Evaluation - Environmental Information will be requested of offerors regarding past environmental activities and the environmental condition of the proposed site and institution. Environmental documentation and other information will be required in order to comply with the National Environment Policy Act of 1969 (NEPA) prior to award. The Government will independently evaluate and verify the accuracy of the environmental documentation submitted in accordance with this solicitation.

The Government reserves the right to eliminate proposals based on the adequacy of the documentation provided by the offeror or the potential impact to the quality of the human environment. For example, the Government reserves the right to eliminate proposals if, in the opinion of the Government, significant impacts deduced by environmental analysis would place in jeopardy the Offeror’s ability to obtain a Notice to Proceed within the required timeframes identified in the Request for Proposal (RFP). Similarly, environmental permits or other parallel requirements under NEPA and outside the direct control of Immigration and Customs Enforcement may place in jeopardy the Offeror’s ability to obtain a Notice to Proceed within required timeframes. Therefore, environmental submittals that do not provide the information necessary to ensure that the proposal actions and ICE’s environmental review can be completed within the required timeframes presented in the proposal may place in jeopardy the Offeror’s ability to obtain a Notice to Proceed and cause the Government to eliminate the proposal.

The Government reserves the right to disclose or make public any environmental documentation or other information provided under this section. Such disclosures would typically occur in Environmental Impact Statements, Environmental Assessments, public hearing, comment periods and other public forums.

The environmental proposal will be rated based on the following table:

Rating Symbol Definition Sufficient S Contains sufficient information for ICE to conduct a complete analysis. Environmental Assessment which demonstrates overall understanding of NEPA requirements.

Corrections and clarifications may be needed, however they are not expected to fundamentally change the proposed Environmental Assessment.

Insufficient I Fails to contain sufficient information for ICE to conduct a complete analysis. Environmental Assessment provided lacks understanding of NEPA requirements.

Environmental Assessment would require complete or significant retesting and document generation.

Sufficient information is defined as: meeting substantially requirements of the J-14 NEPA attachment in a way that does not require proposal revisions which would fundamentally change the proposal. A rating of insufficient will result in the entirety of the offeror’s proposal being eliminated from consideration for award.
