CMS will be evaluating all offeror's regarding COI for both the IDIQ and any Task Order's to ensure that Conflicts of Interest do not exist at either level. COI as detailed in section H.1.c.1, are not mitigatable because they exist prior to award. H.1.c.2 are COI's that may arise post award, and are activities that MIDS contractors must not engage in if they are a MIDS IDIQ contractor.
2 MIDS Special Notice Information Session Questions & Answers No. 56 RFP document, Section L.10, p.119 In the previous Q&A, an offeror followed-up on the pre-solicitation question 56. The question referenced RFP document, Section H.1 (general) pg. 35 and asked whether COI is required at both the IDIQ level and task order level. CMS responded "Both. There are different facts under the IDIQ and task orders." Question 62 in the previous Q & A further asked: "Can CMS explain whether there are differences in COI document collection/review at the task order and IDIQ levels?" CMS responded in that Q & A with the following: "Question/Comment COI is fact dependent and will be reviewed based upon the differing requirements in the IDIQ Statement of Work (SOW) and then again for each Task Order SOW." Please confirm that the Volume III Business Ethics, Conflict of Interest and Compliance Proposal just requires one COI volume to address both the IDIQ and Sample Task Order 0001.

Can Offerors budget into their base year (and beyond as applicable) the costs of this independent audit be paid under contract? Clarificaiton Question: Is CMS expecting the offeror to submit a PMP with the sample task response? | The Draft Project Management Plan listed as Deliverable 2-1 in the Schedule of Deliverables in Attachment J.9-B states that the Draft Project Management Plan is due 5 calendar days after Task Order award; therefore, it is not required to be submitted as part of the proposal. |
However, Section L.12.C provides guidance on what to submit for "Management Plan and Corporate Capacity" for the IDIQ and Section L.13.4 provides guidance on what to submit for the "Management Plan" for Task Order 0001.
