About this file

This is a Byrd Anti-Lobbying Certification form required for federal contract participation in North Carolina's CATS Blue Line Track Welding Services contract opportunity. The certification document establishes the undersigned company's commitment to comply with federal anti-lobbying restrictions and requirements. The form mandates that no federal appropriated funds will be used to influence federal agency officials, Members of Congress, or congressional staff in connection with the awarding of this federal contract or related modifications. The certification must be executed by an authorized company representative and includes the company's printed name, authorized signature, address, and date of execution.

The certification serves as a material representation of fact and a prerequisite for contract participation under 31 U.S.C. § 1352. Companies must agree that provisions of 31 U.S.C. § 3801 et seq. apply to the certification and disclosure. The form requires that identical certification language be included in all subaward documents at all tiers, including subcontracts and subgrants, with all subrecipients certifying and disclosing accordingly. Failure to submit the required certification subjects the company to civil penalties ranging from $10,000 to $100,000 for each failure. If non-federal funds are used for lobbying contacts, the company must complete and submit Standard Form-LLL in accordance with government-wide guidance for new restrictions on lobbying.
