SYNOPSIS OF A PROPOSED FULL AND OPEN COMPETITIVE

SOLICITATION FOR THE ACQUISITION OF THREE (3) CONTRACT

DETENTION FACILITIES (CDF) IN THE HOUSTON, TX AND SAN ANTONIO,

TX AREAS OF RESPONSIBILITY (AOR)

(16) Description: The Department of Homeland Security (DHS), U.S. Immigration & Customs Enforcement (ICE), Enforcement and Removal Operations (ERO), requires three (3) different Contractor-Owned/Contractor-Operated detention facilities (existing or renovated) within the ERO Houston and San Antonio Areas of Responsibility (AOR).

The facilities shall be turnkey ready at the beginning of contract performance and able to provide housing, medical care, transportation, guard services, meals, and the day to day needs for ICE detainees. Due to mission needs, proposals for new construction will not be accepted for this solicitation.

The specific requirements are as follows:

• One facility or several facilities shall house approximately 2,000 adult male and female detainees within the San Antonio AOR (hereby referred to as “Requirement A”). Requirement A shall be located within 50 miles from the San Antonio Field Office located at 1700 NE Loop 410, San Antonio Texas 78217, to maximize transportation and manpower efficiencies, and no more than 30 driving miles from a major hospital and emergency services. The facility(ies) shall have access to public and commercial transportation routes and services and must be located 90 driving miles or less from San Antonio International Airport (SAT).

The facility(ies) is (are) expected to house Level 1, 2, and 3 risk detainees

At minimum the proposed facility(ies) will require:

o This facility will have transgender detainees (see U.S. ICE Guidance Regarding the Care of Transgender Detainees, Policy 11065) o A transportation hub for picking up and dropping off ICE detainees.

o Administrative segregation for male and female detainees o Required medical administrative facilities (ICE provides approximately 90 medical staff) o Office and Administrative Space (ICE provides approximately 100 medical staff) o Secured Parking for approximately 400 spaces (including bus parking)

• A second facility or facilities is required to house approximately 520 adult female detainees within the San Antonio AOR (hereby referred to as “Requirement B”).

The facility(ies) must be located within 50 driving miles from Austin-Bergstrom International Airport and no more than 30 driving miles from a major hospital and emergency services. The facility(ies) shall have access to public and commercial transportation routes and services. The facility(ies) is (are) expected to house Level 1 risk detainees.

At minimum the proposed facility(ies) will require:

o A transportation hub for picking up and dropping off ICE detainees.

o Administrative segregation for female detainees o 5 court rooms o Required medical administrative facilities (ICE provides approximately 45 staff) o Office and Administrative Space for approximately 30 staff o Secured Parking for approximately 30 spaces (including bus parking)

• A third facility or facilities is required to house approximately 1,000 adult male and female detainees within the Houston AOR (hereby referred to as “Requirement C”). These detention services must be performed within 50 driving miles from the Houston Field Office located at 126 Northpoint Drive, Houston, TX 77060, and must be within 15 driving miles or less from the George

Bush International Airport of Houston. The facility(ies) can be no more than 30 miles from a major hospital and emergency services. The facility(ies) shall have access to public and commercial transportation routes and services. The facility(ies) is (are) expected to house Level 1, 2, and 3 risk detainees.

At minimum the proposed facility(ies) will require:

o This facility may have transgender detainees (see U.S. ICE Guidance Regarding the Care of Transgender Detainees, Policy 11065) o Administrative segregation for male and female detainees o A transportation hub for picking up and dropping off ICE detainees.

o Required medical administrative facilities (ICE provides approximately 60 medical staff) o 3 court rooms o Office and Administrative Space for approximately 65 staff o Secured Parking for approximately 300 spaces (including bus parking) o Contractor will be required to house an exterior, temporary, 2,000-gallon

(all exclusive) fuel tank on skids. ICE may utilize a portion of the contractors concrete parking area for short term storage of the fuel tank in emergency situations.

Each facility shall be managed and operable 24 hours a day, 7 days a week for 365 days a year, including any leap years. The services at all three (3) facilities shall be conducted in accordance with industry standards and ICE’s Performance Based National Detention Standards (PBNDS) 2011, as revised in 2016, as well as applicable federal, state, and local laws, regulations, codes, guidelines, policies and standards. The facilities must meet the requirements of the DHS Final Rule, 6 CFR Part 115, Standards to Prevent, Detect, and Respond to Sexual Abuse and Assault in Confinement Facilities, also known as the DHS Prison Rape Elimination Act (PREA) Standards applicable to immigration detention facilities.

For all three (3) requirements listed above, the contractor shall agree that the facility(ies) is/are to be for the exclusive use of ICE and the ICE detainee population. No other agency will be allowed to use the facilities to house detainees, prisoners, or inmates without prior approval of the Contracting Officer’s Representative (COR) or ICE-designated employee.

The procurement will be a full and open competition. The solicitation is expected to be posted around October 15, 2019. This procurement is expected to award three (3) separate Indefinite Delivery Indefinite Quantity’s (IDIQ) with firm-fixed price unit prices and some labor hour CLINs. Each IDIQ will have a separate ten (10) year period of performance for the base period and all option periods, with an initial one (1) year base period, including a 60-day transition in the base period, and (9) nine one (1) year option periods.

Each requirement (A, B, and C) will be evaluated independently and in two phases.

Phase I will evaluate a proposed facility(ies) Environmental Assessment. This evaluation will determine whether a proposed location is “sufficient” (Contains sufficient information for ICE to conduct a complete analysis demonstrating an overall understanding of NEPA requirements) or “insufficient” (Environmental Assessment provided lacks understanding of NEPA requirements and would require complete or significant retesting and document generation). If a proposed location’s Environmental Assessment is found to be insufficient, the offeror’s proposed location will no longer be considered for award and proposed location will not move to Phase II. Phase II will evaluate technical, past performance, and pricing proposals. The instructions for this phase will be provided in the RFP.

The Government’s expected plan for evaluation and award is; Requirement A, then Requirement B, then Requirement C. Each requirement is expected to have its own due dates and timelines, which will be clearly defined in the RFP, timelines and deadlines may run concurrently between Requirements. Prospective offerors may propose on any Requirement, and will not be mandated to propose on all three Requirements.

The Government is providing this synopsis early with the understanding that prospective offerors will use this time to initiate development of Environmental Assessments for project proposals consistent with the information provided in this synopsis. Due to the early synopsis release, the time to complete the Environmental Assessment may be limited. The currently anticipated period from RFP release to the due date of the Environmental Assessment for Requirement A will be two weeks, with the following two weeks currently anticipated to be for evaluation of the Environmental Assessments submitted for Requirement A. This anticipated timeline is to maintain the procurement schedule and meet ICE’s mission needs. However, prospective offerors should be aware that the procurement timeline remains subject to change by the Government based on mission needs and other factors.

The intent of this notice is to provide the pre-solicitation notice required by FAR 5.2, Synopsis of Proposed Contract Actions, in preparation for the release of the Request for Proposal (RFP).

(17) Place of Contract Performance:

• Requirement A: Requirement A shall be located within 50 driving miles from the San Antonio Field Office located at 1700 NE Loop 410, San Antonio Texas 78217. The facility must be no more than 30 driving miles from a major hospital and emergency services (medical, fire, law enforcement, etc.). The facility must be located 90 miles or less from San Antonio International Airport (SAT).

• Requirement B: These detention services will be performed in the Austin, Texas area. The facility(ies) must be located within 50 driving miles or less from Austin-Bergstrom International Airport and no more than 30 driving miles from a major hospital and emergency services.

• Requirement C: These detention services must be performed within 50 miles from the Houston Field Office located at 126 Northpoint Drive, Houston, TX 77060 and within a fifteen driving miles of the George Bush Intercontinental Airport (IAH) located in Houston, Texas. The facility(ies) must be no more than 30 driving miles from a major hospital and emergency services.
