject to not-to-exceed caps, with rates detailed in Exhibit A and limited to 3 percent annual increases after one year. General Conditions Costs and contingency are capped at specified percentages, and the CMAR's fee is limited to 1.75 percent of the Cost of the Work plus contingency. The contract operates on an open-book basis with Owner access to audit CMAR records. Performance and Payment Bonds equal to 100 percent of total compensation are required. The contract includes mandatory compliance with the City's MBE/WBE Program and Community Benefits Agreement, wage theft prevention requirements under Columbus City Code Chapter 377, and various insurance requirements including bodily injury liability, property damage, and professional liability coverage.

If the CMAR submits proposed pricing for the GMP Amendment that attempts to modify or alter or exceed the caps for the CMAR’s Fee, General Conditions, or Contingency submitted with its original proposal submitted in response to the Owner’s RFP shall be a material breach of this Agreement by the CMAR.
