52.212-2 Evaluation-Commercial Products and Commercial Services. (NOV 2021) (Deviation AUG 2025)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
The Government will evaluate quotations using the following factors, listed in descending order of importance:
1. Scheduling
2. Technical Approach
3. Price
Scheduling is more important than Technical Approach. Scheduling and Technical Approach, when combined, are more important than Price.
To be eligible for award, an offeror must:
• Attend the mandatory site visit;
• Submit a complete quotation;
• Receive an Acceptable rating under Scheduling and Technical Approach; and
• Offer a price determined fair and reasonable by the Government
The Government may communicate with Vendors, seek clarifications, or request revised quotations, if determined necessary. The Government reserves the right to issue an order without further exchanges.
Factor 1: Scheduling
The Government will evaluate the offeror’s proposed schedule to determine whether it demonstrates a feasible plan to complete removal, transportation, disposal, and required reporting within the 14-calendar-day period of performance.
The schedule shall identify:
• Mobilization and start of removal;
• Estimated daily removal or load capacity;
• Number and type of vehicles;
• Disposal-facility coordination and anticipated disposal dates;
• Final removal and disposal date;
• Dates for submission of load-level disposal documentation and the final disposal summary; and
Contingency actions for foreseeable delays, including vehicle or equipment failures, weather, site-access limitations, and disposal-facility availability.
Acceptable: The schedule demonstrates a realistic and feasible plan to complete all required work and reporting within 14 calendar days.
Unacceptable: The schedule does not demonstrate a feasible ability to complete the requirement within 14 calendar days or fails to address required disposal and reporting milestones.
Factor 2: Technical Approach The Government will evaluate the offeror’s technical approach to determine whether it demonstrates a safe, practical, and feasible method to perform the SOO requirements.
The offeror shall describe its approach for:
• Confirming that the proposed disposal facility is authorized and able to accept pressure-treated lumber before removal begins;
• Loading, securing, transporting, unloading, and disposing of the lumber;
• Providing sufficient personnel, equipment, vehicles, and supervision;
• Coordinating site access, loading activities, transportation, and disposal-facility deliveries;
• Tracking each load from removal through disposal-facility acceptance;
• Providing load-level disposal documentation no later than one business day after disposal; and
• Providing the final disposal summary and certification within two calendar days after disposal of the final load.
Acceptable: The approach demonstrates an adequate, safe, and feasible method to perform all material SOO requirements, including disposal-facility acceptance, loading, transportation, disposal, documentation, and final reporting.
Unacceptable: The approach fails to demonstrate an adequate or feasible method to meet one or more material SOO requirements.
Factor 3: Price The Government will evaluate the offeror’s total firm-fixed price for completeness and reasonableness.
The total evaluated price will be the offeror’s total firm-fixed price for complete performance of all SOO requirements. The proposed price must include all costs necessary to perform the requirement, including labor, equipment, loading, transportation, disposal fees, documentation, supervision, permits, insurance, taxes, and subcontractor costs.
The Government may use price analysis techniques, including comparison of proposed prices, the Independent Government Cost Estimate, historical prices, market research, or other appropriate methods, to determine whether the proposed price is fair and reasonable.
The Government may reject a quotation with incomplete, materially unbalanced, or unreasonable pricing.
Rating Definitions Rating Definition Acceptable The quotation meets the solicitation requirements for the factor.
Unacceptable The quotation does not meet the solicitation requirements for the factor.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
