12 OBAA Solicitation
70RDND19R00000003,
page 27 and page 36
On page 27 the OBAA states that “certified cost and pricing data will be require prior to contract award for awards exceeding the dollar threshold…
($750,000)…to UARCs and
Federal Government activities”.
On page 36 the OBAA states that “costs above $750,000 may require certified cost and pricing data prior to award”. The FAR has since updated so that CCPD only applies when the total dollar threshold of the proposal is > than $2M AND it is sole source. Will the government acknowledge that a certified cost and pricing data is not needed?
Based on the fact that these awards are solicited under FAR
35 procedures and are not competed directly between offerors, the FAR 15.403-1(b)(1) adequate price competition exception for submitting CCPD is not applicable.
13 N/A Does the Government plan to provide data as part of a
Government evaluation? Or will data be provided in accordance with the offeror’s proposed tasks as negotiated part of the contract award?
CWMD will work with the
Offeror to test the capability with actual data, subject to availability, relevance, and with consideration to sensitivity of DHS data. The
Offeror must state in the proposal if DHS data is required to perform the research and if there are non-DHS data sources available that can be used.
