| Q&A #67, PWS 4.1.2.5, Page 20 | The government response to the initial question is "Contractor will be required to have insurance or pay for damages." Based on that response, following are additional questions: (1) Does the government currently provide insurance for liability and physical damage of the vehicles identified in Attachment 17; (2) The government has indicated that the contractor is responsible to have insurance but the government has not provided the specific insurance requirements. Please identify the requirements; (3) Can the contractor negotiate to keep existing insurance, if it exists? If so, please provide the current insurance information; (4) When the vehicles are parked in the lot on the government facility and not in the care, custody and control of the contractor, who is responsible for the vehicles? | 1) Unless otherwise provided by the contract, the contractor is liable for any lost, damaged, or destroyed Government property except for reasonable fair wear and tear. When applicable, the contractor may receive relief as stated in FAR 45.503, "Relief of Responsibility." (PWS, 4.3.5, pg 22) Also, PWS, 4.3.1, pg 21, states the contractor shall be responsible for the cost of any repairs or replacement caused by negligence, or abuse, by the contrqactor or his/her employees. 2) Refer to Special Contract Requirements, H.10 Liability Claims, pg 22. 3) Will need to be addressed with the incoming/outgoing contractor. 4) Per PWS, 4.3.6, pg 23, when property is furnished by the Government (Government Furnished Property) or acquired by the contractor (Contractor Acquired Poperty) and placed in the contractor's custody, the contractor becomes accountable and responsible for that property until relieved in writing by the Contracting Officer. |
