About this file
This is a Compliance Standards and Remedies document for Polygraph Examination Services under a contract with the Texas Department of Criminal Justice–Parole Division (TDCJ-PD) for Sex Offender Clinical Polygraph Examination Services. The document establishes performance standards and payment adjustment mechanisms for contractors providing polygraph examination services. Key service requirements include maintaining current American Polygraph Association licensing, completing examinations only after subsidy approval, conducting services exclusively at TDCJ-PD Director-approved locations, and submitting quarterly performance measures worksheets by specified deadlines (December 30, March 30, June 30, and September 30). Contractors must deliver full written examination reports to assigned Parole Officers within 15 days of examination completion and submit examination reports to the Fiscal Operations Department by the 1st or 15th of the following month, depending on the examination date.
The document outlines specific payment remedies for non-compliance with established standards. Contractors who fail to maintain proper licensing, complete examinations prior to subsidy approval, or conduct services at non-approved locations will have invoices withheld entirely. Late submission of quarterly performance measures worksheets results in complete payment withholding until documentation is provided. Late delivery of examination reports to Parole Officers incurs a $25.00 daily penalty with a maximum reduction of $200.00, as does late submission to the Fiscal Operations Department. The TDCJ-Parole Division Fiscal Operations Section Director retains authority to withhold or temporarily suspend payments and must notify contractors of such decisions by letter. Contractors may submit documentation justifying reporting delays to avoid payment reductions.
