About this file

This document is an Organizational Conflict of Interest (OCI) Statement related to a federal contract opportunity for the Tribal Home Visiting Resource Institute for Excellence (THRIVE).

The OCI Statement outlines that contractor and subcontractor personnel may receive access to proprietary or source selection information that could create a current or potential OCI. The contractor must notify the Contracting Officer (CO) of any actual or potential OCI and submit a mitigation plan. The contractor also agrees to use and disclose any controlled unclassified information or other sensitive data only for the purpose of the contract, obtain government permission before disclosing it to third parties, and return or purge such information upon request. The contractor certifies it has no known OCI under this contract and will notify the CO of any concerns.

The related federal contract opportunity is Solicitation 75ACF124R00010 for the Tribal Home Visiting Resources Institute for Excellence (THRIVE), a technical assistance services contract administered by the Department of Health and Human Services Administration for Children and Families to provide support for the Tribal Maternal, Infant, and Early Childhood Home Visiting (Tribal MIECHV) Program.

Tribal Home Visiting Resource Institute for Excellence (THRIVE)

Organizational Conflict of Interest Statement

Organizational Conflict of Interest: Contractor and Subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in Federal Acquisition Regulation (FAR) Subpart 9.5. The Contractor shall notify the CO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the CO to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the CO and in the event the CO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the CO may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

Nondisclosure Agreements: In performance of this contract, the Contractor may have access to controlled unclassified information (CUI) and other sensitive, non-public information. The Contractor agrees (a) all ACF Information systems are required to obtain authorization from the ACF Authorizing Official. This includes projects that store, process, and distribute Personally Identifiable Information (PII), Personal Health Information (PHI), or other sensitive information such as CUI (controlled unclassified information); (b) to use and disclose such information only for the purpose of performing this contract and to not use or disclose such information for any personal or commercial purpose; (c) to obtain permission of the Government Program Manager before disclosing/discussing such information with a third party; (d) to return and/or electronically purge, upon Government request, any non-public, sensitive information no longer required for Contractor performance; and (e) to advise the Government Program Manager of any unauthorized release of such information. The Contractor shall have its employees assigned to this contract execute a non-disclosure agreement for delivery to the Government.

The Government will require Contractor personnel to sign a non-disclosure statement to protect non- public information in the possession of the Government.

We have no actual or potential organizational conflicts of interest(s) under this contract that we are aware of. Should any organizational conflicts of interest(s) concerns arise, we will immediately notify the Contracting Officer in writing, and submit a plan to avoid or mitigate any conflicts of interest(s), upon request of the Contracting Officer.
