About this file

The file is a Questions and Responses spreadsheet (Amendment 3) for FDA Solicitation 75F40125R00046 for Tobacco Retailer Inspections. The solicitation is a small business set-aside contract to conduct tobacco retailer compliance inspections across five geographic regions: Region 1 (Northeastern states), Region 2 (Midwestern states), Region 3 (Southern states), and Region 5 (Puerto Rico). The FDA intends to award multiple Indefinite Delivery/Indefinite Quantity (IDIQ) contracts with a 5-year performance period from September 30, 2025 to September 29, 2030.

Key contract requirements include conducting retail tobacco product compliance inspections, collecting and documenting evidence, supporting FDA enforcement actions, and using FDA's Tobacco Inspection Management System (TIMS). Contractors must employ commissionable inspectors who are health, food, or drug officers from the state where inspections occur. The spreadsheet addresses critical operational details such as: prohibiting credit card use for undercover purchases, mandating insurance for underage buyers, specifying evidence storage procedures, and clarifying inspection scheduling flexibility. Contractors will be paid based on certified services, with no advance payments allowed, and must use FDA-provided handheld devices for reporting.
