CALL GUIDE

Federal Emergency Management Agency Region 6

Texas

July 7, 2018

I. PORTABLE TOILET BPA ORDERING PROCEDURES

A. General Procedures:

1. The Portable Toilet BPA is structured for maximum efficiency in providing for an expedited ordering process in order to satisfy the needs of our customers.

2. Each Call will be competed and priced individually per requirement. There is a Price List Technical Exhibit F included in the Master BPA. The prices submitted will be utilized if a Call is needed upon urgency. When the purchase is competed, pricing shall not exceed the Price List that your company provided.

3. Each quote will be firm-fixed-priced, inclusive of prime labor, subcontract labor, resources, materials, supplies, supervision, overhead and other burdens, fee and profit, travel, and all other costs necessary to perform the Call in accordance with the PWS and in compliance with all appropriate environmental, statutory and regulatory guidelines.

4. Award of the BPA will be made utilizing the procedures described in FAR 13.106(a)(2), When soliciting quotations or offers, the contracting officer shall notify potential quoters or offerors of the basis on which award will be made (price alone or price and other factors, e.g., past performance and quality).

The Contracting Officer will be utilizing lowest price at technically acceptable, when a CALL is placed, delivery will also be a factor when cutting a Call. Award of a BPA establishes the technical acceptability of the offeror for the duration of the BPA, and will bind the Government when a Call is placed and accepted.

5. Following CALLS of the BPA, all CALLS will be competed among the BPA awardees, unless a disaster is declared under the Robert T. Stafford Disaster Relief and Emergency Assistance Act. IAW FAR Subpart 26.202 Local Area Preference – When awarding emergency response contracts during the term of a major disaster or emergency declaration by the President of the United States under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.5121, et seq.), preference shall be given, to the extent feasible and practicable, to local firms. Preference may be given through a local area set-aside or an evaluation preference, no separate justification is needed IAW FAR Subpart 6.208. If Unusual and Compelling Urgency is needed a determination by the Contracting Officer will be documented in the file.

6. Each contractor is required to submit a response to every CALL —see specific ordering procedures below. Negative replies to CALLs hinder the competitive nature of the BPA. The CALL Contracting Officer may meet with contractors who are not actively submitting quote probe deeper into their reasons for not competing at CALL, in an attempt to ascertain the corrective actions necessary to stimulate greater contractor participation.

7. The Contracting Officer will exercise broad discretion in awarding subsequent CALLs, considering the following before placing orders:

a. Price

b. Delivery Suspense

c. Potential impact on other orders placed with the contractor, i.e. resource loading/resource availability.

8. Past performance on earlier CALLS as well as current performance on existing CALLS will be considered when placing future CALLS. Contractors will be afforded an opportunity to provide information on problems encountered on earlier CALLS, and their corrective actions taken to remedy such problems in the future. The Contracting Officer shall consider this information, as well as information obtained from any other sources available to the Government, when placing future CALLs.

9. Each CALL will identify the type, location, quantity, required delivery date, duration, de-mobilization constraints, and quote response time. Each CALL will present a subset of the basic contract CLIN structure. However, an individual CALL may not utilize all basic contract CLINs. Each CALL will contain a blank pricing spreadsheet that reflects the CLINs utilized on that CALL. If the CALL is submitted based on a sole source, the contractor will be contacted prior to the award of the CALL to determine if they are capable of doing it. If the requirement is competed, prices shall not exceed the current price upon the Master BPA.

10. All CALLs will be executed as performance-based service acquisitions.

11. Orders may be issued at any time during the life of the blanket purchase agreement.

12. Funding will be at the disaster location annotated on the CALL.

B. Specific Procedures:

1. The Contracting Officer will receive and review the customer’s requirement for feasibility, applicability, and reasonableness as a candidate for a BPA CALL.

2. Unless a declared disaster has occurred and the Robert T. Stafford Act is in affect or urgent and compelling, the Contracting Officer will issue an electronic RFQ to each BPA contract holder. Each request for quote will be issued as an email with attachments.

3. Instructions, response time, and a blank pricing spreadsheet will be included with each Request for Quote email.

4. Each contractor is required to submit a response to every RFQ. Failure to provide a timely response to an RFQ will deem the offeror as non-responsive, and will be documented as part of a contractor’s past performance.

5. A contractor’s response will take one of the following two formats:

a. Negative reply. The contractor informs the Government via reply email that they choose not to submit a quote for this particular quote. The negative reply will state the reason why the contractor elects not to submit to a proposal.

b. Quote. The contractor submits a quote in accordance with the instructions contained in the email Quote. When submitting a quote, the contractor must propose pricing on all the requested CLINs of the CALL by completing and returning the pricing spreadsheet. Partial pricing will not be accepted, and will render the offeror as non-responsive to the quote. The total evaluated price will be the sum total of the completed pricing spreadsheet.

6. In rare instances, oral CALL responses may be considered. In those cases, the Contracting Officer will document the procurement and the actions taken accordingly.

II. Purchase Limitation

BPA Single Call Limit = $99,000.00

BPA Master Dollar Limit = $495,000.00 for the Ordering Period of five years.

The dollar limitation may not be exceeded except by bilateral modification to accommodate additional needs of the agency.

III. ADDITION OF CLAUSES AT CALL LEVEL

Clauses may be added at the CALL level as long as they do not conflict with clauses included in the basic BPA contract. For example, Option Clauses 52.217-8 titled Option to Extend Services and, 52.217-9 titled Option to Extend the Term of the Contract may be included and tailored at the CALL.

IV. TRAVEL & OVERTIME

Each CALL will be awarded as a firm-fixed-price requirement, inclusive of all costs necessary to ensure successful performance. There are no separate allowances for travel, travel time, or overtime.
