E.1.B – PEO SVS Task Order Questions Submission Questions and Responses Template
SITE VERIFICATION SERVICES TASK ORDER - Questions and Responses –

Please use the below required format. Also, make sure to add “CMS Response” below each question.
REQUEST FOR PROPOSAL QUESTIONS (RFP)

Question: Currently both the Eastern and Western Site Visit Task Orders are designated as Task
Order 0001. Would CMS consider differentiating the Eastern and Western Site Visit Task Order numbers to eliminate confusion for everyone?
CMS Response: Because there will be a different contractor receiving the Eastern and Western
Task Order Awards, both Task Orders will be Task Order 0001.

Question: The general scope of the Site Verification Task Order requires availability of personnel nationwide (or within the prescribed regions) to take work from the contractor when ordered by CMS. Please confirm that the requirement of Section 5 is only to identify personnel subject to SCA; if applicable. If a bidder assesses that proposed employees (not aligned with
CFR 541.203(g)) are not subject to the SCA, is it compliant for that bidder to submit with no employees subject to SCA and provide justification via sealed package? This question is posed to alert CMS to the potential sizeable expense of applying the SCA to work and a workforce of this type.
CMS Response: The Offeror shall make a determination if the Service Contract Act applies to their proposed employees with justification in their business proposal as to why the Offeror’s employees are exempt, or identify the appropriate wage determination if the Offeror’s employees are not exempt.

Question: CMS has requested that bidders supply pricing at three different levels of workload for each period of performance. Bidders are likely to need a different number of staff for each of these workload levels. CMS also requires bidders to supply the FTE count and hours associated with their bids under Technical Factor 3. Would CMS please eliminate the FTE/hours requirement for Technical Factor 3 as those numbers will be different at many points in the continuum of workload and present little value if only representing one point in time under one workload scenario?
CMS Response: CMS will not eliminate this requirement.

Question: Technical Factor 3 requires bidders to include FTE on the organizational chart as it states, “Please also include location of each personnel (city, state) and the FTE that person represents”. However, the RFP now requires bidders to present pricing during a startup period, and followed by three different levels of pricing and associated staffing for each period of performance. This creates a situation where it’s unclear what staffing should be depicted on the organization chart. Would CMS please confirm bidders are not required to include FTE on the organization chart?
CMS Response: Confirmed, the FTE amount is not required in the organization chart.

Question: Subcontractor Proposal Information Checklist for each subcontractor as part of
Volume VI. Amendment 2 changed the requirement in Section L.14 to require Exhibit E.3 only from significant subcontractors for Volume I. Can CMS please clarify that offerors should submit Exhibit E.3 for only significant subcontractors on the Site Verification Services Task
Order(s) as part of Volume VI?
CMS Response: Yes, Offerors shall submit Exhibit E.3 for significant subcontractors.

Question:
The Site Inspector position would be exempt from SCA if performed by an internal W2 employee. This position’s job duties pass the Administrative Exemption tests as identified in the Department of Labor –
Wage and Hour Division Fact Sheet #17a. However, given the geographic disparity of the contract work required, 1099/contracted labor will be used. Will The Site Inspector positions be viewed as exempt from
SCA, and if not, will CMS renegotiate labor rates if the DOL adjusts the proposed wage submitted (which is the basis of our FFP) during the conformance process?
CMS Response: The Offeror shall make a determination if the Service Contract Act applies to their proposed employees with justification in their business proposal as to why the Offeror’s employees are exempt, or identify the appropriate wage determination if the Offeror’s employees are not exempt. If the DOL adjusts any wage determinations above the labor rates proposed, a modification will be permitted to adjust for those increases.
MISCELLANEOUS QUESTIONS

Question: Our understanding is that compliance with all IDIQ requirements is required for all
Task Orders; Would CMS respectfully clarify the H.12 Security Information (April 2013) requirement in relation to the SVTO?
CMS Response: The understanding is correct. Section H.11 CMS INFORMATION
SECURITY (APR 2013) is applicable for all Task Orders.
