About this file

This is Amendment 0003 to an Invitation for Bid (IFB) for major maintenance and renovation (M&R) of Montauk Springs Housing at USCG Sector Long Island Sound in East Hampton, New York. The amendment provides responses to 67 Request for Information (RFI) questions and includes a revised Standard Form 1442 (SF-1442) pricing page.

The project scope encompasses complete renovation and septic system replacement at seventeen (17) residential properties: fifteen (15) properties in the Base Bid, with two (2) optional bid items. Work includes interior and exterior renovations, HVAC system upgrades with heat pump installations, electrical panel upgrades to support new loads, plumbing system updates, roof replacement, kitchen and bathroom renovations with solid surface countertops, and complete removal and replacement of existing septic systems. The project is divided into Phase I (nine vacant properties) and Phase II (eight currently occupied properties), with a firm 730-calendar-day period of performance beginning at Notice to Proceed (NTP). The Contractor is responsible for coordinating relocation of occupants from Phase II units, with no construction permitted in occupied housing units. Construction hours are restricted to Monday through Saturday, 7:00 AM to 8:00 PM, with no heavy construction on Sundays and federal holidays. The bid deadline is July 9, 2026 at 2:00 PM EST (extended from June 30, 2026 by Amendment 0002), with a mandatory 20% bid guarantee required. Performance and payment bonds of 100% of the award amount must be submitted within ten (10) calendar days after award. The Government anticipates award in fourth quarter fiscal year 2026 (by September 30, 2026). Bids must remain valid for a minimum of sixty (60) calendar days. The project is eligible for and actively participating in Suffolk County and Town of East Hampton septic grant programs, with the Contractor responsible for preparing and submitting all grant reimbursement documentation. All costs must be included in the base bid without deduction for anticipated grant funding; grant reimbursements will be credited back to the Government via deductive modification. Davis-Bacon wage requirements apply, with the applicable wage determination being NY20260012 (Suffolk County). The contract is firm-fixed-price with no material price escalation clauses; all local market factors, travel costs, and labor premiums must be factored into the bid. Progress payments will be made within 30 calendar days of receipt of proper invoices via the Invoice Processing Platform (IPP); payment is limited to materials delivered to construction sites, not materials stored off-site. The Contracting Officer is Simon W. Leung, USCG Civil Engineering Unit Providence, located at 475 Kilvert Street, Suite 100, Warwick, RI 02886. The project number/PSN is 12675124, with solicitation number 70Z0G126BSLIS0SL1.

RFI # RFI Question Official Response

The spec states the Suffolk County DOH Septic System Permit has already been obtained by the Government. Will copies of the issued DOH permits(s) for all 17 properties be provided to the awardee, and are any of those permits property-specific or design-conditioned (i.e. could they require modification based on the awardee's proposed system)?

Action (CLARIFICATION):

The Government-obtained Suffolk County Department of Health (DOH) Septic System Permits provided in the solicitation are property-specific and design-conditioned. The Contractor shall install all septic systems in strict conformance with the specific, approved site plan and design issued for each individual property. Any modification or deviation from the approved permitted design is strictly prohibited unless a revised plan is submitted and formally approved prior to construction.

Reference Document: "12.a Attachment No. 3 - Septic Approvals (Permits) for PSN P12675124.pdf" (included in the original solicitation package).

The spec states the Contractor must obtain the Town of East Hampton Building Permit and the Town of East Hampton Limited Septic Registry prior to commencing work. (1) Are these obtained once for the project or per individual property/address? (2) Please confirm the expected Town review/issuance timeline so it can be reflected in the schedule, and whether the 730-day performance period begins before or after these permits are issued.

Action (MODIFICATION):

DELETE any and all requirements in the specifications instructing the Contractor to obtain Town of East Hampton building permits, plumbing permits, electrical permits, or local Certificates of Occupancy.

ADD the following text:

"As a federal entity operating on federal property, the Government is not subject to local municipal building codes, building permits, or certificates of occupancy. A Town of East Hampton Building Permit is not required for this project. The Contractor is solely responsible for obtaining necessary environmental or utility-related registrations/permits, specifically the Town of East Hampton Limited Septic Registry for each individual property.

The 730-day performance period begins at the Notice to Proceed (NTP) and includes all time required to secure these environmental/septic registrations."

Reference Specification: Section 01 11 00 (Summary of Work) and Section 01 14 00 (Work Restrictions).

Beyond the Town Building Permit and Limited Septic Reegistry, what other Contractor-obtained permits does the Government anticipate (e.g.

electrical, plumbing, mechanical/HVAC, demolition, road-opening/right-of-way, NYSDOT or Town highway work, dewatering, or tree-removal permits)?

A complete list would let all bidders price permit fees and lead time uniformly.

Action (CLARIFICATION):

As a federal project, local municipal building and trade permits (electrical, plumbing, mechanical, demolition) are not required. The Contractor is only responsible for applicable environmental permits, utility connection permits, and any state or local right-of-way/road-opening permits required for work extending beyond the federal property boundaries.

FAR 52.236-7 makes the Contractor responsible for all necessary licenses and permits "without additional expense to the Government." Please confirm whether permit application fee (Town, County, State, utility) are to be carried in the bid price, or whether any fees are reimbursable / waived for federal project on federal property.

Action (CLARIFICATION):

Because local building permits are not required, no fees for those permits will be incurred. However, per FAR 52.236- 7 (Permits and Responsibilities), any application fees for legitimately required permits (such as the Limited Septic Registry, utility tie-ins, or right-of-way permits) must be carried in the Contractor's base bid price and are not reimbursable by the Government.

Reference: RFI #8 Response; FAR Clause 52.236-7.

Section 1.6.1 requires digging permits and utility locating a minimum of 72 hours before excavation. Is the digging permit a separate Town/installation permit. or is it satisfied by the standard utility-locate (e.g., Dig Safely New York / 811) process?

Action (CLARIFICATION):

No Town of East Hampton or separate municipal "digging permit" is required. The specification's reference to a digging permit is satisfied entirely by completing the standard utility-locate process (811 / Dig Safely New York), which is a mandatory safety requirement prior to any excavation.

Reference: RFI #4 Response; Specification Section 01 11 00 (Summary of Work).

The hazardous-substance clause requires licenses/permits for hazardous removal/disposal obtained "within * days after date of award," with the blank deferred to "timelines established in the contract specifications." Please state the specific number of days after award by which these permits must be in place, and confirm which spec section establishes that timeline (relevant to the Appendix C Hazardous Materials Report).

Action (CLARIFICATION):

The "Preliminary Hazardous Materials Assessment Report" for the building structures is included in the solicitation and indicates no regulated asbestos or lead-based paint. However, Contractors must follow OSHA lead-safe work practices for any work that disturbs painted surfaces, which requires certification under the USEPA Renovation, Repair, and Painting (RRP) Rule. Additionally, Specification Section 01 57 19 (Temporary Environmental Controls) addresses the potential for "contaminated soils" during septic removal, which was outside the scope of the building survey. Therefore, the Contractor must provide evidence of all necessary federal/state licenses (including EPA RRP Certification) and waste disposal permits within 30 days of contract award.

Reference: Preliminary Hazardous Materials Assessment Report; Specification Section 01 57 19 (Temporary Environmental Controls).

The EPP/environmental provisions note some permits can take up to 180 days to obtain and that the EPP will not be approved until permits are obtained. Will the Government provide the SPDES/NPDES Construction General Permit (or MS4 coverage) status for the site, and confirm whether any long-lead environmental permit is the Government's or the Contractor's responsibility?

Action (CLARIFICATION):

No State Pollutant Discharge Elimination System (SPDES)/National Pollutant Discharge Elimination System (NPDES) General Permit or Stormwater Pollution Prevention Plan (SWPPP) is required for this project.

The New York State Department of Environmental Conservation (NYSDEC) Division of Water/Bureau of Water Permits has formally confirmed that because the individual septic replacement locations are geographically separate (greater than 1/4 mile apart), they do not constitute a "Common Plan of Development or Sale" under the Construction General Permit (CGP) GP-0-25-001 Appendix A.

Because each property is evaluated independently and no individual site exceeds the soil disturbance threshold, a formal SWPPP filing is not required. The Contractor shall implement standard erosion and sediment controls (e.g., silt fencing, inlet protection) at each individual site as detailed in the drawings, but no formal stormwater permit application or fee is required.

Reference: NYSDEC Division of Water Jurisdictional Determination; CGP GP-0-25-001 Appendix A; Specification Section 01 57 19 (Temporary Environmental Controls).

SOLICITATION # 70Z0G126BSLIS0SL1

For the septic grant programs (Town RFA, Suffolk County SIP, NYS SSRP), the spec requires a Town- and County-approved installer on the approved-vendor lists. Please confirm: (1) the awardee's septic subcontractor must appear on BOTH the Town of East Hampton and Suffolk County approved-installer lists at time of award; and (2) whether AO FED (the prime) or only the septic installer must be registered.

Action (CLARIFICATION):

The subcontractor performing the septic installation must be on the Suffolk County Department of Health Services (SCDHS) approved installer list.

As a federal entity, the Government is exempt from local municipal control; however, the Government is voluntarily adopting this county standard as a contract requirement to preserve eligibility for a Suffolk County septic grant anticipated to refund a portion of the project costs.

Proof of the subcontractor's current SCDHS approved listing is a mandatory post-award submittal due to the Contracting Officer prior to the start of physical septic construction. Bidders do not need to provide this proof or name the subcontractor at the time of bid submission.

Reference: SCDHS Approved Installer Requirement; Specification Section 01 11 00 (Summary of Work).

Please confirm the Base Bid Item comprises the 15 properties and that OB1#1 = 6 Presidio Place and OBl#2 = 20 Broadway Avenue are each a separate optional add. Will the bid schedule (SF-1442 / Section B) contain distinct CLINs/line items for the Base Bid, OBl#l, and OBl#2?

Action (CLARIFICATION):

Confirmed. The Base Bid consists of fifteen (15) properties, while Option Bid Item #1 (OBI #1) and Option Bid Item #2 (OBI #2) consist of one (1) property each, totaling seventeen (17) properties.

The Price Schedule under Section B of the IFB contain distinct, separate Contract Line Item Numbers (CLINs) for the Base Bid, OBI #1, and OBI #2. Bidders must provide pricing for all CLINs (Base and Options) to be considered responsive and eligible for award. The contractor should provide the Total Lump Sum Bid Price under SF-1442, Box

17. The original IFB contained a typo in the parenthesis stating the total lump sum bid price to include "Item 0001" instead of the correct statement "Items 1, 2, and 3." Therefore, a revised page 2 of the SF-1442 with the correction is provided as Attachment No. 7. Please replace the page 2 of the original SF-1442 with this revision when submitting your bid.

Reference: Solicitation Price Schedule / Bid Form.

How will the Government evaluate and award with respect to the optional items - is award based on the Base Bid alone, or Base plus one or both Options, and may the Government exercise options at - any time during performance or only at award?

Action (CLARIFICATION):

The Invitation For Bid (IFB) already contain the information for this responses. In accordance with Page 104 of the IFB under Section M.2 FAR Clause 52.217-5 Evaluation of Options (JUL 1990), except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

SOLICITATION # 70Z0G126BSLIS0SL1

Are there any scope differences between the Option properties (6 Presidio Place, 20 Broadway Avenue) and the Base Bid properties beyond their phase (e.g . reduced or expanded scope), or is the per-home scope identical?

Action (CLARIFICATION):

Refer to the drawings and Summary of Work (Section 01 11 00) for all specific scope of work requirements at each property. The separation of properties into Base Bid and Option Bid Items is solely for Government funding and evaluation purposes, and does not alter the physical scope of work required at any individual property.

Reference: Specification Section 01 11 00 (Summary of Work); Project Drawings (P12675124 DWGs.pdf).

Please confirm the Phase I (9 vacant) / Phase II (8 occupied) property assignments and whether Phase II units must be fully relocated and vacated before any interior demolition begins in those units.

Action (CLARIFICATION):

Yes, Phase I consists of nine (9) vacant properties and Phase II consists of eight (8) currently occupied properties.

Per Specification Section 01 11 00 (Summary of Work), Section 1.5.1, the Contractor is responsible for all coordination and relocation of occupants. As explicitly stated in Section 1.5.1: "Under no circumstances shall the Contractor perform construction activities at a housing unit while it is occupied."

The Contractor may elect to relocate occupants individually as Phase I units are completed and made available for occupancy, or relocate them all at once, provided no construction occurs in an occupied unit. Refer directly to Spec 01 11 00 Sec 1.5.1 for full logistical and coordination requirements.

Reference: Specification Section 01 11 00 (Summary of Work), Section 1.5.1.

The relocation provision references a professional mover, max 15.000 lbs per household, max 10-mile radius, with COR approval. Will the Government identify the relocation destinations (completed Phase I units

vs. off-site storage), and confirm whether temporary lodging for displaced families is a Contractor or Government responsibility?

Action (CLARIFICATION):

Refer to Specification Section 01 11 00 (Summary of Work), Section 1.5.1, for all occupant relocation, moving, storage, and temporary housing requirements. The Contractor is responsible for executing, coordinating, and funding these services as detailed in the contract specifications.

Reference: Specification Section 01 11 00 (Summary of Work), Section 1.5.1.

What are the permitted working hours/days around occupied family housing, and are there quiet-hours, weekend, or holiday restrictions that should be reflected in the schedule and pricing?

Action (MODIFICATION):

ADD the following section to Specification Section 01 14 00 (Work Restrictions):

"1.6 CONSTRUCTION HOURS AND NOISE RESTRICTIONS

The Contractor shall comply with all local noise ordinances. Heavy construction activities, excavation, and the operation of heavy machinery or loud power tools are restricted to the following hours:

-Monday through Saturday: 7:00 AM to 8:00 PM.

-Sundays and Federal Holidays: No heavy construction, excavation, or loud exterior work is permitted.

Quiet interior work that does not generate outdoor noise disturbances may be performed outside of these hours, subject to prior coordination and approval by the Contracting Officer's Representative (COR)."

Town RFA and SIP grant monies “must be secured prior to septic system replacements.” If grant approval is not known until after award (1.7.1(c)), please confirm whether the Contractor must hold septic work until each grant is secured, and how any resulting delay or stand-by is handled in the schedule and contract time (e.g., excusable delay, separate notice to proceed for septic).

Action (CLARIFICATION):

The Contractor is not required to hold work or delay construction pending municipal grant approvals. Because the Suffolk County "Reclaim Our Water" and Town RFA grant programs are reimbursable funding sources, physical work may proceed immediately upon issuance of the Notice to Proceed (NTP) in accordance with the project phasing.

The Contractor shall execute the work, pass all required inspections, and complete the closeout documentation to trigger the grant funding. Any administrative delay in the Town or County administering the post-construction grant payment shall not result in construction delays, nor shall it entitle the Contractor to additional contract time or delay compensation.

Reference: Specification Section 01 90 00 (Contract and Grant Requirements), including Section 1.7.1.

Does the July 1, 2026 date (or its corrected replacement) reflect a grant-program funding-cycle deadline imposed by the Town of East Hampton, Suffolk County, or New York State? If so, please identify each program’s actual funding deadline so the Contractor can sequence septic work to preserve grant eligibility, and confirm the Government — not the Contractor — bears the risk of grant funds lost to a deadline that predates

NTP.

Action (CLARIFICATION):

See response to RFI #31.

The Government is responsible for overall grant eligibility and managing funding cycle deadlines. The Contractor, however, is responsible for executing the specific administrative tasks required to process the reimbursements, as detailed in Specification Section 01 90 00. This includes, but is not limited to, submitting compliant invoices, providing as-built documentation, and coordinating with the Town/County for closeout inspections.

The Contractor bears no financial risk or schedule liability for any grant funding lost due to administrative deadlines that are outside the scope of their contractually defined responsibilities.

All grant correspondence must be COR-approved before transmittal, and the Contractor must handle all invoicing/coordination with the Town and County for each system. Please confirm the expected volume and cadence of grant invoicing (per-system vs. per-program), the required turnaround for COR review, and whether a single combined submission per program is acceptable, so the Contractor can scope the administrative effort.

Action (MODIFICATION):

ADD the following administrative procedure to Specification Section 01 90 00 (Contract and Grant Requirements):

"1.8 GRANT INVOICING AND REVIEW PROCEDURE

-Submission Process: The Contractor is responsible for preparing and submitting all reimbursement and closeout paperwork required by the Town of East Hampton and Suffolk County grant programs, in the format and cadence required by each individual grant authority.

-Bidding Basis: For bidding purposes, the Contractor shall assume that reimbursement submittals will be prepared and submitted on a per-property, per-grant basis (i.e., a separate submission for each of the 17 properties to each applicable grant program).

-COR Review Time: The Contracting Officer's Representative (COR) shall have ten (10) business days to review each per-property grant package for completeness before approving it for transmittal."

If Phase II (occupied units) transitions during the winter months, how can we comply with the HVAC work window restriction (April 1st – October 31st) without delaying the overall 730-day schedule?

Action (MODIFICATION):

1. DELETE Paragraph 1.1.g in Specification Section 01 14 00 (Work Restrictions), which previously restricted HVAC work to the period between April 1st and October 31st. The Contractor is permitted to perform HVAC replacements year-round in accordance with the approved project phasing schedule.

2. ADD the following section to Specification Section 01 50 00 (Temporary Facilities and Controls):

"1.5.1 WINTER WORK AND VACANT BUILDING CONTROLS

To support year-round construction and prevent damage to Government property, the Contractor shall implement the following controls for all vacant, under-construction buildings during the winter months (November 1 through March 31):

- Temporary Heat: Buildings shall be heated at all times to a minimum of 55°F to prevent frozen plumbing and allow for proper system testing, commissioning, and ambient temperatures for finish curing. The Contractor may heat buildings to a higher temperature at their discretion.

- Building Security: The Contractor shall maintain the security of each vacant building to deter vandalism, squatting, and unauthorized entry.

- Snow Removal: The Contractor shall maintain safe access to the building at all times, including snow removal from driveways, sidewalks, and all entry doors. Snow shall be cleared within 24 hours after a snow event concludes.

The cost of temporary heating, security, and snow removal shall be included in the Contractor's base bid."

The Hazmat report indicates no hazardous materials are present on-site.

However, Spec 01 57 19, 1.2.2 references 'contaminated soils from septic system removals.' Has any soil testing been performed, and should the contractor anticipate contaminated soil disposal costs in their base bid?

Action (CLARIFICATION):

Both documents are correct, as they address different scopes. The "Preliminary Hazardous Materials Assessment Report" applies only to the building structures and confirms there is no regulated asbestos or lead-based paint (though USEPA RRP certification is required for disturbing painted surfaces).

Specification Section 01 57 19 (Temporary Environmental Controls) applies to the excavation of the existing septic systems. No soil testing has been performed around the septic systems, and the specification language is included as a precautionary protocol.

For bidding purposes, Contractors shall assume there are no hazardous/contaminated soils requiring specialized disposal. If hazardous soil is encountered during construction, it will be addressed as a Differing Site Condition in accordance with FAR Clause 52.236-2 (Differing Site Conditions).

Reference: Preliminary Hazardous Materials Assessment Report; Specification Section 01 57 19 (Temporary Environmental Controls); FAR Clause 52.236-2 (Differing Site Conditions).

Confirm if CGL limit of $500,000 is correct, or if Umbrella/Excess is required for $10M project.

Action (CLARIFICATION):

The Commercial General Liability (CGL) limit of $500,000 per occurrence is correct as stated in the solicitation. In accordance with FAR 28.307-2(b), this is the standard minimum required limit for bodily injury liability on a Government installation. There is no additional Umbrella or Excess Liability policy required by the Government for this solicitation.

Reference: Solicitation Section H.1; FAR Clause 28.307-2(b) (Liability).

Section L states the magnitude is $5M to $10M, but Section 01 90 00 requires us to bid the full cost of the septic work before the $1.1M grant credit. If the total gross bid exceeds $10M due to the 'full cost' requirement, will the bid be rejected for being over-budget, or is there a 'funding ceiling' we should be aware of?

Action (CLARIFICATION):

Bidders are required to submit pricing for the full cost of the septic system work as part of their Base Bid, without deducting any anticipated grant funding. A bid will not be considered non-responsive or be rejected solely on the basis that the total evaluated price (Base + Options) exceeds the high end of the project's estimated magnitude ($10M) as a direct result of including the full, unsubsidized cost of the septic system work.

The Government's internal budget and the official project magnitude will account for the anticipated grant reimbursement, which will be credited back to the Government post-award via a deductive contract modification.

SOLICITATION # 70Z0G126BSLIS0SL1

Please clarify whether the following functions must be addressed by independent team members or if a single licensed / certified person canaddress? We feel this level of oversight requested seems heavier when compared to the complexity of the scope of work.

- A 10-year experienced Superintendent on-site at all times.

- A Certified CQC Manager.

- A Health & Safety Officer.

- An Administrative Clerk for the intense $1.1M grant coordination and weekly DBA payroll.

- The Cost: This management "team" costs nearly 500,000 per year**.

Over a 2-year project, that is **1M (10% of the budget) just for people to watch other people work.

Action (MODIFICATION):

ADD the following section to Specification Section 01 35 26 (Governmental Safety Requirements) and Section 01 45 00 (Quality Control):

"1.4.1 DUAL-HATTING OF SITE PERSONNEL

For this project, the Contractor is permitted to utilize a single, qualified individual to perform the combined duties of the Site Safety and Health Officer (SSHO), Contractor Quality Control (CQC) Manager, and Project Superintendent ("triple-hatted"), provided that the designated individual meets all qualification, training, and certification requirements outlined in both Section 01 35 26 and Section 01 45 00 (including holding a current OSHA 30-Hour Construction Safety certification and a valid USACE Contractor Quality Management (CQM) certificate). This individual must be present on-site full-time during all active construction activities."

As the project estimated budget notes 5-10MM, As the spec states to bid full cost, Can you please clarify if you view this project likely as $9MM (accounting for Septic Grant 1.1M). Due to the timing of this check issuance, should we exclude this amount and submit a bid that might cross $10MM, since the Town may issue the grant checks much later than our work completion / full invoicing is expected by the Government?

- The Government's View seems as follows: Govt may see the project as a

$9M project because of $1.1M in grants to pay for the septic systems.

- The Contractor’s Reality: We are required to bid the "Full Cost" (Section

01 90 00). If the hard cost of the work is $9M, and the septic systems are 1.1M, Do we bid as **10.1M**.?

Action (CLARIFICATION):

See response to RFI #40.

Reference: RFI #40 Response.

Please confirm if unique productivity situations / rates are considered when estimating this job (e.g., "it takes 4 hours to install a window"). Are the following factors accounted for:

- Windshield Time: Often referred to as Trade Parade. The 2.5 to 3 hours of daily travel pay required under Davis-Bacon to get a crew to Montauk needs to be paid at the same rate as when the crew is performing actual work.

- The Friday Factor: In the summer, we lose 30-40% of Friday productivity due to Hamptons traffic on Route 27. Traffic is bumper-to-bumper.

Action (CLARIFICATION):

The Government's Independent Government Estimate (IGE) is not disclosed during the solicitation.

Under a Firm-Fixed-Price (FFP) contract, the Contractor is solely responsible for determining their own labor productivity rates, scheduling, and logistics. This includes pricing and accounting for all local geographic factors—such as travel/windshield time, local traffic conditions, seasonal congestion, and trade productivity—within their proposed lump-sum bid. The Government will not adjust contract values or evaluations based on individual Contractor productivity calculations.

SOLICITATION # 70Z0G126BSLIS0SL1

We are noticing a combination of an estimated $1.2M travel gap and/or higher local Trade Costs due to the Luxury / Remote Hamptons market. As we calculated, the travel pay alone is roughly 12% of the entire $10M budget. Can you clarify if the government's estimate accounts for this unique location impact? Clarify if there may be a $1.2M budget shortfall.

Action (CLARIFICATION):

The project's estimated magnitude of construction ($5,000,000 to $10,000,000) is published in accordance with FAR 36.204 solely to provide bidders with a general scale of the project. It does not represent a strict funding ceiling, nor does it disclose the Government's actual internal budget.

Bidders are required to submit a firm-fixed-price bid that reflects all actual costs to perform the specified work in the local Montauk/Hamptons market, including any localized labor, travel, or trade premiums. Bids will be evaluated solely on the basis of price responsiveness and bidder responsibility, not against the published magnitude range.

Will the USCG pay for 'Materials Stored Off-Site'? If we buy all 9-17 septic systems or HVAC units upfront to lock in pricing, can we invoice the Government while materials are in our yard?" (If the answer is 'No,' we may need to add the cost of financing that $1M+ in materials to the bid).

Action (CLARIFICATION):

In accordance with FAR Clause 52.232-5 (Payments under Fixed-Price Construction Contracts), the Government will only consider progress payments for materials delivered directly to the construction sites.

Payment for materials stored off-site (such as at the Contractor's yard or warehouse) is not authorized under this contract. Bidders shall plan their procurement and storage logistics accordingly and carry any associated warehousing or staging costs in their base bid.

Reference: FAR Clause 52.232-5 (Payments under Fixed-Price Construction Contracts).

The Invoice Processing Platform (IPP) is used. Realistically, what is the average number of days from 'Superintendent Approval' to 'Funds in Bank'?" (Long delays can increase our financing costs).

Action (CLARIFICATION):

The Invitation For Bid (IFB) already contain the information for the responses. In accordance with the IFB on Page 11, FAR Clause 52.232-27 Prompt Payment For Construction Contracts paragraph (a)(1)(i)(A) (“30 days” in lieu of “14 days”).

Under the federal Prompt Payment Act, the Government is legally required to make progress payments within 14 calendar days after the designated billing office receives a proper, certified payment request (invoice) via the Invoice Processing Platform (IPP). However, due to the construction type of contracts requires additional review time for the invoices, the time is extended to 30 days for this contract.

The CQC Manager must notify the KO 24–72 hours before each phase (Preparatory/Initial). If we are ready to pour concrete on a Tuesday, how fast can an inspector actually get to Montauk?" (If they take 3 days to show up, you are paying a 10-man crew to sit at the lighthouse doing nothing).

Action (CLARIFICATION):

The 24 to 72-hour notification period specified in the contract is the contractually required minimum notice the Contractor must provide to the Contracting Officer's Representative (COR) to allow for the scheduling of Government quality assurance inspections.

Provided the Contractor gives proper and timely notification in accordance with the specification, the Government will make every effort to have an inspector on-site to witness preparatory and initial phases, including critical work such as concrete pours, without causing undue delay to the Contractor's scheduled operations. The Contractor is responsible for coordinating all inspection notifications with the COR well in advance.

Section 01 14 00 makes us responsible for the move. If a tenant is not packed or refuses to allow the movers in on the scheduled Monday, who pays for the 'Movers' Standby Time' and the 'Construction Delay' for that unit?

Action (CLARIFICATION):

The Government is responsible for ensuring that all residents are prepared for their scheduled move. The Contractor's responsibility is limited to providing the physical moving services as detailed in the contract specifications.

In the event that a resident is not packed or refuses to allow the movers access on the mutually agreed-upon move date, this shall be considered a Government-caused delay. The Contractor shall immediately notify the Contracting Officer's Representative (COR) in writing. Any legitimate and documented costs incurred for mover standby time or impacts to the construction schedule will be handled via a contract modification in accordance with the applicable FAR clauses for delays to work.

We are installing high-draw heat pumps. Have the existing utility transformers and service-entrance conductors been verified to handle the new load, or is that part of our 'Full Cost' bid?" As part of our Site visit we have noticed one home having less than 200AMP service and the circuit breaker seems outdated or compatable to add breakers into old panels As heat pumps are all electric, please confirm the existing panels across all the 17 homes are capable of receiving HVAC, appliance, etc upgrades.

Action (CLARIFICATION):

The Government's design documents have verified that the existing utility transformers and primary service-entrance conductors are adequately sized to handle the new electrical loads imposed by the high-efficiency heat pumps. The Contractor's scope is limited to the replacement and upgrades of the interior branch circuit panels, breakers, and wiring as explicitly shown on the project drawings.

No upgrades to the utility-owned transformers or the main service laterals to the buildings are required as part of this contract.
