About this file

This Sole Source Justification (SSJ) document details the Department of Homeland Security (DHS), Federal Emergency Management Agency's (FEMA) intent to procure five Multiquip, Inc. trailer-mounted generators with a Prime Rating in the 45Kw-70Kw range for its five Mobile Emergency Response Support Detachments. The procurement includes specific generator models (DCA70SSIU4F), trailers (TRLR70USE), accessories like low coolant shutdown kits, storage boxes, and on-site training, with a total estimated value redacted.

FEMA justifies the sole source procurement by noting that Multiquip, Inc. is the only manufacturer capable of meeting their requirements, and they currently have over 20 similar Multiquip generators. The agency conducted market research confirming that all FEMA Distribution Center generators under 400KW are Multiquip products. By maintaining this brand consistency, FEMA aims to streamline parts and repairs, reduce maintenance costs, and leverage existing knowledge of the equipment. The procurement will follow FAR 13.5 Simplified Procedures and will include a combined synopsis solicitation to ensure an efficient and competitive process.

Certain Commercial Products and Commercial Services and specifically under FAR 13.501

Special Documentation Requirements, where acquisitions conducted under Simplified

Acquisition Procedures are exempt from the requirements of FAR Part 6 but still require a justification using the format of FAR 6.104-1 (FAR Class Deviation 25-11). As provided under

FAR 13.501, this justification is modified to reflect that the procedures under FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 – Simplified Acquisition Procedures.

4. Identification of the authority. This action is being taken in accordance with FAR 13.5

Simplified Procedures for Certain Commercial Products and Commercial Services. As provided under FAR 13.501, this justification is modified to reflect that the procedures under

FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 – Simplified Acquisition

Procedures.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

DHS/FEMA intends to procure a brand name specification for trailer mounted generators and equipment under the authority of FAR 13.501, restricting consideration to only one responsible source and no other supplies or services will satisfy agency requirements Only one source is capable of providing the trailer mounted generators and equipment because the Multiquip, Inc.

equipment is unique or highly specialized. Pursuant to FAR 13.501, this brand name specification must be used because it was concluded that in order to build a generator fleet of similar manufacturer of trailer mounted generator and to take advantage of only stocking similar parts and maintaining current knowledge of similar generators, have this procurement as a Brand

Name Justification was the only way to accomplish this. The six Mobile Emergency Response

Support Detachments already have over 20 Multiquip generators that have a predominance of the same parts that can be interchanged and reducing the knowledge gap

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

A combined synopsis solicitation will be submitted to ensure that the solicitation process is efficient, competitive, and supportive of small businesses. Multiquip, Inc. is a small businesss that provided an authorized resellers list of the brand name items. The resellers provided are small businesses.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will determine that anticipated prices will be fair and reasonable in accordance with FAR 13.106-3(a)(1), competitive quotations.

8. Description of market research.

DECD conducted market research and found that all of the FEMA Distribution Center’s generators, 400KW and below are all Multiquip, Inc.’s. The results of the market research indicates other companies’ similar products lack the particular feature(s) required and do not meet, or cannot be modified to meet, the needs of DHS. Procuring an alternate product based on salient characteristics other than Multiquip will significantly increase the maintenance and procurement cost. These costs include the lack of knowledge of the equipment will be lost and additional training.

10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition. None.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required. (Include a statement of actions taken or will be taken to increase competition for future acquisitions of the same item/service).

DECD intends to analyze the existing and emerging requirements to determine if restricting competition to the brand name product can be cost effectively removed. However, at this time all of the FEMA Distribution Center’s generators, 400kw and below are all Multiquip, Inc. brand name products. Multiquip, Inc. is the original equipment manufacturer (OEM) and sole distributor of the equipment. Furthermore, DECD anticipates a strong competitive landscape at that time.
