About this file

This is a Questions and Answers document for federal contract opportunity 70B03C26R000000031 for Mobile X-Ray Inspection Vehicles. The document clarifies technical, contractual, and operational requirements for CBP (Customs and Border Protection) procurement of dual-view mobile x-ray systems designed for inspecting passenger baggage and parcels at U.S. ports of entry.

Key technical requirements include: maximum vehicle dimensions of 250" length, 96" width without mirrors, and 98" height; Gross Vehicle Weight Rating not to exceed 9,500 lbs to avoid requiring commercial driver's licenses; Windows-readable image formats (JPG, TIFF) rather than UFF or DICOS for small-scale systems; dual-view x-ray capability only (single-energy systems not acceptable); optional cold weather packages for operation at temperatures as low as 10°F; 25-foot retractable grounding reel for airport operations; and configurable operator stations for right or left-handed use. The systems must meet all IT security requirements and be capable of secure internal data transmission and image export in standard formats, but do not require integration with CBP enterprise infrastructure. Both panel van and box truck configurations are acceptable, as are internally or externally mounted operator stations. Contractors must price a minimum five-year failure-free warranty including corrective and preventive maintenance and conveyance as part of CLIN 10. CONUS shipping costs should be built into system pricing, while OCONUS shipping will be included as an adder in delivery orders. The Project Management Plan is due within 14 days of first delivery order award, not with the proposal. Internationally manufactured chassis are acceptable if fully compliant with applicable U.S. regulations including 49 CFR and Trade Agreements Act requirements. The Government requires unlimited data rights for all deliverables to ensure full operational, maintenance, and training capability. For corrective maintenance, contractors must attempt remote troubleshooting first and provide 2-week advance notice for scheduled non-emergency visits, while urgent failures require immediate coordination with the ILD Maintenance Dispatch Center. The final delivery timeline requires the first system within 120 days of delivery order receipt, followed by two systems per month thereafter, though the Government may negotiate alternative schedules based on circumstances outside contractor control.

This procurement is subject to the Trade Agreements Act, which has now been included by reference.

The Buy American Act does not apply because it is waived where the trade agreements apply.

Q17.

70B030C26R00000031 NII Mobile XRay, Section II Contract Clauses Question:

The RFP does not contain FAR 52.227-14 Rights In Data – General, or any other data rights clause. Given that the RFP contemplates data being produced, furnished, and/or acquired (including software), please add FAR 52.227-14, using Alternates II and III to allow for the delivery of limited rights data and restricted rights software.

Answer:

The Government does not intend to incorporate Alternates II and III of FAR 52.227-14 for this procurement. The program requires unlimited data rights for all deliverables produced under the contract to ensure full operational, maintenance, and training capability. All deliverables must be provided free of proprietary claim and with unlimited rights as defined in FAR 52.227-14. If there are exceptional circumstances or specific commercial items where limited rights may be appropriate, offerors should raise these concerns for Government consideration, but the baseline requirement is unlimited rights.

Q18.

Attachment 1 SOW, 3.12.1 Technical Documentation, Page 43 Requirement: Section 3.12.1 states that “Technical Documentation shall consist of all documentation used by the Contractor and all Subcontractor’s in the production of the LS-NII system and any follow-on production or modification.”

Question:

Given that the Government is seeking to procure commercial products under the Solicitation, will the Government amend the Solicitation to confirm that offerors are not required to deliver any technical data, technical information, or computer software documentation unless it is customarily available to the public, consistent with FAR 12.211 and FAR 12.212(a)?

Answer:

The FAR Part 12 citations provided within the question are not applicable to this acquisition as the Revolutionary FAR Overhaul (RFO) version of Part 12 is instead applicable. However, consistent with

Mobile X-Ray Inspection Vehicles RFO 12.106 and RFO 12.107, the Government shall acquire only the technical data and the rights in that data customarily provided to the public with a commercial product or process.

Q19.

Attachment 1 SOW, 3.12.1 Technical Documentation, Page 43 Requirement: Section 3.12.1 of the SOW grants the Government “unlimited data rights . . . to all data in the Technical Documentation file for the purposes of maintaining the LS-NII system and training LS-NII system operators and Maintenance Technicians.”

Question:

Please clarify the apparent ambiguity of this sentence in Section 3.12.1, which purports to both grant the Government “unlimited data rights” while at the same time limiting such rights to only those “purposes of maintaining the LS-NII system and training LS-NII system operators and Maintenance Technicians.” Is it the Government’s intent to obtain a license that is limited to use of such data for “purposes of maintaining the LS-NII system and training LS-NII system operators and Maintenance Technicians,” rather than full “unlimited rights” as defined in FAR 52.227-14?

Answer:

No, the Government’s intent is not to obtain a license that is limited in use. The Government’s intent is to obtain full unlimited rights as defined in FAR 52.227-14. The language referencing “purposes of maintaining the LS-NII system and training LS-NII system operators and Maintenance Technicians” is descriptive of the primary expected uses and does not restrict the scope of the Government’s rights. In practice, these rights will be exercised internally and only on a need-to-know basis within the agency, but the legal rights granted are unlimited.

The reference to LS-NII system has been revised to state Small-Scale (SS) NII system.

Q20.

Attachment 1 SOW, 3.12.1 Technical Documentation, DID A017, Pages 43, 74-75 Requirement: Section 3.12.1 states, in part, that “[d]ata initially produced under this contract shall be conveyed to Government free of proprietary claim. DID A017 includes similar language.”

Question:

Please confirm that these sentences are intended to be interpreted as granting the Government unlimited rights to such data consistent with FAR 52.227-14.

Answer:

Yes, these sentences are intended to be interpreted as granting the Government unlimited rights to such data, consistent with FAR 52.227-14. This means the Government may use, modify, reproduce, release, perform, display, or disclose the data in any manner and for any purpose. In practice, the Government will exercise these rights internally and only on a need-to-know basis.

Q21.

Attachment 1 SOW, 3.9.2.2 Ownership, Page 39 Requirement: Section 3.9.2.2 of the SOW states that “[a]ll training products . . . become the property of the United States Government upon delivery and acceptance by the government,” and that “[a]ll rights for use, modification, and repurposing of the training in whole or in part shall belong to the Government.”

Question:

Please clarify whether the successful offeror will retain ownership of training products that constitute technical data or computer software and that the Government will receive a license consistent with FAR

Mobile X-Ray Inspection Vehicles 52.227-14, FAR 12.211, and FAR 12.212.

Answer:

The successful offeror will not retain ownership of training products delivered under the contract. Upon delivery and acceptance, all training products become the property of the United States Government, and the Government receives unlimited rights as defined in FAR 52.227-14. This applies to both technical data and computer software. For commercial items, the Government’s rights will be consistent with RFO 12.106 (technical data) and RFO 12.107 (computer software), but the SOW requires unlimited rights for all deliverables produced under the contract.

Q22.

Attachment 1 SOW, DID A007 Operator’s Training Materials, DID A009 Service and Maintenance Manual, Pages 64, 67 Requirement: DID A007 states that the deliverable will be provided “free of trademark, copyright and/or proprietary claim by the Contractor, and with the unlimited right of alteration, reproduction and/or distribution within the Government.” DID A009 similarly states that deliverables “shall be free of trademark and proprietary claim by the Contractor, and with the unlimited right of alteration, reproduction and/or distribution within the Government.”

Question:

Please confirm that the Government only intends to use, alter, reproduce, and distribute these deliverables within the Government, and please clarify that successful offeror may mark such deliverables to reflect such Government rights.

Answer:

The Government may use, alter, reproduce, and distribute these deliverables within the Government.

The Government is not authorized to release these deliverables outside the Government or to parties without a legitimate need-to-know. Offerors may mark deliverables to reflect the Government’s unlimited rights, but such markings must not restrict the Government’s ability to use, modify, or distribute the deliverables internally.

Q23.

The SOW specifies a maximum vehicle height of 98 inches.

Question:

We request confirmation whether this is a strict requirement, or if a higher vehicle height (e.g., up to approximately 118 inches) may be considered acceptable, provided all operational and safety requirements are met.

The maximum height requirement of 98 inches is a strict requirement.

Q31.

Attachment 1 SOW Mobile X-Ray 3.7 Corrective Maintenance during the Warranty Period (Page 21/22):

Contractor will provide NIID with a 2-week advanced notice for all site visits.

Question:

Please clarify that this 2-week advance notice is for non-system failure visits?

Answer:

The 2-week advance notice requirement is primarily intended for scheduled, non-emergency site visits, such as preventive maintenance or planned activities, to allow for proper coordination, security clearances, and minimal disruption to port operations. For corrective maintenance in response to system failures or urgent issues, the contractor should follow the response timelines and procedures specified in the SOW, which may require more immediate action. In such cases, the contractor must coordinate with the ILD Maintenance Dispatch Center (MDC) and the Government points of contact as soon as possible to arrange timely access.

The contractor must first attempt to troubleshoot issues remotely/telephonically. If on-site corrective maintenance is required, the contractor must notify the ILD MDC and provide updates, including ETA for parts and technician arrival. For urgent corrective maintenance, the 2-week advance notice may not be required; the contractor should coordinate access as soon as possible.

Q32.

3.1.1 – Item #3: Gross Vehicle Weight Rating: Not to exceed 9,500 lbs.

Question:

Previously, the Mobile X-Ray Inspection Vehicle provided for a Gross Vehicle Weight Rating of 11,500.

Would an 11,500 lbs. Gross Vehicle Weight Rating be acceptable to CBP still? Other mobile/portable NII systems require a weight of 16,060 lbs. (for RPVSS) and 26,000 lbs. (for Medium Energy Mobile).

Will the Mobile X-Ray Inspection Vehicles be driven on the same surfaces as the RPVSS and Medium Energy Mobile units?

Answer:

CBP requires Dual View Mobile X-Ray Vehicle to provide officers with a mobile x-ray capability to conduct NII of passenger baggage and parcels at U.S. land, air, and sea ports of entry (POEs). These are considered small-scale mobile systems. The Mobile X-Ray Vehicles’ gross weight shall not exceed 9,500 lbs.

Mobile X-Ray Inspection Vehicles The other two systems mentioned are large-scale mobile systems and are used for scanning passenger and cargo vehicles. They provide CBP with completely different capabilities.

Q33.

3.1.1 – Item #17: Auxiliary climate control system: Low profile if roof mounted (vehicle height not to exceed 96”), capable of cooling/heating, the x-ray unit, and other sensitive components during operation as required.

Question:

Should this instead read as “vehicle height not to exceed 98” to coincide with requirements #13 and #14 in Section 3.1.1?

Answer:

Please see answer to Q6 above.

The Vehicle height shall not exceed 98”.

Q34.

3.2.5 – Item #7 Operator’s station must be configurable for right-handed or lefthanded operations and shall be attached and facilitate ease of set-up.

Question:

Does this imply that the x-ray unit itself is capable of bi-directional scanning? Or is there a preference as to which side of the vehicle is configured as the entrance vs. exit for scanning purposes?

Answer:

The requirement that the operator’s station be configurable for right-handed or left-handed operations refers specifically to the ergonomics and usability of the operator controls, ensuring that both right-hand dominant and left-hand dominant personnel can operate the system comfortably and efficiently. It does not imply that the x-ray unit itself must be capable of bi-directional scanning. However, please note that bi-directional scanning and auto-return are separate operational requirements specified elsewhere in the SOW. There is no preference regarding which side of the vehicle is configured as the entrance or exit for scanning purposes, as long as all operational requirements are met.

Q35.

The deadline for receipt of proposals for this requirement is: Monday, April 6, 2026 at 10:00AM PT.

Question:

Realizing a different NII solicitation has a proposal due date the week prior to April 6th, would CBP considering extending the proposal due date for the Mobile X-Ray Inspection Vehicles to April 17th (the end of the week following April 6th)?

The Government does not intend to extend the deadline for receipt of proposals.

Q36.

Past Performance Questionnaire (Attachment 2):

The solicitation states that references are to submit completed questionnaires directly to the Contract Specialist. As submission of these questionnaires is outside the direct control of the offeror, please confirm how the Government will evaluate past performance in instances where a reference does not submit the questionnaire by the required deadline.

Question:

Mobile X-Ray Inspection Vehicles Specifically, will an offeror be negatively impacted if a reference fails to provide the requested information in time despite the offeror’s good-faith efforts to ensure submission?

Answer:

No, an offeror will not be negatively impacted if a reference fails to provide a completed Past Performance Questionnaire by the required deadline, provided the offeror made a good-faith effort to ensure submission. The Government will evaluate past performance based on all available information, including, but not limited to, questionnaires received, information from the Contractor Performance Assessment Reporting System (CPARS), and other sources as outlined in the solicitation. If no relevant past performance information is received, the offeror will be rated as “Neutral” in accordance with the solicitation instructions, meaning they will not be evaluated favorably or unfavorably for past performance.

Q37.

Delivery Timeline vs. Final Configuration Review (FCR):

Section 1.7 (Delivery) requires delivery of the first system/unit within 120 days, while Section 3.11.6 (Technical Reviews) indicates that the Final Configuration Review (FCR) will occur 120 days after each Delivery Order award. Given this alignment, please clarify whether the Government intends for the FCR to occur prior to delivery of the initial unit or if delivery is expected before completion of the FCR.

Additionally, please confirm whether the delivery timeline for the first unit may be extended (e.g., 240– 365 days) to allow incorporation of FCR outcomes into the initial system.

Answer:

The Government’s intent is for the Final Configuration Review (FCR) to occur prior to delivery of the first system/unit. The FCR is a critical milestone to ensure that all design, configuration, and documentation are finalized and approved before production and delivery. The delivery timeline for the first system/unit—120 days after receipt of the Delivery Order—assumes that the FCR and any required actions are completed within that period.

If, due to the complexity of the system or the need to incorporate FCR outcomes, additional time is required to ensure compliance and quality, the contractor should promptly notify the Contracting Officer. The Government may consider extending the delivery timeline for the first unit on a case-by-case basis if justified by the need to address FCR outcomes or other factors outside the contractor’s control. Any such extension must be coordinated and approved by the Contracting Officer.

Q38.

Delivery Rate Requirements:

Question:

Can the Government clarify whether the required delivery rate is a firm requirement for all delivery orders, or if alternative delivery schedules (e.g., one (1) unit per month) may be proposed to account for chassis vehicle lead times, testing requirements, and delivery logistics to varying locations?

Answer:

The required delivery rate is a firm requirement: delivery of the first system/unit shall occur no later than 120 days after receipt of the Delivery Order, followed by delivery of two systems/units during each following month until the delivery order is complete. However, the Government recognizes that certain circumstances such as chassis vehicle lead times or other obstacles outside of the contractor’s control may arise. In such cases, the contractor should promptly communicate with the Contracting Officer. The Government may consider updated delivery terms or negotiate alternative schedules on a case-by-case

Mobile X-Ray Inspection Vehicles basis, as appropriate. All requests for adjustments must be coordinated and approved by the Contracting Officer.
