About this file
This document is Amendment 2 to Solicitation 75H71526R00006, issued by the Nashville Area Office on July 13, 2026, containing final questions and answers for a construction project located in Mashpee, Massachusetts.
The solicitation calls for the furnishing and installation of seven new HVAC units: two in the Dental building, three in the Admin building (including server room), and two in the Clinic building. The Basis of Design specifies a Trane model 4DCY4048B1096AA, with offerors permitted to propose equal alternative units meeting specified cooling and heating loads defined in Section B(a). The contract requires performance and payment bonds and is subject to Davis-Bacon wage requirements with a construction wage determination covering Barnstable County, Massachusetts. The project is located on tribal trust land held by the government, eliminating permitting requirements and tribal TERO-related fees. Work must be completed within 180 days from the date of award, with construction hours limited to Monday through Friday, 8:00 a.m. to 4:30 p.m., excluding federal holidays and weekends. Site visits were scheduled for August 3 and August 6, 2026, between 9:00 a.m. and 11:59 a.m. and 2:00 p.m. and 3:30 p.m. ET; attendance is evaluated as a proposal factor but does not disqualify non-attendees. Offerors must submit technical documentation including manufacturer specifications, AHRI certification, warranty information, electrical requirements, and installation instructions with their initial proposals. Pricing must be submitted on the SF-1449, though offerors may include itemized schedules. The project is tax-exempt and requires compliance with FAR 52.223-23 and HHSAR 352.223-71 regarding sustainability and energy efficiency standards. Buy American Act requirements per FAR 52.225-9 apply, with a 65 percent domestic content requirement for items delivered in calendar years 2024 through 2028.

↓ FINAL ROUND OF QUESTION AND ANSWER ↓
Question Is a bid guarantee required?
Answer A performance and payment bond are required.
Question Per Statement of Work, Facility and Security Requirements, Item IV, “Contractors are required to visit the site and be escorted by a government representative to confirm locations, dimensions, and conditions of the project before a bid is submitted.” Please confirm if contractors who did not attend the site visit will be disqualified from bidding.
Answer Site visit attendance is a portion of the proposal factor so, you are not disqualified.
Question Please confirm pricing is to be submitted on the SF1449 and the government has not provided a separate bid schedule.
Answer This is correct, a schedule was not included so you will put pricing on the SF-1449.
Offerors may also include their own schedule with itemized costs.
Question Can one person "triple hat" as Superintendent, SSHO and QC Manager?
Answer The government will allow personnel to perform multiple roles only to the extent permitted by the solicitation and applicable safety, industry and contract requirements. Any individual proposed to serve in multiple capacities must meet the qualification requirements for the positions.
Question Can the period of performance be extended after award once the material/equipment lead times are confirmed due to current market conditions for the equipment for this project?
Answer This would be a bilateral agreement after award if a contract modificaiton for extension was justified and needed.
Question Please provide the site visit attendee sign-in sheet.
Answer N/A
Question (If building is occupied) Are there any phasing requirements? How many people will be in the building? Are there any temporary heating/cooling requirements?
Answer BUILDINGS WILL NOT BE OCCUPIED, BUT WE REQUEST ONLY ONE BUILDING BE
DONE AT A TIME SO WE HAVE PLACEMENT FOR THE STAFF. Contractor is required to keep critical equipment rooms cooled (medical fridges, server rooms, perishable medical supplies) to prevent damage or loss, and shall phase installation or install equipment in a manner in coordination with clinical staff to limit overall HVAC outage, minimize disruption and reduce risk of damage due to hazards, debris, weather etc.
Question Please confirm the manufacturer of the existing roofing system and who carries the current warranty of the roofing system.
Answer Roofs were recently replaced (2026) with new membrane systems. These membrane roofs are affixed directly to sheathing, matching existing design. Manufacturer of roof system is “mule-hide fully adhered TPO system”
Question Please confirm whether asbestos or lead is present on this project, and if so, provide the relevant documentation.
Answer We are unaware of any asbestos of lead present.
Question Is this project tax exempt?
Answer Yes, refer to page 29 on the solicitation pdf.
Question When do you anticipate on site work starting?
Answer Final installation dates shall be coordinated with site staff
Question Are third party inspections required?
Answer Not at this time.
Question Is permitting required?
Answer Permitting is not required as the Government buildings are on land held in trust.
Question Are partitioning, dust containment, and/or negative air machines required for this project?
Answer Contractor shall ensure containment and appropriate safety measures to safeguard building during replacement of HVAC units.
Question Is any landscaping restoration required for this project? For example; topsoil, seeding, and fertilizer.
Answer Please read the clauses to be included. On Page 29 FAR 52.236-9 " Protection of
Existing Vegetation, Structures, Equipment, Utilities, and Improvements" was included.
From the clause: " The Contractor shall repair any damage, including those that are the property of a third party."
Question Regarding the submittal requirements for "Equal" equipment listed in Section C(e)(i), could the Government please clarify the required timing for these items?
Specifically, are the six items (Manufacturer technical data, AHRI certification, Warranty documentation, Electrical requirements, Installation instructions, and the Comparison demonstration) required to be included with the initial bid submittal for evaluation purposes, or are these intended to be provided post-award as part of the standard material submittal process?
Answer Preferably, submit these items with your proposal. If the technical requirements cannot be determined from your submission the proposal may not be evaluated.
Question The solicitation specifies the Trane model 4DCY4048B1096AA as the Basis of Design
(Section C, page 4) and also incorporates FAR 52.225-9 Buy American—Construction Materials (Section I, page 24).Could the Government please clarify if the HVAC units proposed must strictly qualify as "Domestic Construction Material" as defined in FAR 52.225-9?Specifically, if a contractor proposes the Basis of Design (Trane) or an "Equal" (such as Carrier), and those units are manufactured outside of the United States or do not meet the domestic component cost percentage, will they be accepted? If the Basis of Design unit itself is not domestically manufactured, has the Government already issued a determination that the Buy American Act restriction is inapplicable to these commercial HVAC units?
Answer The guidance for your question is in the FAR clause 52.225-9. If the offered items are within the range "the percentage will be 65 percent for items delivered in calendar years 2024 through 2028" and if not, does the item qualify under 52.225-9(b).
