STATEMENT OF SERVICES
Role Playing Services
1. PURPOSE
The mission of the Federal Law Enforcement Training Center (FLETC), Cheltenham
MD, is to host approximately 90 participating agencies/bureaus and is responsible for providing certain instructional law enforcement programs as well as a variety of support services.
2. SCOPE
In order to meet the goals stated above, the Contractor shall provide role playing services in the form of qualified trained role players who will participate in on-site practical training exercises, as needed.
3. REQUIREMENTS
a. The Contractor shall be responsible for providing qualified personnel, one of which shall serve as a site supervisor or Lead Role Player, to perform all practical exercises as identified by FLETC personnel. These exercises shall be varied and targeted for law enforcement personnel as directed on a case-by-case basis and represent real-life scenarios in order to prepare entry-level recruits to meet the challenges they may face in the application of their responsibilities as law enforcement officers. The Contractor shall provide role players in adequate numbers for other specific advanced and in-service training programs as necessary to meet the mission of the Facility.
b. The Contractor shall provide role players for a multiple number of programs scheduled to be conducted during each year. The class schedule may vary due to manpower needs of the FLETC and scenarios will be scheduled to avoid overtime. However, should a situation require additional hours, the Contracting Officer will authorize on a case-by-case basis with prior written approval to the Contractor.
The Contractor shall ensure that role players arrive promptly at the scheduled time and place for all training exercises and they are appropriately dressed according to the requirements of the scenario or instructions from the Instructor. Any travel costs or parking fees shall be the responsibility of the Contractor. Contractor employees may bring their privately owned vehicles onto FLETC property however these vehicles must be registered with Security to obtain a parking pass.
4. GOVERNMENT-REQUIRED TRAINING
Contractor employees granted access to the FLETC-Cheltenham facility must be made available for Security Training. This training is a requirement for Contractor personnel.
5. TRAINING FOR PERFORMANCE OF SPECIFIC ROLES
a. The training roles provided by the Government have the potential to result in an arrest situation, cross gender search, and/or physical contact. All role players must be trained in basic law enforcement actions, (i.e., cross gender search, arrest positions, etc.) prior to performing any training role. Each role player participating in cross gender searches must sign the "Physical Techniques Division (PTO) Cross Gender Search" Log and the "Role Player
Consent to Participate in Cross Gender Searches".
b. The scenarios include law enforcement situations requiring the students to use force, resulting in physical contact between the student and role player. Scenarios may result in the application of deadly force (using training weapons), necessitating the role players to wear appropriate safety equipment and attend training. Physical contact may include defensive tactics and compliance techniques. Physical contact may consist of search situations to include cross gender searches involving direct contact between the student and role player; searches are conducted to detect items/contraband contained or concealed on a person. Contractor personnel are required to attend Government provided orientation training before performing in these roles.
The Government will furnish an orientation training to the pool of Contractor employees deemed necessary by the Contractor to assure adequate coverage for the training scenario requirements.
The Contractor shall be responsible for developing, maintaining and updating a list of trained role player personnel who have completed the Government training and are, therefore, eligible to be scheduled to perform the roles. Should the listing of trained role players become inadequate to fulfill scheduling requirements for these roles or upon specific instructions from the
Government, the Contractor will notify the Contracting Officer of how many role player personnel require the training and specify a preference of date and time. The Contracting
Officer will coordinate the needed training with Government personnel. The Government will furnish a 2-hour orientation training each option year. The Contractor shall be compensated for this training.

ROLE-PLAYER CONSENT TO PARTICIPATE IN CROSS GENDER SEARCHES
In order to teach current and future law enforcement personnel proper law enforcement techniques, the Federal
Law Enforcement Training Center (FLETC) conducts role-playing scenarios in which students engage in practical exercises involving body frisks and searches. These practical exercises at times require students to conduct body frisks/searches of contract role-players of the opposite sex ("cross gender searches"). They also involve the placement of students' and instructors' hands on all parts of a participant's body. Accordingly, cross gender searches may involve bodily contact by a member of the opposite sex that, in a different context, might be considered offensive or even criminal, including contact through the clothing with private body part s.
I understand the above purpose of cross gender searches. Furthermore, I understand that my participation as a role-player in cross gender searches is completely voluntary on my part. If I do not wish to participate in such cross gender searches, I understand that no reprisal action will be taken against me by the FLETC. If I do agree to participate in cross genera searches, I do so under the following terms:
• My participation in cross gender searches is completely willing and voluntary. I volunteer to participate in cross gender searches without any feeling of duress or pressure.
• I fully understand that I must wear some type of body-conforming material such as spandex under my clothing while participating in cross gender searches, so long as such use is approved by the instructors of the practical exercise.
• If, at any time during my participation in cross gender searches I become uncomfortable or embarrassed with the exercise, I may end my participation by clearly announcing "Out of role!" to the other participants in the practical exercise.
• I agree to full and permanently release the FLETC, the Department of Homeland Security, the United
States Government, and their subordinate units, officers, employees, agents, and servants from any complaint, claim, demand, damage action, liability, or suit of any nature whatsoever involving my participation in cross gender searches. The waiver of rights to legal action includes, but is not limited to, any complaints or appeals filed with the Equal Opportunity Commission (EEOC) and in any State or
Federal Court.
• I agree to indemnify, defend, and hold harmless the FLETC, the Department of Homeland Security, the
United States Government, and their subordinate units, officers, employees, agents, and servants from any complaint, claim, demand, damage action, liability, or suit of any nature whatsoever for or on account of any injury, loss, or damage to any person or property arising from or in any way connected with my participation in cross gender searches.
By my signature below, I certify that: 1) I have read and completely understand the above information; 2) I voluntarily consent to participate in cross gender searches as a role-player; and 3) I understand that I may rescind this consent at any time and request return of this form for destruction. If I have any questions regarding the above Information, I understand that I may pose them and receive answers before I sign this form.

1. I hereby acknowledge that I have received a security indoctrination concerning the nature and protection of information to which I have been provided conditional access, including the procedures to be followed in ascertaining whether other persons to whom I contemplate disclosing this information have been approved for access to it, and that I understand these procedures.

I will honor and comply with any and all dissemination restrictions cited or verbally relayed to me by the proper authority.
5. (a) For PCII - (1) Upon the completion of my engagement as an employee, consultant, or subcontractor under the contract, or the completion of my work on the PCII Program, whichever occurs first, I will surrender promptly to the PCII

(2) If the Authorized Entity is a United States Government contractor performing services in support of the PCII Program, I will not request, obtain, maintain, or use PCII unless the PCII Program Manager or Program Manager's designee has first made in writing, with respect to the contractor, the certification as provided for in Section 29.8(c) of the implementing regulations to the CII Act, as amended.
(b) For SSI and SBU - I hereby agree that material which I have in my possession and containing information covered by this Agreement, will be handled and safeguarded in a manner that affords sufficient protection to prevent the unauthorized disclosure of or inadvertent access to such information, consistent with the laws, regulations, or directives applicable to the specific categories of information. 6. I hereby agree that I will not alter or remove markings, which indicate a category of information or require specific handling instructions, from any material I may come in contact with, in the case of SSI or SBU, unless such alteration or removal is consistent with the requirements set forth in the laws, regulations, or directives applicable to the specific category of information or, in the case of PCII, unless such alteration or removal is authorized by the PCII Program

This may serve as a basis for denying me conditional access to other types of information, to include classified national security information
9. (a) With respect to SSI and SBU, I hereby assign to the United States Government all royalties, remunerations, and emoluments that have resulted, will result, or may result from any disclosure, publication, or revelation of the information not consistent with the terms of this Agreement.
(b) With respect to PCII I hereby assign to the entity owning the PCII and the United States Government, all royalties, remunerations, and emoluments that have resulted, will result, or may result from any disclosure, publication, or revelation of PCII not consistent with the terms of this Agreement.

United States Government and, with respect to PCII, the Authorized Entity, may seek any remedy available to it to enforce this Agreement including, but not limited to, application for a court order prohibiting disclosure of information in breach of this Agreement. I understand that if I violate the terms and conditions of this Agreement, I could be subjected to administrative, disciplinary, civil, or criminal action, as appropriate, under the laws, regulations, or directives applicable to the category of information involved and neither the United States Government nor the Authorized Entity have waived any statutory or common law evidentiary privileges or protections that they may assert in any administrative or court proceeding to protect any sensitive information to which I have been given conditional access under the terms of this Agreement.

11. Unless and until I am released in writing by an authorized representative of the Department of Homeland Security (if permissible for the particular category of information), I understand that all conditions and obligations imposed upon me by this Agreement apply during the time that I am granted conditional access, and at all times thereafter.
12. Each provision of this Agreement is severable . If a court should find any provision of this Agreement to be unenforceable, all other provisions shall remain in full force and effect.
13. My execution of this Agreement shall not nullify or affect in any manner any other secrecy or non-disclosure Agreement which I have executed or may execute with the United States Government or any of its departments or agencies.
14. These restrictions are consistent with and do not supersede, conflict with, or otherwise alter the employee obligations, rights, or liabilities created by Executive Order No. 12958, as amended ; Section 7211 of Title 5, United States Code
(governing disclosures to Congress); Section 1034 of Title 10, United States Code, as amended by the Military

Section 4(b) of the Subversive Activities Act of 1950 (50 USC 783(b)). The definitions, requirements, obligations, rights, sanctions, and liabilities created by said Executive Order and listed statutes are incorporated into this agreement and are controlling.
15. Signing this Agreement does not bar disclosures to Congress or to an authorized official of an executive agency or the
Department of Justice that are essential to reporting a substantial violation of law.
16. I represent and warrant that I have the authority to enter into this Agreement.
17. I have read this Agreement carefully and my questions, if any, have been answered. I acknowledge that the briefing officer has made available to me any laws, regulations, or directives referenced in this document so that I may read them at this time, if I so choose.
