This is a Design-Build Project Solicitation issued by the Incorporated County of Los Alamos, New Mexico, for the development of a Bike Park and associated amenities on County-owned property along North Mesa Park Road. The solicitation will be conducted in two phases: Phase 1 is a Request for Qualifications (RFQ) open to all qualified firms, and Phase 2 is a Request for Proposals (RFP) limited to short-listed respondents. The County seeks design-build teams comprising a New Mexico-licensed engineer or architect and a New Mexico-licensed contractor, with preference for architects with specialized expertise in landscape design. The project must incorporate inclusive and adaptive-friendly features supporting riders of varied ages, abilities, and skill levels, with compliance to ADA Standards for Accessible Design. The Phase 1 RFQ closing date is October 27, 2026, at 2:00 p.m. Mountain Time, with a pre-response conference scheduled for October 6, 2026. Phase 2 RFP invitations will be issued November 18, 2026, with proposals due December 17, 2026. County Council approval is required for contracts exceeding $300,000, with estimated contract award on February 17, 2027.
The solicitation prohibits cost-plus-a-percentage-of-cost contracts and requires separate submission of design and construction costs in Phase 2. Phase 2 proposers must submit Proposal Security (Bid Bond) equal to 5 percent of the proposal amount and proof of registration with the New Mexico Department of Workforce Solutions. Design payment shall follow a schedule of 30 percent for Schematic Design, 15 percent for Design Development, 35 percent for Construction Drawings, and 20 percent for Construction Administration. Construction costs must include all materials, labor, equipment, permits, and compliance with NPDES Construction General Permit requirements for sites exceeding one acre of disturbance. The project may be funded wholly or partially through grant programs administered by state or federal agencies, with the County currently maintaining the right to fund entirely through its approved local budget. Offerors must acknowledge bonding capacity for proposal security, payment, and performance bonds and comply with New Mexico Public Works Minimum Wage Act and Subcontractors Fair Practice Act requirements. 3. GRANT RELATED INFORMATION
This project may be funded in whole or in part by, or eligible for subsequent reimbursement through, grant programs administered by various New Mexico state and/or federal agencies. As of the date of issuance of this solicitation, final grant determinations may be pending, and the County reserves the right to fund this project entirely through its approved local budget. By submitting a Submission to this solicitation, Offerors understand and agree that if grant funds are secured, the County may require the selected Offeror to comply with specific state or federal funding provisions (including, but not limited to, certified payroll reporting, specialized subcontractor disclosures, or domestic material certifications).
Offerors agree to reasonably cooperate with the County and promptly provide any additional information, documentation, or certifications required to satisfy grant compliance. The selected Offeror shall incorporate this cooperation and compliance mandate into all applicable subcontracts associated with this project.
4. QUESTIONS, ADDENDA, AND METHODS/EXPECTATIONS FOR COMMUNICATION
4.1. Any questions must be received in writing as shown in Solicitation Information and Estimated Schedule above, unless otherwise stated herein or in an addendum. Questions must be submitted through the County’s Procurement Portal. 4.2. Offerors must submit in writing through the County’s Procurement Portal, as stated herein, any questions or requested clarification necessary for Offeror to provide complete Submissions with all Submission components and pricing included. Offerors are asked to refrain from including in Submissions statements such as “more information available upon request,” “pricing to be determined,” or other similar statements. Such statements and failure of Offeror to seek clarification needed for Offeror to provide the requested information may result in an Offeror being found non-responsive or non-responsible. This in no way may be construed to conflict with County’s right to hold interviews and discussions for clarification with Offerors, as further described herein.
4.3. The County relies on its Procurement Portal messaging system for solicitation-related communication.
Offerors are expected to use this system for correspondence with the County. Following solicitation closing, County may continue to issue important notices through the Procurement Portal, either through public notices or direct discussions with vendors, which may include, but is not limited to, requests for clarification, interviews, demonstrations, and related instructions or deadlines. It is the Offeror’s responsibility, before and after solicitation closing, to maintain accurate vendor account settings to ensure receipt of County’s messages and to include any additional account contacts who can reliably acknowledge receipt and respond to County messages in a timely manner. It is the Offeror’s responsibility to configure their own internal system settings to ensure messages from the County and the County’s Procurement Portal are safelisted. Offerors experiencing technical difficulties with the County’s Procurement Portal messaging system are expected to promptly contact the Procurement Contact listed in the solicitation for assistance. Failure to do so may result in Offerors missing important information or deadlines. County may, at its sole discretion, use email, phone, or other communication methods, but is not obligated to do so, nor to confirm receipt of Procurement Portal messages or extend deadlines.
4.4. Addenda and Requests for Interpretation. Any change(s) to the solicitation will be conveyed through the written addenda process. Read carefully and follow all instructions provided on any addendum, as well as the instructions provided in the original solicitation.
4.4.1. Offerors are expected to acknowledge receipt of addenda by submitting signed copies of addenda with the Submissions. No interpretation of the meaning of the plans, specifications or other Solicitation Documents will be made to any Offeror orally and Offerors understand that no oral interpretation once made may be relied upon. Every request for such interpretation shall be in writing and sent through the County’s Procurement Portal messaging tool, as further instructed in Section 4. Requests for interpretation must be received by the question due date deadline(s) specified above under Solicitation Information and Estimated Timeline, unless otherwise extended, at County’s sole discretion. Failure of any Offeror to acknowledge all addenda in its Submissions shall not relieve such Offeror from any obligation under its Submission, as submitted, and may render the Offeror non-responsive. Each Offeror shall ascertain prior to Submissions that the Offeror has received all addenda issued, and the Offeror shall specifically acknowledge their receipt in the Submissions. All addenda so issued shall become part of the contract documents.
4.4.2. Addenda will be issued through the County’s Procurement Portal.
4.4.3. No addenda will be issued later than four (4) calendar days prior to the date for receipt of Submissions except an addendum withdrawing the RFQ or RFP or one which includes postponement of the date for receipt of Submissions.
5. PRE-RESPONSE CONFERENCE
The County will hold an optional, non-mandatory pre-Response conference via a virtual format on the date and time noted in the Solicitation Schedule above and on the County’s Procurement Portal. DBP27-05 Design-Build for North Mesa Bike Park and Amenities Template Version: 20260915 sent to all entities that have registered for this solicitation opportunity through their County Procurement Portal Vendor Account. 16. PROPOSAL SECURITY (BID BOND)
Pursuant to Section 31-172 of County’s Procurement Code, Proposal Security (Proposal/Bid Bond) in the amount of five percent (5%) of the Proposal for the costs associated with the construction of the project must accompany the Proposal during Phase 2 of this solicitation. Proposal security shall be a bond provided by a surety company authorized to do business in the state, or the equivalent in cash, or otherwise supplied in a form satisfactory to the County. Noncompliance with this requirement at Phase 2 of this solicitation requires that the Proposal be rejected. Proposal Security will be returned promptly after the County and the accepted Offeror have executed the contract, or if no award has been made within ninety (90) days after the date of the opening of Proposals, upon demand of the Offeror at any time thereafter, so long as Offeror has not been notified of the acceptance of Offeror’s Proposal. In submitting their Proposal Security, it is not mandatory that Offerors use the Proposal Bond form provided on the County’s Procurement Portal. The County strongly encourages all Offerors to use this form, but if the Offeror elects not to use it, the Proposal Bond must be submitted on a form acceptable in the construction industry and approved by the County Project Manager in advance of the Proposal due date.
17. LIQUIDATED DAMAGES FOR FAILURE TO ENTER INTO CONTRACT
The successful Offeror, upon failure or refusal to execute and deliver a signed contract and required Performance and Payment Bonds within ten (10) calendar days after Offeror has received the Notice of Award, shall forfeit Offeror’s Proposal Security to the County, as liquidated damages for such failure or refusal. See also Section D of the Sample Services Agreement provided on the County’s Procurement Portal.
18. POWER OF ATTORNEY
DBP27-05 Design-Build for North Mesa Bike Park and Amenities Template Version: 20260915
Attorneys-in-Fact who sign any required bonds must file with each bond a certified properly executed and dated copy of their power of attorney.
19. OBLIGATION OF OFFEROR FOR PROPOSAL
Complete sets of Solicitation Documents must be used in preparing Proposals; neither the County nor Engineer (as defined in the Construction Contract Book, Definitions, Section 5.2.1) assumes any responsibility for errors or misinterpretations resulting from the use of incomplete sets of Solicitation Documents.
The Submission of a Proposal will constitute an incontrovertible representation by Offeror that Offeror has complied with every requirement of the RFP and that, without exception, the Proposal is premised upon performing and furnishing the Services and Work required by the Solicitation Documents. The Offeror will be required to establish to the satisfaction of the County the qualifications and capability of the persons proposed to furnish and perform the Services and Work described in the Solicitation documents. Offeror, by signing the Verification of Authorized Offeror and submitting a Proposal also acknowledges that the Contract Time is reasonable for the weather and climactic conditions.
Prior to the award of the contract, the County will notify the Offeror in writing if the County after due investigation has reasonable objection to a proposed person or entity who Offeror intends to perform the Services and Work. Upon receiving such objection, the Offeror may, at the Offeror’s option, (1) withdraw the Proposal, or (2) submit a substitute person or entity acceptable to the County with an adjustment in the Proposal cost to cover the difference in cost, if any, occasioned by such substitution.
The County may accept the adjusted Proposal price. In the case that the adjusted price makes them no longer the selected Offeror, County reserves the right to award the contract to another Offeror as determined by County to be the most advantageous to the County, taking into consideration the evaluation factors set forth in the Solicitation Documents. In the event of withdrawal as described herein, Proposal bond will not be forfeited. Persons, including but not limited to, the Project Manager, Superintendent, and any Subcontractors proposed by the selected Offeror and to whom the County has made no reasonable objection must be used by the selected Offeror to perform the Work for which they were proposed and shall not be changed except with the prior written consent of the County.
20. PROPOSALS TO REMAIN SUBJECT TO ACCEPTANCE
