About this file

This document is a justification and approval for other than full and open competition for a brand name only acquisition of Safariland-brand Miniature Red Dot Sight (MRDS) compatible handgun holsters and accessories for the U.S. Customs and Border Protection (CBP).

The key details are:

  • CBP intends to award a single, three-year indefinite delivery, indefinite quantity (IDIQ) contract for MRDS compatible duty handgun holsters and accessories.
  • After initial market research, CBP determined that only Safariland-brand holsters meet the required specifications, including an internal locking mechanism that secures the handgun by the ejection port with a thumb-release.
  • Following the initial solicitation, CBP became aware of an additional holster system with a similar retention mechanism. However, this holster still does not meet all of CBP's minimum requirements, such as compatibility with authorized handgun-mounted lights and the ability to increase/decrease retention levels.
  • Therefore, CBP has determined that Safariland remains the only manufacturer that can fully meet the agency's operational needs at this time.

Attachment 1 U.S. Customs and Border Protection

Justification and Approval For Other Than Full and Open Competition Brand Name Only Safariland MRDS Compatible Holsters

Version 4.0 Update 2024

Addendum to Previously Approved

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION BRAND

NAME ONLY

Date: July 22, 2024 PR: 20144177

1. Identification of Agency and Contracting Activity.

Department of Homeland Security (DHS), U.S. Customs and Border Protection (CBP), Office of Acquisition (OA), Procurement Directorate (PD), of behalf of the Law Enforcement Safety and Compliance (LESC) Directorate proposes to enter into a contract that shall be on a basis other than full and open competition for a Brand Name Only acquisition for handgun holsters that are compatible with Miniature Red Dot Sights (MRDS).

2. Background of Actions Taken to Date.

CBP intended to procure, on a brand name only competitive basis, Miniature Red Dot Sight (MRDS) compatible duty handgun holsters and two (2) accessory items (belt loop and quick locking system) and plain clothes officers/agents in conjunction with the authorization, issuance, and installation of MRDS on Glock duty handguns. This action would result in a three-year indefinite delivery, indefinite quantity (IDIQ) contract.

CBP previously issued Request for Quote (RFQ) 70B06C24Q00000175 on System for Award Management (SAM) on July 3, 2024 with quotes due July 29, 2024. The RFQ included brand name specifications and a properly documented and approved Justification for Other than Fully & Open Competition Brand Name Only (Justification) for Safariland-brand holsters. After posting of the RFQ, additional market research was conducted due to additional information brought to the attention of the Government. The purpose of this addendum to the originally approved Justification is to document those findings.

3. Description of Supplies/Services.

The basic requirement is to provide a new MRDS compatible duty holster for the impending issuance and installation of MRDS on currently issued service handguns. The original Justification included a description of the supplies to be provided, to include a description of the basic requirements of the holsters. Specifically, the Justification identified a need for an internal locking mechanism that secures the handguns through the ejection port, with a thumb-release mechanism, so as to maintain consistency with currently-issued duty handgun holsters purchased through Safariland.

In addition to the need for this thumb-release retention mechanism, CBP also requires the following minimum specifications for their holsters based on safety and operational needs of CBP agents and officers:

Uniform duty holsters (both right-hand and left-hand versions), with same previously identified retention system, specifically designed to fit the Glock Gen 5 models 47 and 19;

Plain clothes holsters (both right-hand and left-hand versions), with same previously identified retention system, designed to be worn outside the waistband (OWB) specifically designed to fit the Glock Gen 5 models 47, 19, and 43X;

The uniform duty holsters must be light bearing holsters capable of accepting ALL handgun mounted lights authorized for operational use within CBP;

The holster must be a complete holster system to include: belt mounting bracket, holster, and mounting hardware, consisting of only Original Equipment Manufacturer (OEM) components;

The uniform duty holster belt mounting bracket must be designed to accept duty belts

The duty holsters must have the capability of covering the MRDS while in the holster to protect the optic from environmental conditions;

The holster manufacturer must offer the uniform duty holster in black as well as Cordura wrapped multi-cam exteriors; and

Uniform duty holsters must have the capability to increase or decrease the levels of retention based on the individual officer/agent operational needs.

Alternatives to the specified holsters shall not be accepted as they fail to incorporate or address some of the basic requirements stated above which are necessary to comply with CBP firearm safety standards/procedures/policies and/or operational needs based on specific

4. Description of Supplemental Market Research.

CBP previously conducted thorough market research that was properly documented in the contract file and published Justification. The previously published Justification documented that Safariland-brand holsters utilize an internal locking mechanism (i.e., ALS) that secures the weapon by the handguns ejection port, which releases with a thumb drive, resulting in a safe locking mechanism in all CBP operational environments. As part of market research conducted in early CY2024, CBP was not aware of any similarly designed holster systems in production. This led to the determination that only Safariland-brand holsters could meet

In July 2024, in response to the published RFQ and Justification, CBP LESC became aware of a second holster, made by , that utilizes a similar thumb released, internal ejection port locking system. During the market research phase, which occurred in earnest between January and April 2024, this holster was not a completed product and was still in the design/prototype phase, thus its lack of inclusion in the original documentation. However, upon being notified of its availability, CBP conducted additional market research on this holster system, known as the

. A review of the holster system determined that it failed to meet several minimum requirements for holster.

5. Demonstration That the Nature of the Acquisition Requires Use of the Authority Cited.

The original Justification posted to SAM in support of RFQ 70B06C24Q00000175 cited statutory authority permitting other than full and open competition is 41 U.S.C. § 3304(a)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302- One Responsible Source and No Other Supplies or Services Will Satisfy Agency

-name description. The Justification cited the acquisition of patented Safariland-brand MRDS holsters a rements, thereby precluding consideration of a product manufactured by another company.

A review of information that came to the attention of CBP after the posting of the J&A does not change the authority cited, though CBP does recognize there are additional holsters utilizing a similar retention system as Safariland. However, after consideration of all of to include a thumb-release ejection port locking mechanism and those additional requirements identified in Section 3 above, it is determined that Safariland continues to be the only manufacturer that can meet all of the performance specifications needed for CBP operations at this time, which is summarized in Table 5.1 below.
