About this file

This solicitation seeks proposals for armed protective security officer services throughout northern Florida. The Department of Homeland Security, Federal Protective Service requires armed guards to protect federal personnel and property at various federally owned and leased buildings. Offerors must provide all necessary labor, management, training and equipment to perform these services in accordance with the statement of work. The base period of performance is one year with four one-year options and an optional six-month extension. Services will be acquired through an indefinite delivery/indefinite quantity contract with firm fixed price task orders. The acquisition uses a best value tradeoff source selection with non-price factors more important than price. Estimated hours are over 2.8 million for a 66-month period. Proposals are due January 24, 2023. Offerors must possess a Top Secret facility clearance by the due date. The North American Industry Classification System code is 561612 with a $22 million small business size standard.

RFP 70RFP122RE4000003, PSO Services for North Florida

Replacement Page 67 whose pricing is determined by the Contracting Officer to be most competitive may be reviewed prior to, or instead of, other technical proposals received. Based on the initial review of these technical proposals, the Government may not evaluate the technical proposals of other offerors, whose total evaluated pricing was higher than that of one already evaluated and already assigned the highest possible technical adjectival rating. This would occur when the Contracting Officer determines that one or more of the technical proposals already reviewed is of such a level of quality that it would not be in the interest of the Government to incur cost beyond the price of the technical proposals already reviewed.

Proposal Submission Requirements

1. The resulting contract requires access to classified information. Offerors shall possess a

Top Secret facility clearance by the time and date established for submission of offers. Offerors shall provide a certified statement of current Top Secret Facility Clearance which will be verified by the Contracting Officer prior to award.

2. Standard Form 1449, Solicitation/Contract/Order for Commercial Items – When responding to this RFP the Contractor must use the Standard Form 1449 as a cover page to the proposal. All pages of the SF1449 must be completed to include the Pricing

Schedule, which details all CLINs, quantities, unit prices and extended prices.

3. Proposals shall be comprised of TWO (2) separate electronic files. The first file shall contain one (1) copy of the technical (non-price) submission. The second file shall contain one copy of the pricing submission and all other documents required by the solicitation

(e.g. the SF 1449 to include the Pricing Schedule, Price Element Breakdown, Disclosures, Representation & Certifications, Subcontracting Plan (if applicable), etc.).

Both of these files should clearly identify the RFP for which it is being submitted. The

Price Element Breakdown shall be submitted in Excel Format. Vendors are reminded to submit files one and two via email to Kerrin.Cahill@fps.dhs.gov and

FPSACQDIV1@fps.dhs.gov. Proposal submissions containing links to SharePoint or similar sites will not be accepted.

# Contractor Document Page Reference Contractor Question Government Response

1 RFP Page 16 04. PRICES Is the Offer to use the FY23 CBA wage and fringe provisions in developing the price proposal? See Solicitation Provisions, pages 74-75, Price Proposal, paragraph 3. Vendors shall calculate a weighted average, accounting for the mid-year rate change in the CBAs, based on the CBAs’ wages and bona-fide fringe benefits that apply to the Base Ordering Period of the RFP. Offerors shall propose the Base Ordering Period PSO blended wage and/or bona fide fringe benefit rate(s) for all ordering periods. Future performance period PSO rates should not be escalated for future CBA economics or mid-year rate changes that may be applicable to future contract ordering periods. In the event, a CBA does not have H&W rates for the period applicable to the Base Ordering Period, the most current rate in the CBA should be used for the purposes of calculating the weighted average. Offers should note Amendment 0001 provides new CBA-2022-587, Rev, 0, dated 11/30/2022, for Orlando Florida & Surrounding Areas, which replaces and supersedes CBA-2019-12904, Rev, 2, dated 11/15/2021 provided in the original RFP. 0004 provides updated CBA-2021-496, Rev. 1, dated 11/30/2022, for Tampa Florida & Surrounding Areas, which replaces and supersedes CBA-2021-496, Rev. 0, dated 11/15/2021 and CBA-2021-497, Rev. 1, dated 11/30/2022, for Jacksonville Florida & Surrounding Areas, which replaces and supersedes CBA-2021-497, Rev. 0, dated 11/15/2021.

2 RFP Page 67 Proposal Submission Requirement 4. Page The technical proposal (covering all non-price factors) is limited to ten pages in at least 11 pt. font and 1” margins. Will the Government accept a font size of no smaller than 9 pt. for diagrams, illustrations, charts, tables, and figures? No. Font shall be at least 11pt as stated under Proposal Submission Requirements on Pages 67 and 73 of the RFP.

3 SOW Page 33 6. Training Previous training and certification documentation and/or credentials shall be valid and meet requirements of this contract to be considered. Are the incumbents considered to meet all current training and acceptability standards (suitability)? See Amendment 0004 which provides current Master Certification List. Not all PSOs are qualified/certified to the requirements contained in the RFP. Amendment 0004 provides a Master Certification List which specifies which certification/qualification/training was achieved by incumbent PSOs as of the date of the report. This information may have changed since the date of the report.

4 SOW Attachment Page 30 b. Firearm Qualification Course Shotgun Firearm: Contract-authorized duty shotgun (Note: A specific post requirement must exist for PSOs to be armed with a shotgun.) Can the Government please clarify if shotguns are required as Contractor Furnished Equipment? Shotguns are not currently required. Refer to SOW Exhibits, page 138.

5 N/A N/A Post exhibit, locations, staffing required for accurate proposal development Will the Government provide a complete post exhibit? Amendment 0004 advises that the Post Exhibit been updated to correct various elements including day calculations, relief requirements, addresses, and post types and applicable CBAs. The most current post exhibit will be emailed to vendors who previously provided a signed Non-Disclosure Agreement. Any other vendor who wishes to have a copy of the most current post exhibit, but has not yet provided a signed Non-Disclosure Agreement, may do so by submitting an email request containing a signed Non-Disclosure Agreement to kerrin.cahill@fps.dhs.gov and fpsacqdiv1@fps.dhs.gov.

6 SOW 75 Contractor Provided Equip. What handgun make, model, caliber, platform and brand is used by the incumbent PSOs Glock 19 (9 MM)

7 Considering the economic uncertainty and inflation present in the labor market and material supply chain today there is serious doubt concerning price stability during the extended period of contract performance. The uncertainty is industry-wide and outside the contractor's control. The solicitation pricing instructions require the contractor to include both labor and associated material and other costs into one firm fixed labor rate, which increases the economic risk to the contractor even further. The market variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor. Under the current economic circumstances, would the Contracting Officer consider including the clause at FAR 52.216-4, Economic Price Adjustment-Labor and Material, or the clause at FAR 52.216-5, Price Redetermination-Prospective, or an agency-prescribed clause as authorized in paragraph (a)(2) of FAR 16.203-4? No.

8 If the government is unwilling to include FAR 52.216-4 or -5 in the contract, would the Contracting Officer consider separating the direct labor rate from materials and other ODCs and including the materials and other ODCs on a separate cost-reimbursement CLIN? No.

9 Can the government confirm the last Contract Award amount and/or provide the contract number? The incumbent contract number is HSHE4-17-D-00002. The award amount was $105,485,655.00.

10 Can the Government confirm that this is the same level of effort of the last/current contract? Yes. The Post Exhibit provides the current, known service requirements. However, note that this is an indefinite delivery, indefinite quantity type contract and task orders will be issued for the actual known service requirements based on the post requirements at that time. Refer to page 15 of the RFP, section 03. Maximum Quantities.

11 Can the Government confirm on average, historically, how much TAS they used annually over the past contract term of five years? The following historical information is provided for informational purposes and is not a representation of any future requirements. Before COVID and during a Hurricane approximately 18,000 TAS hours annually. During/After COVID, approximately 9500 TAS hours per year. FEMA TAS varies. The Post Exhibit provides the current, known service requirements, but the government may order up to the maximum quantities specified in the 1449 pricing schedule; see page 15 of the RFP, section 03 Maximum Quantities and pages 20-21, 04. Prices, E. Definitions, 1. PSO Services.

12 Can the Government confirm if there is a CBA(s) in place for any of the Supervisory positions? If so can we obtain a copy of it? No, there is not a Supervisory CBA in place and CBAs are not applicable to Supervisors. (if true) See RFP pages 16-18, 04. Prices.

13 Can the Government please clarify what are the Submission requirements for the Technical (non-price volume)? In the Pre-proposal conference slides the Management Questionnaire, a Transition Plan and a Formal Quality Control plan is listed as a submission requirement but in the RFP pages 69 -74 there is no mention of a Quality Control Plan and Transition also in the Attachment 9 the only thing under Management Approach for minimum submission requirements is Field Level Supervision Attachment 8. See Amendment 0004 which clarifies the Submission Requirements and updates Attachment 9. The pre-proposal conference slides erroneously indicated that a Transition Plan and a Quality Control Plan are required with proposal submission, however these are post award documents only provided by the vendor receiving contract award, see SOW sections 3.2.1 and 3.4.1. The Management Approach requires submission of Attachment 8, Field Level Supervision Exhibit, Management Questionnaire, and DHS Mentor-Protégé Participation (if vendor is a large business concern). The Technical (non-price proposal) has a page limit of 9 pages inclusive of the 6 pages, one per question, allotted for the Management Questionnaire. Please also be advised that if there are any remaining discrepancies between the RFP and the Attachment 9 (Proposal Submission Checklist), pre-proposal conference slides, or anywhere else, the RFP and Amendments shall take precedence.

14 If a formal Quality Control Plan is required how many pages are we allowed and is it included in the 10 pages? A formal Quality Control Plan is not required with proposal submission, but in accordance with SOW 3.4.1 the awardee will be required to provide a detailed Quality Control Plan within 15 calendar days after the contract award conference. This Quality Control Plan is not page limited.

15 If a Transition Plan is required how many pages are we allowed and is it included in the 10 pages? A Transition Plan is not required with proposal submission, but in accordance with SOW 3.2.1 the awardee will be required to provide a Transition Plan within 7 calendar days after the contract award conference. This Transition Plan is not page limited.

16 It appears the Offer good through date is different on the conference slides than in the proposal it is 180 days on the Pre-Proposal slides and 120 in the RFP under Proposal Submission Requirements. Please confirm the good through date you would like us to use? The RFP takes precedence. Reference RFP page 68, paragraph 6, Offerors shall hold their offers valid for 120 days after the solicitation closing date, unless requested to further extend it by the Contracting Officer.

17 I understand the requirement for a TS security clearance. Is the requirement for a company clearance or an individual acting as a manager of this contract at the time of the proposal? Reference RFP page 67 (updated) in Amendment 0004, paragraph 1, offerors shall possess a facility clearance. Facility Clearances are granted to entities, rather than individuals.

18 Where can we find a post breakdown list/chart? See answer to question #5 above.

19 General Pricing Will new medicals be required for all incumbents during transition? Reference SOW Section 5.2.2.1, incumbent PSOs must complete a medical and physical examination every five years to continue working on any FPS PSO contract. New hires require an initial pre-employment medical and physical examination prior to working on any FPS PSO contract.

20Solicitation
Pg. 67 of 111Proposal Submission Requirements
No. 4.The specified font size is 11pt. Would the Government please allow smaller fonts for graphics and in tables as long as the content is legible? No. See answer to question #2 above.

21 Attachment A; Pg. 26 of 85 Statement of Work Section 5.3.5 The Statement of Work in Section 5.3.5 states: “Once a completed personnel security package has been received, the standard processing time is generally up to twenty‐one (21) calendar days, so long as there are no derogatory issues.” For planning purposes, what is the true average processing time for clearances in the last 12 months? If processing time consistently exceeds 60 days, will the Government consider allowing entry on duty with Quick-Checks? The average processing time for clearances, in the last 12-months is within 60 days.

22 Attachment A; Pg. 55 of 85 SOW 9.5, Post Tracking System (PTS) When does the Government anticipate the new Post Tracking System (PTS) will become active on this contract? Reference Amendment 0004, amended Page 20 of the RFP, paragraph D. 1. Post Tracking System (PTS), sentence added to the end of the paragraph that reads, “It is expected that PTS will be implemented immediately upon contract award.”

23 General General Do any of the tenant agencies conduct their own clearance/suitability determination separate or in addition to FPS? Yes. FBI conducts its own. FPS conducts the clearance/suitability determinations for all other tenant agencies.

24 The evaluation criteria lists the technical evaluation factors in the order of importance. The first factor is titled, “Relevant Past Performance (written)”. Can the Government confirm the Attachment 3 Past Performance Project Form and Attachment 4 Past Performance Questionnaire are what is required to submit under this evaluation subfactor and that no separate written narrative is being requested? Yes, past performance is captured on the past project forms. Additional narratives would only be required if teaming is proposed or relying on an affiliate. See pages 69-71 of the RFP. Attachment 3 Past Performance Project Form shall be completed for each reference contract submitted. Past Performance Questionnaires (Attachment 4) may be submitted for each reference contract. Where a teaming arrangement is proposed, a narrative and/or the actual Teaming Agreement, if one exists, shall be submitted as part of the proposal by the managing partner of the joint venture or the prime contractor. In order to receive credit for the past performance of an affiliate, a separate narrative shall be submitted as part of the proposal clearly demonstrating that the affiliate will be meaningfully involved in performance of the solicited contract.

25Collective Bargaining AgreementThere are three Collective Bargaining Agreements (CBAs) provided in the RFP for Orlando, Tampa and Jacksonville, and their surrounding areas. Additionally, there are 38 locations/cites called out in the NFL Recompete 2021 Post Exhibit.xlsx File; several of which are not in close proximity to either of the above cities. Will the Government please provide a mapping of which cities are covered by each of
the CBAs?Each CBA lists additional cities that are covered under each CBA. See also Amendment 0004, Attachment 5 CBA Location Coverage is provided, which also lists the cities applicable to each CBA as well as update Post Exhibit that has been amended to include the CBA applicable to each post.

26 Collective Bargaining Agreement In P. Attachment 10 PSO Seniority List.xlsx, there are three CBAs listed: CBA2019-12904, CBA 2018-11998, and CBA 2018-11999. Only one of the CBAs numbers in the list match a CBA document provided in the RFP (CBA2019-12904, Orlando, FL). Amendments 0001 and 0004 provide updated CBAs. Amendment 0004 also provides an updated seniority list.

27 Supervision and Relief It appears there are varying levels of relief at each site. Could you please clarify what the relief requirements are to assist in confirming staffing levels for sites? Refer to SOW section 12.1.2 Breaks. This section indicates that breaks or meal periods shall be provided in accordance with the minimum state requirements or applicable CBA (12.1.12.1). Further, 12.1.2.2 indicates that the post exhibit will specify which posts require provision of a relief PSO if the assigned PSO is taking a break or meal period to ensure continuous/uninterrupted coverage. The Contractor must provide a replacement PSO for each employee on an authorized break where the post exhibit specifies relief/continuous coverage. Patrol (rover) PSOs shall not be used to provide relief for PSO on a break or meal period. 12.1.2.3 states that Supervisors shall not provide relief while working in a supervisory capacity. Breaks and meal periods are different than relief. It is the responsibility of the contractor (the company that employs the PSOs) to ensure that it is also in compliance with any applicable state/local laws and the respective Collective Bargaining Agreements pertaining to relief. It is the company’s discretion how they staff posts for breaks as long as it meets the terms of the contract/SOW and any other applicable laws, regulations, and Collective Bargaining Agreement requirements.

28 Supervision and Relief While we are aware that no supervisors can stand post, can a regional/program manager fill in for a supervisor and can a PSO temporarily move into a supervisor role for a short period and then move back to a PSO role when not needed in the management position? Please refer to SOW section 12.2.5.2, the Contractors shall not allow supervisors to perform productive PSO hours while performing in the capacity of a supervisor. PSO Supervisors will not work as “Key Personnel” on any PSO contract; SOW section 11.1.1 Under this contract, the Government designates the positions of Contract Manager, QC Monitors, and Training Instructors to include NWDTP Training Instructors as “Key Personnel.”; SOW section 11.2.6, the Contract Manager shall not perform PSO duties, whether in a productive or supervisory capacity, while performing Contract Manager duties. SOW section 12.1.2.3 Supervisors shall not provide relief while working in a supervisory capacity (i.e., a supervisor shall not perform supervisory and productive PSO services simultaneously). To provide relief, a supervisor must sign‐off as a supervisor; remove any supervisory insignia, and sign‐in as a productive PSO.

29 Supervision and Relief Can we create a “site lead”, who is still a PSO and in the union, for the sites that have multiple posts at one location? It is at the vendor’s discretion/business decision how it wants to designate staff and pay its employees; however, a site lead is not a supervisor and as indicated on pages 17-18, FPS is not purchasing the services of any other type of non-supervisory PSO/guard such as Lead PSO, Lieutenant, Sergeant, Captain, or as identified by any other nomenclature (e.g., Armed PSO levels, numbers, etc.) and tied to higher wage and fringe benefit rates (when combined) in the CBA. Use of such positions in performance of this contract is not consistent with the terms and conditions of this contract. Because FPS is not purchasing services for any position, other than the standard armed PSO position, and use of any other non-supervisory PSO position in performance of this contract is inconsistent with the terms and conditions of the contract, the contractor will not be eligible for any price adjustment predicated on the wages and/or fringe benefit rates for these positions increasing. Such positions will not be permitted to fulfill the direct requirements identified by the post exhibit and will not be billable to the Government. See Note on pages 17-18 of the RFP under 04. Prices, B. Contingency Pricing.

30 Supervision and Relief Is there a specific span of control requirement for the supervisors to post management? Solicitation is clear on its face in regards to Supervisors roles and responsibilities.

31 CBA 2021- 497 Local 31 The last H&W rate is effective 12/2021 with TBD 12/2022. Does the Government have an updated rate or MOU? No, the Government does not have an update aside from the CBA’s incorporated via Amendment 0001 and 0004. See also the answer to question 1.

32 Can the government confirm that Attachment 11: Management Questionnaire should be submitted with Management Approach in the Technical Proposal? The Management Questionnaire is not referenced in Attachment 9: Proposal Submission Checklist. Yes. The Management Questionnaire should be submitted with the Management Approach. Attachment 9 has been updated and provided with Amendment 0004. See also the answer to question 13.

33 Should contractors provide pricing for the 6-month extension period referenced on page 1 of the SF1449 No. Pricing does not need to be provided for the extension under FAR 52.217-8. See RFP page 74, Price Proposal, paragraph 1 and 2, for evaluation methodology.

34 Would the Government confirm if TAMS is active on the current contract? If not, when does the Government expect for TAMS to be up and operating on the new contract Yes, TAMS is active on the current contract.

35 Can the government confirm that the work days identified on the post exhibit are correct Yes. Please refer to Question #5.

36 Can the Government confirm the Management Questionnaire is excluded form the 10-page limit as stated in the Proposal Submission Requirements, Page Limitations (Page 67)? Please refer to Question #13.

37 Can the Government confirm the 10-page limit specified for the technical proposal is limited to addressing only the following requirement under Quality Assurance? “Offerors may, at their discretion, provide a narrative to enhance the Government’s understanding of their proposal, containing their rationale for the proposed staffing levels, supervisory labor mix, and geographic placement of supervisors as contained in Attachment 8 as well as the processes, procedures and methods to be used by supervisors to ensure that effective supervision is provided contract-wide”

If so, can the Government confirm that any other technical narrative sections such as Staffing, Training, Transition, etc. that have previously been part of the technical requirements are no longer required to be addressed in the technical price narrative? See Amendment 0004 which clarifies the page limit and submission requirements. The page limit has been revised to 9 pages inclusive of 6 pages for the Management Questionnaire and any narrative supporting Management Approach, A. Quality Assurance, 1. Field Level Supervision of PSOs, paragraph b and for addressing C. DHS Mentor Protégé-Program Participation requirements, if required. See also pages 69-74 of the RFP.
