Question/Comment FEMA Response
Could you please confirm the Fair Market Rent (FMR) for Iowa, as Figure 1 referenced in the SOW is missing?
The FY25 FRM for the counties in Iowa has been included under Figure 1 of the SOW.
It is possible to extend the time to report damages in the unit from 7 to 30 days?, in Iowa, under the UNIFORM RESIDENTIAL LANDLORD AND TENANT LAW, §562A.12, landlords have 30 days after a tenant moves out to return the security deposit or provide an itemized list of deductions for damages beyond normal wear and tear.
FEMA has determined that this will remain at seven (7) days due to the requirement to provide immediate occupancy for another applicant if needed. FEMA will be paying monthly rent on these units and seven (7) has been the standard for FEMA’s direct lease program.
In case of damages, will the security deposit be paid after each move-out or at the end of the lease? The security deposit should be paid upon move-out. If the unit is reassigned to a new applicant, the deposit should be restored to its original value to ensure consistent and fair treatment, covering damages as outlined by the FEMA Security Deposit policy.
Security deposits will be paid at the end of each lease.
Given that the Renewal / Notice to extend to property owners require 30-60 days' notice to them, can the notice period for the Option to Extend Services from FEMA be adjusted from 5 days to 30-60 days to ensure consistency?
FAR clause 52.217-8, Option to Extend Services will be adjusted from five (5) days to 30 days. FAR clause 52.217-9, Option to Extend the Term of the Contract will be adjusted to read “(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.”
